However, the divorce obtained abroad must be passed upon judicially by a Philippine court to prove its validity before the Filipino spouse can remarry under Philippine law through the process of Judicial Recognition of Foreign Divorce (JRD).
The decision of the Philippine Court shall become the basis for the annotation of civil registry documents. Indeed, Recognition of Foreign Divorce in the Philippines requires a court case to recognize a valid foreign divorce between a Filipino and a foreigner. It allows you to correct your Philippine marriage record to reflect the divorce. Second paragraph of Article 26 of the Family Code of the Philippines: “Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien Spouse capacitating him or her to remarry, the Filipino Spouse shall have capacity to remarry under Philippine law.” A valid divorce decree obtained abroad is not automatically recognized in the Philippines. A foreign divorce decree must be proven, just like any fact, in the Philippine jurisdiction. The proper petition must be filed in court. 1. There is a valid marriage that has been celebrated between a Filipino citizen and a foreigner; and
2. A valid divorce is obtained abroad by the alien spouse capacitating him or her to remarry.” “The reckoning point is not the citizenship of the parties at the time of the celebration of the marriage, but their citizenship at the time a valid divorce is obtained abroad by the alien spouse capacitating the latter to remarry.” dual citizenship and divorce; divorce and dual citizens; divorce obtained after naturalization; divorce after being naturalized as foreign citizen; divorce after acquiring US citizenship; divorce for dual citizens; canadian dual citizenship and divorce decree.
It make sense really coz you are both Filipino and living abroad. It is not under the foriegn laws to disolve the marriage of another country. Its not their business to do so. My properties in the Philippines cannot be included during my divorce in Australia coz it is not under the Australia’s jurisdiction. It had to be done in the Philippines though I became an Australian and soon American so my ex an Australian can never touch my properties ie: he is not listed co owner coz they can’t own properties in the Philippines. It was an accidental loophole that protected me from splitting my assets.

Kailangang kailangan talaga na magkaroon ng divorce sa Pilipinas. Kasi kahit walang divorce ay naghihiwalay din naman ang mga tao. Tapos may kaso pa na kahit matagal silang naghiwalay at pareho silang nagkaroon ng ibang pamilya, nung namatay yung lalaki ay inangkin siya ng unang asawa samantalang nagmove on na siya at andiyan ang kanyang second husband. Ng dahil lang sa 10k na insurance money. It's so unfair.. At marami din nagkakasakitan.. walang takas ang babae kahit binubogbog dahil walang divorce..
Hindi lang talaga hiwalay ang problema ang ibang foriegner na ex husband ayaw na nila ipagamit yung apelyedo nila kasi wala na nga kayo.kaso di Mo pwede baguhin yun kung di ka naka pa file juridecial recognition kailang pa yun para mabago yung apelyedo Mo.yun ang hirap Hindi kasi maiintindihan yun nang iba.at isa pa napakamahal nang bayad tapos yung dala Mo pera pa pinas konti lang saan ka pupulot nang bayad.ok lang sana kung na 500pesos lang at madali lang yung prozess mag aantay ka pa nang matagal ok lang sana kung one week lang.sa ibang bansa ang Dali lang nang processing nila Sa devorce at di mahal yung bayad kasi kasi kung sino yung May trabaho or kung sino yung nag file nang devorce sya yung mag babayad nang devorce. At isa pa May embassy naman bawat bansa,isa pa wala naman kaibahan Sa kanila at Sa pinas para yung bayad instead Sa pinas embassy na lang diba...

Hi Atty, need pa bang mag file divorce kahil NULL VOID ang marriage? nakalagay po sa marriage contract Republic Act No. 76 which stated there is no legal impediment in this celebration of matrimony. kinon sulta napo namin sa Local Civil Registrar , ang sabi po ng authorized person, NULL VOID daw ang Marriage Contract.
1980 pa ang wedding at naghiwalay sila 1998 until now. 20 years na po silang seperated at no communication. pwede pa ba syang magpakasal uli.? Salamat po.

If you are referring to an annulment of marriage in the Philippines, yes, it is different from a divorce decree obtained abroad. If the husband was still a Filipino citizen at the time that he obtained the foreign divorce decree, there would be a challenge when you apply for judicial recognition of the divorce decree in the Philippines because the law requires that the other spouse is a foreigner at the time of the divorce. But to my mind, it can be a good test case because the intention of the law is to remove the unfairness on the part of the Filipino spouse who is barred from getting married again while the other spouse who is now a foreigner is enjoying his/her life free from the marriage bond.

Philippines doesn’t have a divorce law except for the divorce allowed under the Muslim Personal Code. What we have under the Family Code are Declaration of Nullity of Marriage and Annulment of Marriage. But mere separation in fact or lack of support is not a ground for either of them.

Kung parehong pinoy at nag divorce abroad, hindi po ito recognized ng Philippine law. Hindi po allowed na magpakasal ulit sa Pilipinas. Wala pong jurisdiction ang Philippine court sa ibang bansa so our law on Bigamy does not extend there.

If your divorce was not yet judicially recognized in the Philippines and not recorded in the Civil Registry, your marriage in the Philippines still subsists. You cannot contract another marriage. Contracting another marriage while the first marriage is still subsisting would constitute a bigamous marriage.

Since you are a foreign citizen, your status, condition and legal capacity are now governed by your present national law. If divorce is allowed under your present national law, then you can possibly apply for divorce in that foreign country on the assumption that you qualify under such law. But as to whether or not you can invoke Article 26 of the Family Code of the Philippines for purposes of re-marriage in the Philippines, Philippine jurisprudence says you cannot.
