Heck of a job keeping your cool and knowing the laws! I was saying that I bet management knows what the laws are and that they have probably illegally threatened others with trespassing who didn't know the full extent of the law and complied. They send the young green rookies out to do their bidding and if called out, they can just say the kid didn't know better. It's super important that we talk about the good and bad. When we only point out the bad, nothing productive happens. When we point out the good, maybe other officers will see that and try to improve how they do their job.
Are you? What was well done? The fact that the state allowed him to fish on a public lake is a "well done" from you? The guy had to have multiple permits and licenses to even be there. Then he has to follow multiple laws around what fish he can and cannot keep. Then he has to have a life jacket. Then he can only be on the water during certain times of the year. Your comment just shows how truly kuk'd out America is.

I find it frustrating, when these peeps think their bylaw or ordinance is more powerful than anything, including the constitution. It’s like private company breaking all sorts of laws, because their charter says it’s ok. Just doing that job, huh.
I would guarantee that management knows exactly what the laws are. They just don't like it when they have non paying people in the area where they and paying people operate their vessels. They tell the kids to do ridiculous things they would never do because they can blame the "green" rookies for not knowing. This ol boy called them out on it and this is what happened. Take that from someone from Germany, that just doing my work excuse, yeah that one is historically burned. Completely and entirely, forever. Thank the Germans for that. The "shower operators" during Germanys dark days collectively used that defense. Would recommend to actually never ever, absolutely never use it. It's no excuse for tyranny nor anything. The Germans are the reason, soldiers have a duty to ignore illegal orders, btw. If they act upon those orders knowing they were illegal, they are as culpable as the officer issuing them. If they callously follow illegal orders, they might still be culpable.
About 45 years ago a friend and I were fishing exactly the same way and that Marina called a deputy Sheriff to us and the deputy threatened to take my friend and I to jail if we didn’t leave. We knew our rights but left just because we didn’t want the confrontation and the fish weren’t biting. We left that day but we did fish there a lot of different times after that. At my age now I would stand up for my rights.

Being a DNR conservation officer for 12 year's, I'm glad to see this video! People think just because they own property around a body of public water that they own that water as well. Wrong!! Just like the airspace above your land! I retired from LEO after a bad accident and being a DNR officer is the only form of LEO I would've ever been. People like the Karen's in this video are what's wrong with this great country! The fisherman did nothing wrong, let the man enjoy his trip!!
In my line of work the air space thing comes up a lot. Hypothetically even if somebody did own the airspace it wouldn't matter because it is open to the public and it's regulated by the federal government, not the property owner. Property owners can't control the use of the airspace any more than they can control a public sidewalk that happens to be over their property line.
I had a homeless woman living in her van try to tell me I couldn't fish in a public pond at a park yesterday. She then proceeded to tell me the waste pump station nearby was connected to the pond, as if the city would pump raw sewage into an open pond that empties into a creek that dumps into the bay...I just shook my head and told her to shut up before I called the cops on her for illegally living in her van.
Nope this officer one must be a fisherman in his off duty hobbies so he knows two the call wasn't lied into with threats of violence or hostile actions which plays into how a cop is gonna proceed ans three as sad as it is.. in this case this officer does get an A+ that isn't always the case in his past or future encounters. There isn't enough officers to correctly have time to research a law before arriving therefore their default it to restore peace as fast as possible as there's only one officer for every 100,000 people.
He definitely shouldn't have been confrontational in the way he said everything, but I don't think its all on him. Sounds like his boss told him to get the fisherman out, and the employee didn't know any better. Ive worked in a marina the last 7 years, and my bosses enforce no fishing from the land (our property), but they made it well and clear to all of us that unless they touch land, they're in public waters and have the right to fish. Seems like the owner/manager of the marina is either willfully ignorant of the law, or sent out the employee to scare him off, assuming that the angler didn't know the law and wasnt familiar with his rights.

As a bass fisherman and someone who fishes tournaments all around, this has happened to me more times than acceptable. It's truly sad that ppl think they can stop someone from fishing a public lake.
That cop is top shelf. He's out here de-escalating with the fishing guy, he defends the golf cart kids as young guys just doing what their told. He's fucking chill and took 2 different people that were sporting for a fight and got them all calmed down. Literally the best cop.
Just because it is legal doesn't always make it right. You can't tell me a guy setup with multiple cameras isn't looking for encounters to video. He was 100% legal to fish there, just as he could fish in any other part of the lake.

