      Of course. Like back in the day when public meetings or trials were held in saloons or other privately owned establishments, they couldn't make up their own laws, ban witnesses, observers, speakers, etc. Once a government body takes up the affairs of government in any privately owned business, it becomes a public forum.
      If not, then county commissions could simply meet in the back room of any restaurant and ban any members of the public from attending.
      Churches that are polling places for elections can't ban Republicans...etc.

      He knows that. He's getting scared. It's sad really. I can't blame him. He's done way more than I ever have for sure... That being said, I emailed him the name of a lawyer in New Orleans a couple months ago about his Baton Rouge incident. He never responded to my email but literally within a week he was in Kenner Louisiana. You may have seen that fiasco too... anyway, I thought he must have called and seen the guy, but he never replied to my email or contacted the lawyer.

      @norfcalgreens you are correct. Government officials and persons in possession of private property are the only figures who can restrict your access to property. Suppose you lease/rent an apartment, the landlord cannot say who can visit you.

    It doesn’t matter if it’s leased private property. If it’s leased to the DOC or any government agency, that part of the building is public and open to the public. You’d only be trespassing if you entered the private businesses property and remained after being told to leave. The government part of that building doesn’t have the same protections

      Im pretty sure that Sean does know this, BUT our corrupt officials are learning new ways to silence freedom every day.@@Mitchell100k what they do is illegally arrest and press charges against people like amagansett acura amanda, rouge, erie county, sean, riot girl, and many others. just because the nazi's know that it forces the rights activists to be really really careful to not catch another charge which could produce more jail time without bail. so with sean having at least one court case coming up - he has to be extra careful - the nazi's know this and love it. he has been effectively neutered - they have vise-grip pliers on his nut sack and one more charge ( legal or not ) they will squeeze until he is castrated completely.

      Because the supervisor was DOCC police, the cops sided with the supervisor out of 'professioinal courtesy'. The supervisor is actually clever. He snookered the cops into believing that the landlord had a right to remove anyone from "his" property. That's not how property law works. But the police didn't know that.

    When an individual leases space to a government agency, he cannot restrict the access of the public in the parts leased to the state agency.
    If that was the case, the government could just lease properties from private individuals to restrict public access in all its forms which could be both prior restraint and unconstitutional.

    If there was ever a time when an audit requires more of a push back, this would be it. As you stated, Sean, the probation department within that building is governed by the same laws as any other state facility. Its office is 100% public. Leaving without solidifying that fact and educating those public servants was a missed opportunity as it now gives the false impression that you were NOT allowed to be there. An understanding of our rights was not established here, unfortunately. For the People, please make this right by correcting their behavior and setting those public servants straight. A victory lap is in high order for this location.

      This wasn’t a random audit, he’s laying the groundwork for exposing corruption. It starts with coming in with a camera, there will be revisits. Maybe a mass audit should be done. Are you busy? You could come, a show us how it’s done!

      Sean left having obtained enough to give him standing for a lawsuit. He had a clear threat of arrest based on his camera and exercising his right to remain secure in his belongings (identification). So beyond the public feedback addressing grievances with their government he has two legal options to proceed here. Firstly via Due Process clauses of the 5th and 14th amendments, and secondly via a lawsuit.

    IF IT IS LEASED BY THE GOVERNMENT, THEN IT IS STILL PUBLIC. THE AREA FOR THE PAROLE IS PUBLIC. THE OTHER PARTS LEASED BY OTHERS ARE THE PRIVATE AREAS. PLEASE CONFER WITH YOUR LAWYERS AND IF POSSIBLE, FILE THAT LAWSUIT!!

      Absolutely. Private leases to government public building then it becomes public. If I rent a property, I become master of the house and decisions on who can or cant be visitors is at discretion of the master. It would be illegal for instance if I was told by the actual owner I cannot have asian people enter the building.

And the first female security officer wasn’t at all surprised that she didn’t need to buzz him in, so I HIGHLY doubt they typically have it closed and locked. So they are likely also liars.

      You make a good point about the female officer not being surprised, but there also is a "Please ring bell" sign on the window pointing to the access pad (1:28, 1:38). Maybe it's an old sign. Or maybe they had parolees who claimed they arrived on time for their appointments, but there was nobody there to buzz them in.

We’ve seen in so many audits that whenever the government leases a space from a private owner, there MUST be public accessibility to the public areas of that building, and that the owner has no ability to trespass anyone from those areas. This "public serving" building has coded lockes on every single door explicitly keeping the public out. You are welcome to stand on the sidewalk and record, people do it all day long. But they cannot just come in, anytime day or night and record around the station, that is tax revenue funded and there to serve the public. You'll be arrested for trespassing.

      As a govnt employee I can tell you WHY they are never fired. They are part of a public union + the amount of time, effort, cost, use of supervisor time to train a new employee is thousands and thousands of dollars.

With the public entity being within the building the only way to trespass would be if the person was breaking a law, otherwise you can’t trespass someone from public property.

The elements of loitering are the individual things the prosecutor must prove in order to convict you of the offense. In order for you to be found guilty all of the following must be proven true:
      You remain in a public place;
      You do not have special permission to remain; and
      You are in the place for the purpose of engaging in a series of unpermitted activities.
      Filming is the purpose & cant be considered loitering. The cops cant use their opinion to determine if a loitering crime has occured. Their lawyers have to determine if a law was broke

    A new law needs to be passed - public officials refusing to identify while working should be instantly dismissed. How can you hold any of them accountable or praise them if they refuse to provide their details. They happily take our money yet provide miserable service to the public. Disgusting stuff.

      The supervisor is actually clever. He snookered the cops into believing that the landlord had a right to remove anyone from "his" property. That's not how property law works. But the police didn't know that. "Ignorance of the law is no excuse" - unless you are a police officer...

    Sean took the L here. Doesn't matter if the building is private if they are leasing it out to govt. agencies. At that point, the govt areas within the building become public (publicly accessible areas within the govt. agency) Sean should have explained this and went back inside or got the illegal trespass from the police.

      It is lease to we the taxpayers.
      That means we own the bldg till the lease is up.
      Now let me tell you why we the people are leasing private property.
      It’s called a bailout.
      The property owner probably can’t find tenants.
      He still has to pay property taxes so we are here to bail him out.
      It’s like how shopping centers go out of business
      It will turn into an abandoned eye sore land with homeless living in it. Graffiti, cars, appliances dump.
      This building that we let our public servants work in might belong to a politician that is partnering with the failed grumpy land owner that wants to kick out Sean.
      We the people can stop paying him and take our money elsewhere and watch that land turn into a dump
      No good for the community
