  • Friday, November 17, 2017 | Almost half of the complaints filed with the Equal Employment Opportunity Commission (“EEOC”) contain retaliation allegations and that number has continued to increase over the past several years. In many instances, it is not the underlying claim of discrimination that results in an employer’s liability, but the retaliation claim. These retaliation claims are preventable with appropriate policies, guidelines, and training of managers and supervisors.
Ellen Adams’ litigation practice primarily consists of defending employers against claims of discrimination, harassment, retaliation, wrongful termination and alleged wage and hour violations. Meagen Burrows has a general business transactional practice with an emphasis on employment contracting (particularly in the health care industry). Ellen and Meagen also advise clients on developing policies, procedures and training: responding to complaints: handling investigations and other employment matters.

Why has the government EEO judges put all case reviews on hold? One judge said she is so over burden that she has suspended review of cases.

Is extreme work scrutiny the day after going public with EEO, retaliation?

Define work scrutiny...if they are in anyway making your job more difficult then yes you are protected under the laws. Any adverse action that is taken against a person once they have engaged in a protective activity will look suspicious, especially within close temporal proximity (days or weeks). Best advice is to start documenting and speaking with an employment attorney.