I run go pros on my boat constantly. I like to film my best catches, and also having a camera running while operating any motorized vehicle is a good idea. I see non fisherman with go pros running on their boats at all times as well. It’s no different than people driving around with dash cams. You’re just assuming it’s for causing confrontation. Seeing this guys boat, and all the accessories, he’s got at least 90 grand into that thing. He spent all that money just to go out and hope someone has a problem with what he’s doing? Highly doubt that
I seriously doubt the marina employees were mistaken about people “illegally” fishing. The owner probably TOLD them to keep “his” marina clear. Probably has gotten away with it for years.

The fisherman is in the wrong in my opinion. It doesn’t matter if he is legally allowed to fish there or not. It is a matter of common courtesy as a fisherman to stay away from other peoples boats and don’t interrupt people trying to operate a business. The marina is being payed to watch those boats and keep them safe. They had every right to be concerned about a man casting his lines towards them
Happens all the time on my local lakes, dock owners think they own the water. I keep a piece of paper in my boat that has the Georgia anti-harassment of hunters/fisherman law on it as well as a copy of the navigable water's laws to shut them down. I also have the local ranger's phone number in case the land/dock owner just doesn't get it or really tries to escalate. Luckily, I have not had to use that number yet. I have given a copy of those papers to some dock owners over the years. Once they understand I am within my rights to fish around their dock and they do not own the water under it they stop with the harassment.
I don’t know what it is that pisses people off about fisherman, it always seems like someone has to start in on harassing fishermen who are out there trying to have fun. Apparently many people believe that they own the water
I used to work for a marina when I was young. Boats do get fishing line caught on the propellers a lot and it can cause a lot of damage to the motors. It's not cheap to get a propellor and seals replaced! Also, they have been known to hit boats and cause damage. They all aren't good at casting!
I love that he said "You probably know the law better than I do". Policeofficers often act like they are god who know everything better. But you can't know everything, and even tho he knew he gave kudos to the fisherman. Thats a no ego cop right there.
Another point I give Officer Luke an "A+" for is not requiring Mr. Royal to produce an ID. According to many, many other cops (including many featured here on ATA), the mere fact that they were responding to a call (as Officer Luke was), required them to ID the people they spoke to ("so they can put it in their report"). _If that were true_ (I know it's not), then Officer Luke just violated that law. Yes, Mr. Royal _voluntarily_ gave his first name, but Luke did not demand an actual ID as so many other cops would have.
It’s foolish to give any details even first name. A cop told me they use the first name with description to do a search. They can then upload your name on a database that then forms a historical background if you ever find yourself in court for any reason. It can convey that you are a problem. Same if you are arrested even if the charge is dismissed or you are freed before charges that stays on the record. This is why ATA saying comply and argue later doesn’t give the whole story. Getting your record cleared is incredibly difficult and rarely achieved. He’s way too fond of telling people to comply.
Guy on the boat was totally an asshole the guy on the cart was just doin what his boss told them , and he could know better about fishing laws for working at a marina but he might not be a fisherman and wouldn't know. Still, he or that guard should've just called the non emergency line find out for sure instead of continuing the conflict
To be fair, their employer probably ordered them to chase away "anyone fishing in the marina." Meaning someone fishing while standing on the marina docks. But the ambiguity of the phrasing meant it could have also meant someone fishing from a boat in the marina. And the Kens felt compelled to use the broad interpretation of their orders just to be on the safe side, to protect their job.

He was telling the kids to be respectful and watch how they spoke. or he would "come up there and give you one what for" that is a threat. I totally agree that the cop was very polite, respectful and he didn't take any sides because he knew how to do his job right and all cops in America should learn from this cop, because he didn't come off like he's a dictator demanding that the guy on his boat was doing everything illegal and listening to the workers from the marina. That's what a lot of cops do, they pick a side and make their own conclusions that you are guilty and then if you say anything to them with a tone that they don't like, then they have an attitude and then they just do whatever they want to you. Cops don't like to descalate a situation, because then they feel like they have no power over you and that's why there's only a few of them that will do their job right and the rest of them don't care about descalating, they care about is making people do what they say and if you don't then they will show you what will happen to you, because they wear a badge and a gun.

