Other sites have dug a little depper and found that it was the external translator companies that didnt push to have their individual translators credits as Nintendo always gives the general credit for these companies, unless they ask. Once again, people like to assume they know all the details and run with what they got; in order to paint a picture of what ever agenda they have for or against a company. Again, it is as you said and they did sign a contract, only to complain about it after the fact and its that companies' fault for not saying something before.
Agreeing to the terms and signing the contract doesn't make it any less bad or predatory. If I have no other job options, haven't worked on a project for weeks, and suddenly a company offers me a job, I would sign it in a heartbeat. It would be the difference between getting paid or being evicted. In that situation, the terms become acceptable concessions. People who are already well-known for their translation work can afford to turn down bad contracts, but these people obviously couldn't.
If I signed and NDA and didn't get credit, I would still list it. With the law nowadays regarding NDA's, I doubt it could be enforced with any type of significant penalty. Nintendo would have to go out of it's way to prove to a judge that the violation impacted revenue and continues to impact revenue. And if Nintendo was somehow successful, the only real recourse is a warning to the offender not to do it again. It's like digging up a drain because you dropped a penny down it. It's just not worth it.
