    The constitution isn’t up for debate. The second amendment isn’t up for discussion or debate, it say the right to keep and bear arms it doesn’t say militias right to keep and bear arms .

      funny how everyone debates and quotes the 2nd, but they always skip the first 4 words. A well regulated Militia.
      i mean it says regulated and controlled right off the bat. it doesn't say for personal use, not saying you cant have one. but it does say regulated and for what reason. show me where it says for self defense, i mean it only mentions the security of a free State. not your personal security, thats why its never quoted, because people would be lying to themselves.

      Rock on, good sir! The words of Trudeau and co. the past few years turn my stomach. But I also know many Canadians are similarly repulsed! We're in this together (well, we TRY at least. Powers that be likely try pin us against each other, and so on). Find myself disgusted by Canadian laws, but remind myself that a great many of you surely do not agree. USA isn't too far behind Canadian PC laws; here's hoping we ALL survive, regardless the nation :) .

      @@user-co1gu3lh8u Well first off the Jan 6th protests were legit when they were only in the protest phase and in designated areas and not going IN to the capitol building.
      When it turned violent it ceased to be freedom of speech and again they trespassed into the building.
      Protesting ON campus at a College/Uni is private property and hence freedom of speech cannot be used as an excuse if the Uni/College decides they think it's disruptive. They can trespass the students.

      ​@@_Make_America_Native_Again_.Free SPEECH is necessary and beneficial. Coercion of others via threats, explicit or implicit, is not acceptable. Although I'd argue that most of the speech going on right now falls into the former category, some of it extends into the latter. That has to stop. Also, free speech does not extend to criminal trespassing, nor to assault and battery. I've seen examples of these crimes occurring and going unpunished during these protests. Again, the majority have not done these things, but some have, and they need to be stopped. My advice: if you want to keep free speech free, then police your own, root out the troublemakers and "disinvite" them from your ranks.

      Justice Breyer: “The Constitution means what I say.”
      The function of the courts is to enforce the law AS WRITTEN irrespective of their personal feelings or beliefs. This is the Constitution I want. The Constitution that Breyer wants is toothless, powerless, meaningless, and worthless. It’s endured 236 years despite justices like him.

    just as your right to assembly doesn't mean you can riot without reprecustions, we still have laws in place that these colleges should ABSOLUTLEY be enforcing. Taking over property, vandalism, destruction, impeding the freedoms of others, violence and threats is what we have seen across these campuses not "protest"

    He has a duplicitous and false way of stating the two different approaches. Textualism is a part of the originalist tool box.
    Practical considerations are usually part of any decision making process. But the key here is whether he believes it is okay to basically legislate and regulate from the bench. And the record shows that he does believe in that far too much. That means he has little respect for law as all law is by definition original. When a law including constituitional provisions or statutes are proven impractical, whatever that may mean, then it is up to the representative or republican process to change it. It is not up to an arrogant self appointed bench politico to do that. They can opine but they cannot legislate. He is arrogant.

    As a kid watching tv I was always amazed and I always looked at that the Highest Supreme Court like they are the ones that makes the final decision and I looked at them with respect and integrity at the highest like wow!. Now I know why it's because they protect the constitution and thats is protecting the people of America our country our rights.❤🇺🇸

    I believe we should look to the intent of the Framers and any laws passed. It doesn't matter if they didn't know the internet was coming, For the Judiciary to do other than interpret the law as intended is Legislative. Perhaps that is why they like the concept so much.

    Justice Stephen seems like a nice guy, and he makes some good points. But I disagree the constitution should be "reinterpreted" because things have changed over time. Yes internet and stuff like that did not exist back then. But as he rightly pointed out the values are still relevant. You should still need a warrant to spy on our internet use for example. When you open the door to reinterpretation, you open pandora's box. The power of the constitution comes from the fact that it is a contract between "We the People" and Government. The contract does not change, even hundreds of years later. That is power.

    Breyer, "we'll have a constitution that no one will want". If that is the problem, then the constitution should be amended to be one that folks want, rather than having unelected SCOTUS legislate via broad interpretation to get one that they think people want. A fundamental problem is that process of amendment was made so hard that almost all reforms can't be accomplished, and ambiguities in wording or intent can't be resolved by fixing the constitution. The only way that reconstruction amendments were passed was because the southern states were not represented in Congress and they couldn't get back representation without approving them. Another fundamental problem is the movement of things that are political decisions into to being constitutional questions.

    Shannon is incorrect when she says that Breyer was not pushed to retire. Breyer was too conservative for the left, and the left did not want him on the bench for another possible 10 years or more, so they pushed him to retire and replaced him with a far leftie, KetanjJackson Brown. She does not know what a woman is, but maybe she can find it in a new and revised Constitution that is up with the times.

    Such an intellectual man, even though he would not necessarily agree with my views, having healthy debate and discussion without persecution and condemnation is what has made our country so much better than all the others. It would be refreshing if all the justices would sit down and have this kind of conversation and let the public see them outside of their day to day job. I am just not sure who could barter such an event given the biases of the media nowadays.

    To his statement "We have the words, the freedom of speech". Exactly, I agree, but it does NOT say the freedom of conduct that interrupts the daily lives of others and or either physically harms them, threatens them, or otherwise interrupts their daily lives. In the case of the college campuses, lives they HAVE PAID for i.e. tuition.
