Please let us get there. During episode 1, we discussed how our opinions of Walter White completely changed in earlier seasons upon re-watch of BB, so I understand how much can change on a re-watch. Aw that's a shame, but totally understandable. My opinions on the BCS characters changed so much over the show, same thing with Breaking Bag (I actually didn't really enjoy the show until I saw the whole picture haha and it made BCS just that much better). I really enjoy your reactions and thoughts - it sucks if we have to wait a little while to get the rest of it, but it sucks even more for you to get spoiled - the story of this show is special and it's fun to form your own opinion about it. Big law firms are all about reputation and image. People pick lawyers by what they imagine the company to be. Unless it’s a minor item you don’t pick some unknown. This ad portrays their firm are ambulance chasers. So not getting approval is a big issue.
I'm sympathetic to Jimmy and our hosts here because it is true that hobbling yourself for a case because of reputation concerns outside the case seems...bad. An actual disservice to your clients, arguably malpractice/negligence. It's not that the reputation concern is made up, it's just that if you take on a case you should be willing to pursue the case effectively, including an ad tailored to people relevant to that case, even if they're not your usual "high class" clientele. If they're not willing to advertise to the class of clients for this lawsuit, t makes you think this is not the right firm to have taken on this case.
Jimmy would like to live in a world where a firm can do the best work they can when it's a corporate case, and also do the best work they can when it's an ambulance chasing case. And we just don't live in that world because the world is shallow. His problem is he's also willing to act like we do live in the world he wants even though he knows we don't.
Oh and frankly Kim could've directly confronted him about this. You probably have to explain her not calling Jimmy out on his self-deception, with her own self-deception that Jimmy got approval for it despite Jimmy not actually saying "I showed it to the partners and they approved" (I don't think). But how much healthier would it have been to just have that conversation "look...I think you know, but maybe you don't, this is how reputation works, and this is why most law firms like ours aren't going to run that ad. Did you actually get it approved." It's not her job to control Jimmy, but HHM aren't wrong to say, she should've known.
Eh it really doesn't. He was wrong to not ask for permission regardless, but, that ad is better written, shot and directed - being an actual professional film production from experienced directors in real life, directing an amateur ad in their show - than 99% of any law firm related ads you'll ever seen on TV in your entire life. The mesothelomia one, for instance, is the real commercial that ran CONSTANTLY on TV during the 90s. And it sucked. If you want to see "ambulance chaser" ads or just straight up awful law firm advertising, take a look at something like Jim Adler the Texas Hammer. Class action suits are rarely ambulance chase lawyers, either.
Problem with Jimmy's commercial is that it is predictive of future behaviour He showed his bosses that he is willing to make company wide decisions without consulting them. That is a massive problem for them. And this is problem for Jimmy all the time. He constantly makes decision for other people because he knows they wouldn't agree to them and he thinks he knows better and can just explain himself afterwards.❤❤❤
it's also not the image that they want to project. The Sandpiper case is potentially very valuable... but it's not a high priority for them. They've spent decades cultivating an image as a prestigious lawfirm to attract clients like big banks and corporations with deep pockets... the commercial that Jimmy put together looks less like one such a lawfirm would run and more like some fly-by-night ambulance chaser lawyer's ad... not quite as bad, yet, but similar to the ads that Jimmy would make for himself in the future as Saul Goodman. The ones that made Walt say "you would have been the *last* lawyer I would have gone to"... the theatrics play well with certain people... but not with the type of clients that this lawfirm is hoping to attract.
This is a point I see so many reactors shrug off. In no world would this be acceptable at ANY law firm. I understand that most business' are results oriented, but that completely misses the point.
@@OldDominion80 Not just law firms but ANY large corporation. They all have very strict branding guidelines that all forms of marketing must get approval from the higher-ups.
Yeah, unfortunately Chuck's not wrong that it's not about a specific law or rule or principle or code of conduct, it's about a pattern of behavior. You can't just change the circumstances or context and act like you've totally changed, if that pattern is still there.
As someone who struggles with anxiety & procrastination and was unemployed for a few years, I related to Chuck's criticism of Jimmy in that I had to realize "yeah just because I have a job now and am staying on top of things enough that it's pretty stable, doesn't mean I don't still have things to work on, or that it's acceptable to routinely let things slide just because I know where the limits are."
The thing with Breaking Bad and Better Call Saul is that they actually would go out of their way to use real numbers that are setup so that if you call them you'd get a message from the fake company you'd call. I know of a few youtubers who used to call the numbers on their channels to let people hear the messages that the answer machine would leave. There fore making the show seem more realistic as if it is based in our universe.

