    Truth be told these two people are nice and gentle people. If the guy had pleaded for reduction , I have no doubt the landlady wiould have agreed. God bless them both and the justice court family.

      A judge should use his/her discretion to relate to anyone in the court if the plaintiff or the accused is not literate enough to defend or relate his/her case in court.
      That singular act alone will go a long way in helping the handicap party to express themselves freely and openly without holding back. Many people have been misunderstood and wrongly condemned because of their failure to defend themselves in the court of law due to the fact that they lack command of the "almighty" English language.

    Hmmmmmm😢😢😢😢... that's all i can deduced from today's judgement. For All the men out there!! who are hustling to be responsible for their love ones,may God bless you all....I saw a Nice man with so much respect for elderly but lack capacity to express himself and was frustrated with situations around him then bursted into anger yet his sense of respect is still intact.. secondly i saw a woman who needed money but have to trap his tenant in order to get enough evidence in order to compell him to pay his money..No matter what you do as a person seek for advice from professional not those who will be biased or sentimental towards you because it will help you to defeat common hurdles.. Peace

    Great Judge, great lady! Issues swiftly resolved using the 'carrot and stick' strategy, backed by LAW.

    The landlord is nice, but the tenant did not approach her calmly. The landlord would have agreed to the 230k prior to coming to court with a better approach.

    How so sad, how so foolish and callous of this tenant to try to -take advise from someone else, and then victimise a recently widowed lady, you actually got on with the late husband - a point he didn’t disprove when put to him!!!….. Love of MONEY INDEED IS THE ROOT OF ALL EVIL

    This judgement has to be Naija law. You don’t make me sign a receipt with is a binding contract then months later tell me to bring back the receipt so I can sign another one. Like if u made a mistake, that’s your fault. You suck it up and wait till the next rent payment to get him to sign for the new rent increment. In my opinion, judge ruled based on biased view, compelled the defendant to a yes or no answer knowing fully well he didn’t comprehend what she was talking about.

      He was notified the increment applied to the next payment period. He was never asked to pay more for the period he had already paid for. He refused to acknowledge and pay the increased rent when time came to pay for the new term. He could have simply arranged to per her 10k over each of the next 5 months instead of coming to court.

    The problem in Africa is no tenants right. 17,8% increment is too high. Here in Europe it is 3-5% max. and there must be a reason like some big renovation like bathroom remodeling, kitchen remodeling or windows and plumbing changing.
    If you rent is 760 euros, it will increase between 15 to 20e and not 135€.
    Dey don't born any landlords to increase rent from 760 to 895.

No matter what country you live in, you either pay rent, pay a mortgage or have your own property. Unless you want to live on the streets. Even in Europe & US if you don't pay they either take you to court or send bailiff to your house for re-possession.

    Landlady 3yrs is too early for increment ooooo... Haabaaaa.... Despite the economy situation..... Am very sure the building will be all dis old houses in lagos oooooo....

    When the receipt was given to the tenant by the Landlady husband he never wrote that the tenant will pay 280K on the next rent, it was when the Landlady returned from UK that she went to the tenant and asked him to return the receipt given to him by her husband.
    But the tenant declined and the Landlady went and wrote another receipt and included the 280K to be paid in the up coming rent which the tenant refuse to collect.
    Why is the Landlady now lying in the court that she indicate that 280K will be paid on the next rent meanwhile she is not the one that issued the receipt and only do that with another receipt when she returned from UK and the tenant refuse to collect because he already has substantive receipt earlier given to him by the Landlord which dose not bear the said 280K.

    I'm a landlord, and I don't issue receipts to tell that he would pay the same next time, they only notify change of amount. So the guy is right. The husband never indicated any additional amount meaning he expects him to pay the same amount of rent. Commonsense.

      Your common sense is like mosquito sense to someone else. She notified him twice, one year and 6 months prior to end of contract. Even the recorded phone conversation indicates he was determined not to accept the increase in rent. So carry your common sense go front

If the wife want you to increase the rent and the husband who is the landlord expect you the pay the same amount, which of the two you will follow? Because obviously the husband issued him a receipt without indicating that he has increase the rent. You not just get sense at all.