The fisherman was technically the victim of disorderly conduct, the perpetrators admitted they used fighting words, the victim was clearly offended by those fighting words. The cop never even explained to the perpetrators that they had committed a crime. That would have been proper police work. That way they would have legal reasons not to pick fights.

I always like this channel because, as law SHOULD be, it’s a balanced opinion. Good behaviour is called out as well as bad. Channel owner does the best job of providing legal support for his analysis. If he doesn’t teach law he damn well should be. This guy puts a lot of work into these videos with his legal research and does it in a way everyone can understand. As a former probation agent I can say that takes a huge amount of time and work.

No one is entitled to talk to anyone a certain way, but the fisherman was an ass as well. Instead of just ignoring and waiting for the cops, he raised his voice, interrupted, and popped off a threat to the kids too. Everyone in this video except the cop was rude.
The problem with some citizens they think they control everything. Just cause I don't like what you do. Everything public is for everybody. It's called public for a reason. We are all part of the public now. Is private then. It's private for a reason meaning you can't go on that private property. It's that simple so if it's public property, you have a right to go on there. Cause we are the public we. The people are the public.
YT has been known to censor(take down) videos for reasons. They own the platform, it’s theirs, right? So, they could tell content creators/yt channels that they are not allowed to post videos that contain ads because there are people that pay for the premium service to not have to watch ads. I’m just saying it seems to me that it is not impossible for them to take down videos because they contain ads, and they could do so if they chose to. Right? Or, I could be wrong. It may not be that simple. But it seems to me that since it’s their platform, they can take down videos and censor comments(I’ve had a few of mine disappear) for just about whatever reason they want.

Though its common for landowners to try and hide the public access points with logs or bushes. or put similar debris in the water near the access points. Maine law says the public has a right to access any body of water larger then 10 acres. Both the water, and a point to access the water. At least in theory
The difference between a regular sheriff/officer and a Wildlife and fisheries officer is night and day. Straight up. Dudes clearly WLF. These officers. I'd imagine that he did that just something write into the report in case something happens in the future and to cover all his bases. Officer Luke doesn't look like he wants to go around bossing people all day, you can tell those types the moment you see them
My only critique is how he talked to the young man on the golf kart. He’s young, he doesn’t know better. Don’t get hostile with him, just let him know he’s wrong and that he can go get his boss out here if he wanted something done about it. Yes, I know the young man was disrespectful but we all know what it was like when we was his age, we thought we knew everything….he should have just calmly explained to him why he’s allowed to fish there.

100% agree. Need more interactions like this one. Love your deep dive into the rules about how Texas law could classify property damage as a misdemeanor or a felony and how restitution could be involved, but, because of this. I feel it should be noted that if he accidentally damaged property, although he wouldn't be criminally charged, he could be subject to civil litigation for the damages.

I find it frustrating, when these peeps think their bylaw or ordinance is more powerful than anything, including the constitution. It’s like private company breaking all sorts of laws, because their charter says it’s ok. Just doing that job, huh.
I would guarantee that management knows exactly what the laws are. They just don't like it when they have non paying people in the area where they and paying people operate their vessels. They tell the kids to do ridiculous things they would never do because they can blame the "green" rookies for not knowing. This ol boy called them out on it and this is what happened. I would bet they have even illegally threatened with "trespassing" on others, doing the same thing before. They know what and how to get away with this kinda junk.
Take that from someone from Germany, that just doing my work excuse, yeah that one is historically burned. Completely and entirely, forever. Thank the Germans for that. The "shower operators" during Germanys dark days collectively used that defense. Would recommend to actually never ever, absolutely never use it. It's no excuse for tyranny nor anything. The Germans are the reason, soldiers have a duty to ignore illegal orders, btw. If they act upon those orders knowing they were illegal, they are as culpable as the officer issuing them. If they callously follow illegal orders, they might still be culpable.
About 45 years ago a friend and I were fishing exactly the same way and that Marina called a deputy Sheriff to us and the deputy threatened to take my friend and I to jail if we didn’t leave. We knew our rights but left just because we didn’t want the confrontation and the fish weren’t biting. We left that day but we did fish there a lot of different times after that. At my age now I would stand up for my rights.