I am always surprised why no one comments on the behavior of Mike's daughter-in-law. For several episodes now, you can see how she is stretching Mike to spend more and more. Here we had a very obvious scene where she faked gunshot marks to get Mike to move them to a better, more expensive place. Mike has been there, knows it's a scam, but accepts it for the sake of his granddaughter and risks his own life to earn the right amount. This adds an extremely bitter edge to his efforts.
Consider this scenario. Say you hire an accountant. Then they make a pitch to you about a money investment idea. You say you'll think about it. Then behind your back they use your accounts to make the deal and it makes money. This is an extreme example, despite the fact that the result was positive you would feel conflicted about the results were achieved. Trust would be broken. Regardless of the results someone made a unilateral decision in your name that affects your standing. It's hard to feel completely happy with the gains when the knowledge of how much this person over stepped their bounds and the fear of what the could do if you just continue to act like this go on. Are they supposed to act blindly to Jimmy's actions and hope it just works out every time? Jimmy just should've shown them the ad and let the chips lie where they fall. That was the true right thing to do, but he acted impulsively. Actions have consequences.
I think lots have said this but the bottom line is D&M has to hold Jimmy accountable. Success or not, he acted on behalf of the partners by running the ad especially when he knew Clifford wanted to discuss it first. If he had presented it and they approved it or edited or rejected it, that is their call, not Jimmy’s. Imagine you have an editor for your channel that makes up a promo and posts it before checking with you. It gets you get a ton of new subscribers but it promises or implies something you can’t uphold or discloses something you didn’t want aired.
Yeah, and maybe that 'great initiative' by the scrappy editor is so bad for your reputation that a lot of patrons take their business elsewhere. I didn't get it at first either. Yeah, he should have gotten permission first, but why the hostility when it worked out so well? But that was naive. Not only do they have a RIGHT to be angry, it 100% makes sense too.
The hypothetical is slightly different because Jimmy's ad didn't promise or imply anything untoward, the disagreement was purely stylistic. It was melodramatic and that is enough to make them "look bad". And that's hard to relate to. Part of the show is Jimmy and many viewers looking at some of the codes of behavior of "upper crust" people/law firms and tearing their hair out "why are you so uptight!" But in the end you can't deny, in ANY job even a much lower paid one, sneaking around your boss is always gonna put you in hot water.
I'm trying to imagine if a new editor threw in a very high-intensity intro to a video with like, pro wrestling walkout music, and then lots of aggressive meme-y cuts in the edit, that would be a wildly different style than the current videos, and would definitely earn a "WOAH, ok we're gonna have to get on the same page what style we're going for here and run the next few by us." Would it rise to the level of "you've damaged our reputation?" Hm. It's just hard for me to see it as quite the same severity as the law partners did. And even if it was, for a YT channel, the video IS the product, whereas Jimmy's video is one ad tailored appropriately toward one case.
It blows me away that people don't understand that as successful as the commercial is, there are clients that pay Davis & Main a LOT of money who don't want to be associated with a firm that even gives off a hint of what's known as "ambulance chasing." My brother-in-law is an attorney. His firm would NEVER go for that. His firm has spent years conducting their business in a specific way. Their clients expect that type of conduct to continue. A commercial that doesn't stay on brand could damage what they've built beyond repair. That's not to say it's always bad. To each his/her/their own, but certain firms have to be very, very, very conscientious of how things look. Their brand being associated with that commercial could have serious negative effects on current clientele. The one partner said it all: "The Sandpiper case isn't what keeps the lights on here." As great of a case as it is, their current clients are way more important than getting 200 phone calls and winning the Sandpiper case, as big as it is.