    More than 20% increase in rent within two years of tenancy is not justified. The government should do something urgently to address this madness by Lagos state landlords.

In his mind , she’s not the rightful owner so he needs to ‘drag’ the property with her .😂! . Chronic Narcissism Disorder. Everything on earth naa dem get am ….. he will even be saying the landlady is ‘ jealous of him. She’s envious ; It is hatred etc . 😅

    Please let try to look into a matter not by emotion alone.. people are hear talking about that the land lady is playing smart.. the voice note proves the guy is aware , and is either to plead for extension of time or leave the house !... Its painfull in these economy but landlords are still landlords, is their house , the best thing to do is to plead for extension of time or leave the house ,not drag with the owner of the house!

    Wait oo, I thought rule of lagos state is that a landlord is not supposed to increase house rent until after 4years of the tenant in the house.

    When looking for a place to rent check if the owner is a woman, educated or not educated landladies you can't outsmart them, so think twice before signing anything with them. Be very smart.

    The plaintiff and defender were happy.

    There is no law that spells out when and how to increase rent in Nigeria. What the law frowns at is arbitrary increase in rent. (Tenancy Law 2011, S.37)
    To put it simply; If you're renting a place and your landlord wants to increase your rent, you can ask the court to decide if the increase is fair. The court will look at how much other places in the area are charging for rent, listen to both you and your landlord, and consider any special circumstances about your place. If the court decides the increase is unfair, they can tell your landlord to change it to a different amount. However if they rule in favor of your landlord you are now obligated by law to pay the increased rent. Also, your landlord can't kick you out while this is being decided.
    However,
    Tenancy Law 2011, S.7
    Unless the rental agreement says otherwise, the tenant needs to do two main things under law:
    1. Pay the rent on time and in the way the agreement says.
    2. Pay for any fees or bills (like utility bills) that the landlord doesn't have to pay by law, both now and in the future.

      So under Section 8 of the Tenancy Law 2011 ( Tenancy Law 2011, S.8)
      Unless stated otherwise in the Lease (Tenancy) Agreement, the landlord must:
      1. Not interfere with the tenant's quiet and peaceful enjoyment of the property.
      2. Pay all legally required taxes and charges.
      3. Insure the property against loss or damage.
      4. Not cut off access to shared facilities or services.
      5. Not take the tenant's belongings or block access to them.
      6. Maintain and repair the exterior and shared areas of the property.
      What concearns your question is subsection 6, to elaborate:
      1. **Exterior Maintenance**: The landlord must ensure that the external structure of the building is in good condition. This includes the roof, walls, windows, doors, and foundations. Maintenance tasks might involve painting, fixing leaks, and repairing any damage that could impact the structural integrity or safety of the building.
      2. **Common Areas**: Shared spaces that are used by all tenants, such as hallways, staircases, lobbies, and communal gardens, must be kept in a clean and functional state. The landlord should handle cleaning, gardening, and repairs of common facilities like elevators or lighting.
      3. **Safety Features**: Maintenance also extends to safety and emergency equipment in common areas, such as fire extinguishers, smoke alarms, and security systems. The landlord should ensure these are all in working order and comply with safety regulations.
      4. **Utilities**: If any utilities are controlled centrally, such as heating in a multi-unit building, the landlord must ensure they are functioning properly and repairs are made as needed.
      Overall, this duty emphasizes the landlord's role in preserving the quality and safety of the living environment, ensuring that all tenants have a safe and well-maintained space to live in.
      So unless stated otherwise in your Tenancy Agreement (I would suggest reading it through again) your landlord is required to maintain the repair of the property, especially if you have been doing your legal duty as a tenant by not withholding rent nor missing payments (I would also recommend keeping a record of it, how much and payments dated)

    My rent expired last year 31st October and my landlord younger brother and son insisted i should pay a new rent from #150k - 200k without any notification or previous discussion in respect to such increasement.