Being a DNR conservation officer for 12 year's, I'm glad to see this video! People think just because they own property around a body of public water that they own that water as well. Wrong!! Just like the airspace above your land! I retired from LEO after a bad accident and being a DNR officer is the only form of LEO I would've ever been. People like the Karen's in this video are what's wrong with this great country! The fisherman did nothing wrong, let the man enjoy his trip!!

In my line of work the air space thing comes up a lot. Hypothetically even if somebody did own the airspace it wouldn't matter because it is open to the public and it's regulated by the federal government, not the property owner.
Property owners can't control the use of the airspace any more than they can control a public sidewalk that happens to be over their property line.

I had a homeless woman living in her van try to tell me I couldn't fish in a public pond at a park yesterday. She then proceeded to tell me the waste pump station nearby was connected to the pond, as if the city would pump raw sewage into an open pond that empties into a creek that dumps into the bay...I just shook my head and told her to shut up before I called the cops on her for illegally living in her van.

This is how law enforcement are able to act when given the "education" they need to enforce the law that they have been hired to do.

Nope this officer one must be a fisherman in his off duty hobbies so he knows two the call wasn't lied into with threats of violence or hostile actions which plays into how a cop is gonna proceed ans three as sad as it is.. in this case this officer does get an A+ that isn't always the case in his past or future encounters. There isn't enough officers to correctly have time to research a law before arriving therefore their default it to restore peace as fast as possible as there's only one officer for every 100,000 people.

He definitely shouldn't have been confrontational in the way he said everything, but I don't think its all on him. Sounds like his boss told him to get the fisherman out, and the employee didn't know any better. Ive worked in a marina the last 7 years, and my bosses enforce no fishing from the land (our property), but they made it well and clear to all of us that unless they touch land, they're in public waters and have the right to fish. Seems like the owner/manager of the marina is either willfully ignorant of the law, or sent out the employee to scare him off, assuming that the angler didn't know the law and wasnt familiar with his rights.

As a bass fisherman and someone who fishes tournaments all around, this has happened to me more times than acceptable. It's truly sad that ppl think they can stop someone from fishing a public lake.
In many states it’s illegal to harass a fisherman as they are used in wildlife population control. That includes cutting lines

Just because it is legal doesn't always make it right. You can't tell me a guy setup with multiple cameras isn't looking for encounters to video. He was 100% legal to fish there, just as he could fish in any other part of the lake.

I run go pros on my boat constantly. I like to film my best catches, and also having a camera running while operating any motorized vehicle is a good idea. I see non fisherman with go pros running on their boats at all times as well. It’s no different than people driving around with dash cams. You’re just assuming it’s for causing confrontation. Seeing this guys boat, and all the accessories, he’s got at least 90 grand into that thing. He spent all that money just to go out and hope someone has a problem with what he’s doing? Highly doubt that

The fisherman is in the wrong in my opinion. It doesn’t matter if he is legally allowed to fish there or not. It is a matter of common courtesy as a fisherman to stay away from other peoples boats and don’t interrupt people trying to operate a business. The marina is being payed to watch those boats and keep them safe. They had every right to be concerned about a man casting his lines towards them
In Minnesota, harassing a fisherman IS a crime. Golf cart guy would have been arrested.
Happens all the time on my local lakes, dock owners think they own the water. I keep a piece of paper in my boat that has the Georgia anti-harassment of hunters/fisherman law on it as well as a copy of the navigable water's laws to shut them down. I also have the local ranger's phone number in case the land/dock owner just doesn't get it or really tries to escalate. Luckily, I have not had to use that number yet. I have given a copy of those papers to some dock owners over the years. Once they understand I am within my rights to fish around their dock and they do not own the water under it they stop with the harassment.
Only thing worse than a bad cop is a bad security guard that think they have power and tries to enforce rules or laws that don't exist.

I used to work for a marina when I was young. Boats do get fishing line caught on the propellers a lot and it can cause a lot of damage to the motors. It's not cheap to get a propellor and seals replaced! Also, they have been known to hit boats and cause damage. They all aren't good at casting!