Yeah, I do not get how people can't understand this either. There are no circumstances whatsoever where ANY company or business is going to be even remotely ok with a random employee making and releasing unapproved promotions or advertising... let alone a new hire making unapproved totally off-brand advertising. That is a huge misconduct problem, and is absolutely a fireable offense. The company could even sue for damages (and would probably win). Even if Jimmy would have reused the template from the mesothelioma commercial, he still would have been in a lot of hot water with Davis & Main. It wouldn't have been nearly as egregious, but still would have been completely inappropriate and unacceptable. There is nothing good or right about what Jimmy did, it's just more classic Slippin' Jimmy behavior.
Sounds like they shouldn't have taken on this case and are now letting other cases and clients interfere with their professional responsibility to advocate for their Sandpiper clients, if they're not willing to do effect outreach to the class being represented by the suit.
That's literally not ambulance chasing. I recommend actually watching TV some day. You'll see ambulance chaser ads. They have the production value and sound normalization of a used car lot commercial.
Jimmy doesn't have license to speak for Davis and Main, he works for them, but he is an employee, not a decision maker in leadership. I think if Jimmy had kept the firm's name out of the commercial and just had a burner phone number to call for more information about it, they would have been mad still about not seeking permission, but not nearly as much so as the firms reputation would have been intact. That's what they are really mad about, Jimmy presuming to think he can speak for them. In this case I disagree with you, I don't think it was Chuck egging Howard on, again, to highfalutin lawyers, reputation is everything. Howard stuck his neck out promoting Jimmy to D&M, probably more than a little due to Kim's prodding, and now its blown up in his face. Clifford now will think less of Howard and the only one he has control over to punish for it is Kim, so he will punish Kim.
The actor playing “TUCO”he was also in another great series called “The Closer” starring Kyra Sedgwick, he played a detective. Was a great show and everyone on it was great! Raymond Cruz! Season 4 , episode 7 : Sudden Death ( The Closer) So Good!!! He did such a great job!!
i never realised it when i first watched BCS but this reaction made me realise that Mike is responsible for so much more that happens in Breaking Bad. He doesn't kill Tuco and gets him arrested instead, where he shares a cell with Skinny Pete who vouches for Jesse and Walt and is how they get involved with Tuco.
And keep paying attention in BCS too, because Mike much more culpable in how Jimmy turns out than most people like to admit, because Mike is "the good guy" that breaks the law and murders people.
I forgot about the Skinny Pete connection haha, nice recall. During this video's intro when they were comparing BCS to BB, I was thinking...as good as this show is, it completely revolves around BB, while BB stands on its own. Making so many things in this show (especially with Mike & Nacho) connected to stuff that happens in BB is definitely FUN, but sometimes I think, maybe it didn't need to make it QUITE such a small world.
Arguably, that was not permitted solicitation of or advertising to new members to a class action, and that has the potential to prevent or significantly delay and encumber certification of a valid class, putting the entire case in jeopardy.

