    My best advice to anyone seeking a protection order to definitely have an attorney. Do all you can to find one pro Bono. Despite that document, document, document! Meaning texts, record phone calls, photos of violent incidents even if police weren’t called. If the abuser has an attorney be prepared to be cross examined. You will have to testify about all that’s happened and remain composure. Lastly depending upon the court and when the court order is given... MAKE SURE THE ABUSER IS PROPERLY SERVED! Even if he did attend the hearing, technically there needs to be “due diligence”. Essentially without being served it’s a useless piece of paper and a waste of time, emotional pain, and money. Always remember as well it is only a piece of paper.

      my case is a little different though.. it was a female neighbor that I was intimate with for a couple months, then we broke it off. She moved like 3 months ago and I’m moving as well. I don’t even know where she moved nor do I care lol. If I go, what do I need to do if I can’t afford a lawyer? Just tell them that we don’t even live near each other anymore? If I don’t go, would I get arrested? Or just a restraining order on her? I could care less about her..she definitely did this as a last resort of revenge since I moved on and dumped her. She claiming I stalked and harassed her lol 🤦🏾‍♂️ these women… sheeesh

    Just went to my court hearing. It was in my favor. Doesnt quite look like this during the pandemic. Courts are utilizing webex technology so I was able to just do it from home on my computer. I was able to email all evidence such as pictures and camera footage to the court. Super easy! Btw defendant did not show up. Order if protection is for one year.

    • @LornaSatchwell
      @LornaSatchwell 3 роки тому

      Did you email that information before or during the hearing?

    • @queenj7720
      @queenj7720 3 роки тому +4

      I was prepared to share my evidence during hearing over webex however they did not allow me to share my screen. They provided me an email address to send it to and I was able to do so after court hearing. You could probably do this in advance if you call the courts early to obtain the email address to send it to. Just make sure you include case number and state in email that you would like to submit it as evidence. I believe it was easy for my judge to make a determination soley on the fact that I initially submitted copies of harassing text messages and photos when I initially turned in application for restaining order.

    • @queenj7720
      @queenj7720 3 роки тому +3

      Also it helps when you have multiple police reports. Everytime something happens, call the police so that the behavior is documented. I experienced months of stalking, harassing text messages, and abuse by proxy. Having cameras and documentation makes it easy. I have not experienced anymore events since restaining order has been in place. Btw, I had no contact with this party during this time period which made my case stronger...... UPDATE: after restraining order was issued, the stalking stopped then started again. Before order, I was been stalked like 5 days a week. Now, it has completely stopped 3 months after order but I still keep my guards up.

      @@queenj7720 I'm so glad your order was granted and sustained. My abuser is trying to contest the restraining order and my mom and I are scared because it will be a huge financial burden to hire an attorney for us but we will if we need to. I'm scared that I won't have proof of the violence and threatening behaviours he exhibited but I have heaps of written evidence via text and email... It'll all just be on the phone and not on a computer though for my hearing which I'm anxious about since I'm hard of hearing. intoxication proves bad testimony 🤡 so yes it is a completely relevant question. now what the guy could have done if he truly knew he did not cause marks on her neck was to ask to see the time stamp of the photos because what if those photos time stamps were a month before? then if the man truly was innocent the photos would be rejected and the lady could of lost the order of protection.

    • @TrentonTompkins
      @TrentonTompkins 2 роки тому +5

      This view is the number one problem with the criminal justice system -- as soon as a woman says shit, whether it's violence or rape or whatever, she becomes a 'victim' and an innocent guy becomes a "perp". In the real world, the cops and prosecutors are the bad guys as often as not. Women make up rape to get revenge on boyfriends, or to not seem like a slut to the next bf - soon they'll need to accuse guys of rape just to be eligible for abortion in some states. Some guys are just screwed up abusers, but pfa's also keep people from talking and working out problems at taxpayer expense; they can also be used to later take away the right to use firearms, sue or get custody.

    Good advice I have a temporary protection order in place against my now ex husband and I go to court to get a permanent one on june 21st I hope I get it because this temporary one is not stopping him from coming near me and my daughter and contacting us and I have all the proof of abuse done by him all the screenshots of threats from him and his family and being harassed by his attorney that he's having a secret relationship with I have proof of her telling me that is the reason she's lying for him she knows what he's done but is just covering for him and I also filed my medical records from when he raped me and I ended pregnant which ended with him kicking me in the stomach multiple times causing me to misscarry and ended in the hospital and ect (so much to write that happened)
    He's showing up for his supervised visitation on Saturday which is suspended due to the protection order in place against him but I'ma get a Sheriff to meet me to get him served even tho he's aware of the order and has violated it once already and is in violation for it and might be getting locked up for it on Saturday

    That was embarrassing for both of them. How do you not know to stand up? He actually asked, do I have to stand up. 🤦🏼‍♂️ You got the custody of your kids riding on this and you have two fucking questions? You might as well stay at home. LOL

    Why don’t you do one that’s actually helpful and more realistic… Like a mother claiming domestic violence just to get the kids and father away from each other and try to look good, or more like make the father look bad. And then show how absolutely no evidence at all is needed to make a restraining order permanent if the respondent willingly sign it. And then talk about how fuck they are after that and how they’ll never get their kids back ever again

    Update : I won. His case got dismissed and I have been advised to go to small claims court.
    I have one in 3 days. It’s my first and hopefully my last. I’m actually moving away from my apartment to purposely avoid this toxic neighbor who owes me money, but pulled a gun on me when I came to ask for my money back. Then he goes to the court for a protection order of harassment, said that I threatened his life with my egg in hand. Please wish me luck as an African man in America I do not want any trouble with anyone.

    Dude is so cringe. "Isn't it true...." Thats the only legalese he knows, lol. Then when the other side fails to validate the point he was attempting to make, he just falls silent. He doesn't even say "No further questions your honor." And you should NEVER bring up a possible motive for your alleged crime, like jealousy over cheating, especially if the petitioner didn't specifically mention it. The judge is only going to see that you are passionate about that issue and make the likely assumption that this was indeed your motive for retaliating with violence.