Another point I give Officer Luke an "A+" for is not requiring Mr. Royal to produce an ID. According to many, many other cops (including many featured here on ATA), the mere fact that they were responding to a call (as Officer Luke was), required them to ID the people they spoke to ("so they can put it in their report"). _If that were true_ (I know it's not), then Officer Luke just violated that law. Yes, Mr. Royal _voluntarily_ gave his first name, but Luke did not demand an actual ID as so many other cops would have.
It’s foolish to give any details even first name. A cop told me they use the first name with description to do a search. They can then upload your name on a database that then forms a historical background if you ever find yourself in court for any reason. It can convey that you are a problem. Same if you are arrested even if the charge is dismissed or you are freed before charges that stays on the record. This is why ATA saying comply and argue later doesn’t give the whole story. Getting your record cleared is incredibly difficult and rarely achieved. He’s way too fond of telling people to comply.

Guy on the boat was totally an asshole the guy on the cart was just doin what his boss told them , and he could know better about fishing laws for working at a marina but he might not be a fisherman and wouldn't know. Still, he or that guard should've just called the non emergency line find out for sure instead of continuing the conflict

To be fair, their employer probably ordered them to chase away "anyone fishing in the marina." Meaning someone fishing while standing on the marina docks. But the ambiguity of the phrasing meant it could have also meant someone fishing from a boat in the marina. And the Kens felt compelled to use the broad interpretation of their orders just to be on the safe side, to protect their job.

Working as a security guard I have more than once been fired or removed from a job site because I refused to do something I knew was illegal on the other hand I have also had to tell the cops what code section to read to get them to inforce the law
My old roommate was fired for letting homeless sleep against the warmth coming out of a building usually he’d go out around 6AM to tell them it was time to leave. But one day someone high up came to work early and spotted them.
It is unfortunately rare to see a law enforcement officer be this friendly and knowledgeable.

The grades assigned in this video are above reproach, and I agree with you that the fisherman could have been slightly more polite to the marina employees, but he still definitely deserves an a. I totally agree that the cop was very polite, respectful and he didn't take any sides because he knew how to do his job right and all cops in America should learn from this cop, because he didn't come off like he's a dictator demanding that the guy on his boat was doing everything illegal and listening to the workers from the marina. That's what a lot of cops do, they pick a side and make their own conclusions that you are guilty and then if you say anything to them with a tone that they don't like, then they have an attitude and then they just do whatever they want to you. Cops don't like to descalate a situation, because then they feel like they have no power over you and that's why there's only a few of them that will do their job right and the rest of them don't care about descalating, they care about is making people do what they say and if you don't then they will show you what will happen to you, because they wear a badge and a gun.

How does the officer get an A+ when he didn't do anything at all? The fisherman was technically the victim of disorderly conduct, the perpetrators admitted they used fighting words, the victim was clearly offended by those fighting words. The cop never even explained to the perpetrators that they had committed a crime. That would have been proper police work. That way they would have legal reasons not to pick fights.

I always like this channel because, as law SHOULD be, it’s a balanced opinion. Good behaviour is called out as well as bad. Channel owner does the best job of providing legal support for his analysis. If he doesn’t teach law he damn well should be. This guy puts a lot of work into these videos with his legal research and does it in a way everyone can understand. As a former probation agent I can say that takes a huge amount of time and work.

The problem with some citizens they think they control everything. Just cause I don't like what you do. Everything public is for everybody. It's called public for a reason. We are all part of the public now. Is private then. It's private for a reason meaning you can't go on that private property. YT has been known to censor(take down) videos for reasons. They own the platform, it’s theirs, right?
So, they could tell content creators/yt channels that they are not allowed to post videos that contain ads because there are people that pay for the premium service to not have to watch ads.
I’m just saying it seems to me that it is not impossible for them to take down videos because they contain ads, and they could do so if they chose to. Right? Or, I could be wrong. It may not be that simple. But it seems to me that since it’s their platform, they can take down videos and censor comments(I’ve had a few of mine disappear) for just about whatever reason they want.

Though its common for landowners to try and hide the public access points with logs or bushes. or put similar debris in the water near the access points. Maine law says the public has a right to access any body of water larger then 10 acres. Both the water, and a point to access the water. At least in theory

My only critique is how he talked to the young man on the golf kart. He’s young, he doesn’t know better. Don’t get hostile with him, just let him know he’s wrong and that he can go get his boss out here if he wanted something done about it. Yes, I know the young man was disrespectful but we all know what it was like when we was his age, we thought we knew everything….he should have just calmly explained to him why he’s allowed to fish there.