Hi guys, Happy New Year! This episode presents a big legal issue that you, Daniel, and most people do not know about. State bar associations (which license attorneys to practice law in their state) have very strict rules regard attorney solicitation of potential clients. For example, the California Bar Association has a rule (Rule 7.3) that attorneys cannot solicit clients in person, by phone, or through real-time electronic contact if their primary motive is financial gain. Violating these solicitation rules is problematic not only for the attorney in question, but his or her law firm, which is why the Davis & Main partners are so upset. While it is highly unlikely that an attorney could be disbarred for one unethical client solicitation, a California attorney can be disbarred for improper solicitations, as it is considered a violation of professional conduct rules and can lead to disciplinary action by the State Bar, including disbarment depending on the severity of the misconduct involved. Law schools cover attorney solicitations and what is and is not proper in a second or third-year course called "Ethics." I hope this helps clarify why improper attorney solicitation is a big deal.
Real law firms aren't about their clients. They're about their position within the whole system. Jimmy joined a firm that had built itself a respected position in that system, including high-level corporate clients who pay the bills for feel-good pro bono clients. Jimmy isn't about the ecosystem, just the rush of the moment.

I read the Ad thing a different way. There is a path Jimmy could negotiate with D&M to do a single airing in order to proof it will work while talking down the consequences. But Jimmy is not doing this because he lacks the self-esteem to do so (As shown in the guitar scene). So instead of facing his problems, Jimmy acts in a destructive way - evon though Kim warned him about doing things like that. And why does Jimmy lack the self-esteem? Bang! We are back to Chuck (piece of shit).
Love the show specific intro. Btw, thank you to Raymond Cruz for bringing back Tuco so we could get that epic scene of him versus Mike. BCS gives us those moments we never got in BB and I’m all for it.

The big problem Davis & Main had was that they felt the style of the ad appealed to a 'lower class' of clientele than their usual large corporate clients and were concerned with protecting their image.

It's not about legality. If he had just showed them first they would either allow it or not but if not they would at least explain why. Jimmy doesnt care about the why because his ends always justify the means. He had every chance to show them first but decided not to. The content of the ad isnt the issue. I love Jimmy but there's a reason he ends up as a criminal lawyer. Proffesionally he as an arsonist chimp with an m16 but that's what he excels at so you know... whatever I'm lost, isnt free to call 911 from payphones?
I wonder what would happen if Jimmy was willing to consider another career outside of the law. He seems like he would enjoy something like advertising or filmmaking a lot more and would make a better use of his talents and wouldn't have jerks like Chuck breathing down his neck all the time.
I can see why you would be rooting for Jimmy and against D&M, but when you remove yourself from the protagonist trance, the whole fiasco really was a slimy move by Jimmy. D&M's Mesothelioma ad (based on real firm ads I've definitely seen) needed approval because it represented their entire Firm. Jimmy's ads are goofier and make him out to be an ambulence-chasing slime-ball to many people, which reflects poorly on D&M. The fact that he pretended to Kim that he got it approved was the cherry on top. Chuck is right about his brother; whether Chuck's actions have hindered or only advanced Jimmy's transformation into Saul is a different discussion.
I think the one question that's good to ask when people are confused about why Jimmy's commercial got them all in trouble is what do you think when you see cheesy commercials for lawyers on tv? A lot of clients for law firms that pull in a lot of money simply do not like if their lawyers look like ambulance chasers. It's an image Jimmy was trying to fight and was perpetually confused about. There are strict rules around law advertisements because it used to not even be legal to do so. And Chuck was correct that Jimmy was basically angry that he misled Kim and she trusted him.
I am always so shocked how no one gets this, but it's more than that too, he went behind the firm's back and used their name and everything without permission. These are lawyers, suing and lawsuits are always on the mind. Plus the rep.

Now, they have taken a position, but it's completely informed. Nothing to do with a lack of intelligence, just your preconceptions. Maybe you're just not fully understanding the Jimmy character.

You have to get legal sign off on commercials, especially if you are a legal firm. I was in the gaming industry and would never think of running a TV ad without getting our in-house attorney to review to make sure we weren't at risk. Still, was an amazing commercial and it looks like he used the previous end-screen, so not sure why they got that angry. Also, the gun dealer was the same one in BB that sold Walt a pistol and a machine gun at the end, and Crazy 8 in his Tampico shirt also made an appearance.
He used the firm’s name without permission. I’d be pissed if someone decided - on their own and without my permission - to represent MY company to the public. Jimmy was clearly in the wrong here.

The terrible ad vs Jimmys ad perfectly encapsulates Chuck v Jimmy. One is professional and technically accurate and bougie, and the other is flamboyant and effective and frugal.
Jimmy's commercial reeks of an "ambulance chaser" borderline cheesy. It's like one of those after midnight commercials you would see on TV, I totally understand why Cliff wouldn't want his firm connected with such a commercial.

