I have a family member who deals with mental health. We have tried to get help for them but we cannot sign papers or put them away for their own good unless they do something wild. Why should someone fire a forest fire when a match could have been blown out. it is really stupid.
Because as shocking as it may seem, we have people who would put their own mother in a home, just to collect their government check.. So in order to lock someone away in a home like that, their has too be evidence that they are actually not capable of taking care of themselves or that they are a danger to others. Because of that little rule, many people who are perfectly sane and stable are not locked away because they had a greedy brother or mother or even son.

What a family MAY attempt to do is take the profits from mama's estate and use it to put mama in a home of ill repute just to save money if not blow the money before the state can get it. Case in point, my mother in law was in a home for the last few years of her life. My father in law set it up so that one of her checks went to a account with the Home, and the other checks she got went to her bank account. He used that money to buy her the things she needed, and to take her out of the home every weekend when he came off the road.. In order for the "Home" to get that money, the family or the person with the power of attorney or the patent themselves depending on the situation, has to set it up to be that way.
People have rights. Including those with mental Issues. The vast majority of them aren’t violent. Additionally America doesn’t fund mental health anymore. There’s limited money to treat the indigent.

The thing is that the sister can’t force him to be hospitalized and supervised, but the courts can. She informed the proper people that he needed to be put away so they could do their job and not only punish him for the crime he committed, but prevent future crimes from happening. They didn’t despite being warned and him exhibiting escalating behavior, and now multiple people are dead because of it. So yeah. It is Miss Kincaid’s responsibility 🤧

That's why she wrote and asked the lawyers to take him more time but it's a gray area in the law and when his brother took his medicine he is a great lawyer, at the end he got not guilty for medical reasons and the sister told the judge and everyone that he is gonna kill again when he stop taking his medicine.
You can't get a family member hospitalized if they don't want it. And, even if they do want it, there aren't enough spaces. And, even if they do get hospitalized, the treatment is stabilize and release, not long term help. We need to change the system.

I never quit advocating for her to get into the better one. Every chance I had i gave a speech about how our choice was better for her. Well, Kincaid had the opportunity to get him off the street _earlier_ when he was stalking Joanna, but she and the police let him go. So if she had done better due diligence the first time, discovering his history of violence, He wouldn't have been released to later kill and maim those innocent people in his mania. It's really a two way street, she called, she reached out on behalf of her brother, who needed help, the rest should have been up to the state, and board of mental health officials, if a person presents a danger to themselves and others around them, at the first sign of a red flag, there must be some kind of intervention or monitoring said individuals. A fine is not the answer, there should be a followup, and maybe several followups, to prevent things like this in real life.

You have to understand this: nobody chooses to be born with a mental disorder, nobody chooses to be traumatised enough to develop one, and especially nobody chooses to have a family member with a mental disorder. His sister couldn’t do ANYTHING about his disorder once he had turned 18, an age he had long since surpassed when he committed his first crime. People have rights, even mentally ill people, so they can’t be hospitalised against their will without court interference. I should know this because I also have a debilitating mental disorder. And on the note of him not taking his meds - mentally ill people can take responsibility just the same as anyone who isn’t mentally ill. They just need help, such as with therapy and said medication. He knew he had to be on his medication but stopped when he felt better. I understand this, because being on my medication makes a lot of things very difficult for me and makes me feel restricted. But I, like this lawyer character, also understand that just because it makes me feel bad doesn’t mean it’s not saving me from a worser evil, because my meds are preventing a horrible thing just as his were. And given how intelligent he actually is, he absolutely knew this too. What he did was of depraved indifference. He knew what could happen, he just wanted to feel good. They used to be able to institutionalize dangerous people BEFORE they did something bad. But in the 70's(I believe) the Supreme Court said that was unconstitutional.

The problem is it's nearly impossible to make something that wasn't included in the constitution in it now as you need 90% support from all the states or something like that and over 70% of people don't believe Abortions should always be allowed at any point in pregnancy. That's why she wrote and asked the lawyers to take him more time but it's a gray area in the law and when his brother took his medicine he is a great lawyer, at the end he got not guilty for medical reasons and the sister told the judge and everyone that he is gonna kill again when he stop taking his medicine.
You can't get a family member hospitalized if they don't want it. And, even if they do want it, there aren't enough spaces. And, even if they do get hospitalized, the treatment is stabilize and release, not long term help. We need to change the system.
@@infonut When my mother needed to go into a long term care facility, we picked a very good one. They didn't have room there right away, so they put her in a place where she wasn't happy. I never quit advocating for her to get into the better one. Every chance I had i gave a speech about how our choice was better for her. We finally got her into that place and it made a huge difference in her life. So yeah, some people do advocate for their relatives.

This is the hospital's problem, they did not make sure he took his meds. The sister too. Stop blaming others. It's really a two way street, she called, she reached out on behalf of her brother, who needed help, the rest should have been up to the state, and board of mental health officials, if a person presents a danger to themselves and others around them, at the first sign of a red flag, there must be some kind of intervention or monitoring said individuals. A fine is not the answer, there should be a followup, and maybe several followups, to prevent things like this in real life.
The problem is abusive relatives who rig the system to abuse them. People have rights.

I’m sorry but a lot of people in the comments are very ignorant and stupid, operating on the opinion that somehow, the main ones responsible for people with destructive mental health disorders are their family members. You have to understand this: nobody chooses to be born with a mental disorder, nobody chooses to be traumatised enough to develop one, and especially nobody chooses to have a family member with a mental disorder.
His sister couldn’t do ANYTHING about his disorder once he had turned 18, an age he had long since surpassed when he committed his first crime. People have rights, even mentally ill people, so they can’t be hospitalised against their will without court interference. I should know this because I also have a debilitating mental disorder.
And on the note of him not taking his meds - mentally ill people can take responsibility just the same as anyone who isn’t mentally ill. They just need help, such as with therapy and said medication. He knew he had to be on his medication but stopped when he felt better. I understand this, because being on my medication makes a lot of things very difficult for me and makes me feel restricted. But I, like this lawyer character, also understand that just because it makes me feel bad doesn’t mean it’s not saving me from a worser evil, because my meds are preventing a horrible thing just as his were. And given how intelligent he actually is, he absolutely knew this too.
What he did was of depraved indifference. He knew what could happen, he just wanted to feel good. Just like a man drinks to feel good but may pay no attention to the consequences when he sits behind a wheel while drunk. Depraved and indifferent.
They used to be able to institutionalize dangerous people BEFORE they did something bad. But in the 70's(I believe) the Supreme Court said that was unconstitutional.
This now Supreme Court overturned Roe vs Wade, judges on court vastly out of date.

The problem is it's nearly impossible to make something that wasn't included in the constitution in it now as you need 90% support from all the states or something like that and over 70% of people don't believe Abortions should always be allowed at any point in pregnancy. Conversely the vast majority of people do not believe they should be banned outright. The fact that it was that way for 50 years does not mean it was legally correct.

This might be a factor but I heard a story in my family where one of my older family members had their spouse committed against their will because they couldn't get divorced. Wasn't even dangerous or mentally ill, she just didn't want him around. There is nothing to do. We don't have mental health services beyond a short stay in a hospital or jail. That's it.

I pointed out what services exist. I never gave an opinion about any of it - just stated what options are available.
This just shows that aslyums while seen as cruel did good things. Kept those that refuse treatment or were willing to harm others. In a location they would he treated and protect to public from harm. To many bleeding hearts and "cost cutting" allowed them to be closed. Mental health can be helped and handled. If the person is unwilling to be recoved and helped. They should be forced to stay where they cant harm others or themselves.