We should self-sabotage our case with ineffective client outreach because we don't want to be ambulance chasers (even though we actually did take on a case representing these people who really were victimized and deserve financial compensation). I totally understand why Jimmy thinks everyone who thinks this way has their head up their ass.
Ricola commercials were everywhere in the 80s/90s. Wayne's World parodies them, The Office had references to them. Americans know Ricola. That young character in this episode of BCS is a bit too young to remember, but oh well. The important thing is that the figurine he's making fun of comes back in a major way.
It's never confirmed, but its possible the elder woman, (Elma May) in El Paso, could be related to Steve Gomez. In a B.B. episode I remember Steve mentioning his aunt who lived in a neighboring area to Abq.
Davis and Main was upset because they have a reputation with clients that are much more important than the one sandpiper case. The ad made them look like ambulance chasers. Which Jimmy is.
The way I see it, the problem with the ad wasn't really that it looked "lower class" than their usual clients. It's like a emotionally manipulating clickbait article in video form and this company doesn't do clickbait. If this was a newspaper, he'd be fired immediately. Having said that, the ad they went with in the end will do exactly nothing for the case. I would be surprised if they get a single call from it and they probably don't care. At this point it's about making people (or more accurately other law firms) forget about the original ad. However, it's very reasonable to assume that HHM shared the case with D&M because of their reputation and if D&M did ads like this all the time, HHM maybe would've gone with another firm.
As someone who has stopped working at "real" jobs over the number of times I've been in trouble for taking initiative and doing something positive for the company, I'm on Team Jimmy™ here.

Big law firms are all about reputation and image. People pick lawyers by what they imagine the company to be. Unless it’s a minor item you don’t pick some unknown. This ad portrays their firm are ambulance chasers. So not getting approval is a big issue.
The mesothelioma ads make me think that just as much, though.
I'm sympathetic to Jimmy and our hosts here because it is true that hobbling yourself for a case because of reputation concerns outside the case seems...bad. An actual disservice to your clients, arguably malpractice/negligence. It's not that the reputation concern is made up, it's just that if you take on a case you should be willing to pursue the case effectively, including an ad tailored to people relevant to that case, even if they're not your usual "high class" clientele. If they're not willing to advertise to the class of clients for this lawsuit, t makes you think this is not the right firm to have taken on this case.
Jimmy would like to live in a world where a firm can do the best work they can when it's a corporate case, and also do the best work they can when it's an ambulance chasing case. And we just don't live in that world because the world is shallow. His problem is he's also willing to act like we do live in the world he wants even though he knows we don't.
Oh and frankly Kim could've directly confronted him about this. You probably have to explain her not calling Jimmy out on his self-deception, with her own self-deception that Jimmy got approval for it despite Jimmy not actually saying "I showed it to the partners and they approved" (I don't think). But how much healthier would it have been to just have that conversation "look...I think you know, but maybe you don't, this is how reputation works, and this is why most law firms like ours aren't going to run that ad. Did you actually get it approved." It's not her job to control Jimmy, but HHM aren't wrong to say, she should've known.
Eh it really doesn't. He was wrong to not ask for permission regardless, but, that ad is better written, shot and directed - being an actual professional film production from experienced directors in real life, directing an amateur ad in their show - than 99% of any law firm related ads you'll ever seen on TV in your entire life. The mesothelomia one, for instance, is the real commercial that ran CONSTANTLY on TV during the 90s. And it sucked. If you want to see "ambulance chaser" ads or just straight up awful law firm advertising, take a look at something like Jim Adler the Texas Hammer.
Class action suits are rarely ambulance chase lawyers, either.
Problem with Jimmy's commercial is that it is predictive of future behaviour He showed his bosses that he is willing to make company wide decisions without consulting them. That is a massive problem for them. And this is problem for Jimmy all the time. He constantly makes decision for other people because he knows they wouldn't agree to them and he thinks he knows better and can just explain himself afterwards.❤❤❤
it's also not the image that they want to project. The Sandpiper case is potentially very valuable... but it's not a high priority for them. They've spent decades cultivating an image as a prestigious lawfirm to attract clients like big banks and corporations with deep pockets... the commercial that Jimmy put together looks less like one such a lawfirm would run and more like some fly-by-night ambulance chaser lawyer's ad... not quite as bad, yet, but similar to the ads that Jimmy would make for himself in the future as Saul Goodman. The ones that made Walt say "you would have been the *last* lawyer I would have gone to"... the theatrics play well with certain people... but not with the type of clients that this lawfirm is hoping to attract.
This is a point I see so many reactors shrug off. In no world would this be acceptable at ANY law firm. I understand that most business' are results oriented, but that completely misses the point.

Yeah, unfortunately Chuck's not wrong that it's not about a specific law or rule or principle or code of conduct, it's about a pattern of behavior. You can't just change the circumstances or context and act like you've totally changed, if that pattern is still there.
As someone who struggles with anxiety & procrastination and was unemployed for a few years, I related to Chuck's criticism of Jimmy in that I had to realize "yeah just because I have a job now and am staying on top of things enough that it's pretty stable, doesn't mean I don't still have things to work on, or that it's acceptable to routinely let things slide just because I know where the limits are."

The thing with Breaking Bad and Better Call Saul is that they actually would go out of their way to use real numbers that are setup so that if you call them you'd get a message from the fake company you'd call. I know of a few youtubers who used to call the numbers on their channels to let people hear the messages that the answer machine would leave. There fore making the show seem more realistic as if it is based in our universe.

I am always surprised why no one comments on the behavior of Mike's daughter-in-law. For several episodes now, you can see how she is stretching Mike to spend more and more. Here we had a very obvious scene where she faked gunshot marks to get Mike to move them to a better, more expensive place. Mike has been there, knows it's a scam, but accepts it for the sake of his granddaughter and risks his own life to earn the right amount. This adds an extremely bitter edge to his efforts.

Consider this scenario. Say you hire an accountant. Then they make a pitch to you about a money investment idea. You say you'll think about it. Then behind your back they use your accounts to make the deal and it makes money. This is an extreme example, despite the fact that the result was positive you would feel conflicted about the results were achieved. Trust would be broken. Regardless of the results someone made a unilateral decision in your name that affects your standing. It's hard to feel completely happy with the gains when the knowledge of how much this person over stepped their bounds and the fear of what the could do if you just continue to act like this go on. Are they supposed to act blindly to Jimmy's actions and hope it just works out every time? Jimmy just should've shown them the ad and let the chips lie where they fall. That was the true right thing to do, but he acted impulsively. Actions have consequences.

I think lots have said this but the bottom line is D&M has to hold Jimmy accountable. Success or not, he acted on behalf of the partners by running the ad especially when he knew Clifford wanted to discuss it first. If he had presented it and they approved it or edited or rejected it, that is their call, not Jimmy’s.
Imagine you have an editor for your channel that makes up a promo and posts it before checking with you. It gets you get a ton of new subscribers but it promises or implies something you can’t uphold or discloses something you didn’t want aired.

I didn't get it at first either. Yeah, he should have gotten permission first, but why the hostility when it worked out so well? But that was naive. Not only do they have a RIGHT to be angry, it 100% makes sense too.
The hypothetical is slightly different because Jimmy's ad didn't promise or imply anything untoward, the disagreement was purely stylistic. It was melodramatic and that is enough to make them "look bad". And that's hard to relate to. Part of the show is Jimmy and many viewers looking at some of the codes of behavior of "upper crust" people/law firms and tearing their hair out "why are you so uptight!" But in the end you can't deny, in ANY job even a much lower paid one, sneaking around your boss is always gonna put you in hot water.
I'm trying to imagine if a new editor threw in a very high-intensity intro to a video with like, pro wrestling walkout music, and then lots of aggressive meme-y cuts in the edit, that would be a wildly different style than the current videos, and would definitely earn a "WOAH, ok we're gonna have to get on the same page what style we're going for here and run the next few by us." Would it rise to the level of "you've damaged our reputation?" Hm. It's just hard for me to see it as quite the same severity as the law partners did. And even if it was, for a YT channel, the video IS the product, whereas Jimmy's video is one ad tailored appropriately toward one case.

It blows me away that people don't understand that as successful as the commercial is, there are clients that pay Davis & Main a LOT of money who don't want to be associated with a firm that even gives off a hint of what's known as "ambulance chasing." My brother-in-law is an attorney. His firm would NEVER go for that. His firm has spent years conducting their business in a specific way. Their clients expect that type of conduct to continue. A commercial that doesn't stay on brand could damage what they've built beyond repair.
That's not to say it's always bad. To each his/her/their own, but certain firms have to be very, very, very conscientious of how things look. Their brand being associated with that commercial could have serious negative effects on current clientele. The one partner said it all: "The Sandpiper case isn't what keeps the lights on here." As great of a case as it is, their current clients are way more important than getting 200 phone calls and winning the Sandpiper case, as big as it is.
And hence why Jimmy ends up practicing out of a strip mall under an alias.
Yeah, I do not get how people can't understand this either. There are no circumstances whatsoever where ANY company or business is going to be even remotely ok with a random employee making and releasing unapproved promotions or advertising... let alone a new hire making unapproved totally off-brand advertising. That is a huge misconduct problem, and is absolutely a fireable offense. The company could even sue for damages (and would probably win).
Even if Jimmy would have reused the template from the mesothelioma commercial, he still would have been in a lot of hot water with Davis & Main. It wouldn't have been nearly as egregious, but still would have been completely inappropriate and unacceptable. There is nothing good or right about what Jimmy did, it's just more classic Slippin' Jimmy behavior.
Sounds like they shouldn't have taken on this case and are now letting other cases and clients interfere with their professional responsibility to advocate for their Sandpiper clients, if they're not willing to do effect outreach to the class being represented by the suit.
Hopefully your brother in law doesn't take on cases to make himself look good then s*** on his clients there because of his "professional reputation".
That's literally not ambulance chasing. I recommend actually watching TV some day. You'll see ambulance chaser ads. They have the production value and sound normalization of a used car lot commercial.
Jimmy doesn't have license to speak for Davis and Main, he works for them, but he is an employee, not a decision maker in leadership. I think if Jimmy had kept the firm's name out of the commercial and just had a burner phone number to call for more information about it, they would have been mad still about not seeking permission, but not nearly as much so as the firms reputation would have been intact. That's what they are really mad about, Jimmy presuming to think he can speak for them.
In this case I disagree with you, I don't think it was Chuck egging Howard on, again, to highfalutin lawyers, reputation is everything. Howard stuck his neck out promoting Jimmy to D&M, probably more than a little due to Kim's prodding, and now its blown up in his face. Clifford now will think less of Howard and the only one he has control over to punish for it is Kim, so he will punish Kim.

i never realised it when i first watched BCS but this reaction made me realise that Mike is responsible for so much more that happens in Breaking Bad. He doesn't kill Tuco and gets him arrested instead, where he shares a cell with Skinny Pete who vouches for Jesse and Walt and is how they get involved with Tuco.
It was another half-measure that had serious repercussions.
And keep paying attention in BCS too, because Mike much more culpable in how Jimmy turns out than most people like to admit, because Mike is "the good guy" that breaks the law and murders people.

During this video's intro when they were comparing BCS to BB, I was thinking...as good as this show is, it completely revolves around BB, while BB stands on its own. Making so many things in this show (especially with Mike & Nacho) connected to stuff that happens in BB is definitely FUN, but sometimes I think, maybe it didn't need to make it QUITE such a small world.

Arguably, that was not permitted solicitation of or advertising to new members to a class action, and that has the potential to prevent or significantly delay and encumber certification of a valid class, putting the entire case in jeopardy.

Hi guys, Happy New Year! This episode presents a big legal issue that you, Daniel, and most people do not know about. State bar associations (which license attorneys to practice law in their state) have very strict rules regard attorney solicitation of potential clients. For example, the California Bar Association has a rule (Rule 7.3) that attorneys cannot solicit clients in person, by phone, or through real-time electronic contact if their primary motive is financial gain. Violating these solicitation rules is problematic not only for the attorney in question, but his or her law firm, which is why the Davis & Main partners are so upset. While it is highly unlikely that an attorney could be disbarred for one unethical client solicitation, a California attorney can be disbarred for improper solicitations, as it is considered a violation of professional conduct rules and can lead to disciplinary action by the State Bar, including disbarment depending on the severity of the misconduct involved. Law schools cover attorney solicitations and what is and is not proper in a second or third-year course called "Ethics." I hope this helps clarify why improper attorney solicitation is a big deal.

Real law firms aren't about their clients. They're about their position within the whole system. Jimmy joined a firm that had built itself a respected position in that system, including high-level corporate clients who pay the bills for feel-good pro bono clients. Jimmy isn't about the ecosystem, just the rush of the moment.

I read the Ad thing a different way.
There is a path Jimmy could negotiate with D&M to do a single airing in order to proof it will work while talking down the consequences. But Jimmy is not doing this because he lacks the self-esteem to do so (As shown in the guitar scene). So instead of facing his problems, Jimmy acts in a destructive way - evon though Kim warned him about doing things like that.
And why does Jimmy lack the self-esteem? Bang! We are back to Chuck (piece of shit).

The big problem Davis & Main had was that they felt the style of the ad appealed to a 'lower class' of clientele than their usual large corporate clients and were concerned with protecting their image.
Tuco clearly replaced those boxing gloves that Mike took off of him- he’s wearing them when Hank kills him in BB!

It's not about legality. If he had just showed them first they would either allow it or not but if not they would at least explain why. Jimmy doesnt care about the why because his ends always justify the means. He had every chance to show them first but decided not to. The content of the ad isnt the issue. I love Jimmy but there's a reason he ends up as a criminal lawyer. I can see why you would be rooting for Jimmy and against D&M, but when you remove yourself from the protagonist trance, the whole fiasco really was a slimy move by Jimmy. D&M's Mesothelioma ad (based on real firm ads I've definitely seen) needed approval because it represented their entire Firm. Jimmy's ads are goofier and make him out to be an ambulence-chasing slime-ball to many people, which reflects poorly on D&M. The fact that he pretended to Kim that he got it approved was the cherry on top. Chuck is right about his brother; whether Chuck's actions have hindered or only advanced Jimmy's transformation into Saul is a different discussion.

I think the one question that's good to ask when people are confused about why Jimmy's commercial got them all in trouble is what do you think when you see cheesy commercials for lawyers on tv?
A lot of clients for law firms that pull in a lot of money simply do not like if their lawyers look like ambulance chasers. It's an image Jimmy was trying to fight and was perpetually confused about. There are strict rules around law advertisements because it used to not even be legal to do so. And Chuck was correct that Jimmy was basically angry that he misled Kim and she trusted him.

And the rules and law governing solicitation of members to a class action are even more restrictive than those governing lawyers advertising in general. Jimmy’s solicitation and unapproved advertising has the potential to block certification of the class, putting the entire case in jeopardy. These were not small missteps on Jimmy’s part, and it is not at all clear that he was doing things the right way and within the law - probably not, in fact.

You have to get legal sign off on commercials, especially if you are a legal firm. I was in the gaming industry and would never think of running a TV ad without getting our in-house attorney to review to make sure we weren't at risk. Still, was an amazing commercial and it looks like he used the previous end-screen, so not sure why they got that angry.
Also, the gun dealer was the same one in BB that sold Walt a pistol and a machine gun at the end, and Crazy 8 in his Tampico shirt also made an appearance.
He used the firm’s name without permission. I’d be pissed if someone decided - on their own and without my permission - to represent MY company to the public. Jimmy was clearly in the wrong here.

The terrible ad vs Jimmys ad perfectly encapsulates Chuck v Jimmy. One is professional and technically accurate and bougie, and the other is flamboyant and effective and frugal.

It's never confirmed, but its possible the elder woman, (Elma May) in El Paso, could be related to Steve Gomez. In a B.B. episode I remember Steve mentioning his aunt who lived in a neighboring area to Abq.
ABQ is in New Mexico, El Paso is in Texas and they are 266 miles apart. So, there's that.
Davis and Main was upset because they have a reputation with clients that are much more important than the one sandpiper case. The ad made them look like ambulance chasers. Which Jimmy is.

The way I see it, the problem with the ad wasn't really that it looked "lower class" than their usual clients.
It's like a emotionally manipulating clickbait article in video form and this company doesn't do clickbait. If this was a newspaper, he'd be fired immediately.
Having said that, the ad they went with in the end will do exactly nothing for the case. I would be surprised if they get a single call from it and they probably don't care. At this point it's about making people (or more accurately other law firms) forget about the original ad.
However, it's very reasonable to assume that HHM shared the case with D&M because of their reputation and if D&M did ads like this all the time, HHM maybe would've gone with another firm.
