You're lucky. Here in MN if we are able to safely leave the house we must do so, but I can't imagine being able to when a criminal breaks into our home especially at night. Big win here in Arkansas, past couple years the wording of our state law said that just carring a firearm doesn't represent the unlaw intent of carring a weapon to committ a crime and it's been clarified that we are a Constitutional carry state and just this year we had the duty to retreat law recended. Now we all need to follow Texas and start recending all unconstitutional gun laws.

Here in Texas it's even better as it relates to the home. Anything attached to the home is considered the home like carports, porches you name it so long as it's attached it's the home and the can use lethal force. The problem is that many people think it extends to the rest of their property and barns and it doesn't. You still have no duty to retreat but even pulling your gun on a trespasser can land you in jail unless they are armed and even then pulling the trigger requires they reach for that firearm. I open carry on my property and often with my AR since I have to deal with coyotes and hogs and have run into trespassers. Most just run but I have had to call the cops on one that didn't. My guns stayed in the holster and my AR over my chest but with my hands on it just in case. That kept me out of jail since he turned out to be unarmed. I don't see trespassers anymore since day or night the ones around here who would do that know that I go down into the pastures day and night armed. And I'm not making much noise or using a flashlight until I have to since I can see fairly well at night.

Here in Louisiana, your vehicle is also considered part of your home. So you could be out and about somewhere and if you catch someone trying to steal it or from it, its the same as if they tried breaking into your house.

I’m seriously thinking of moving to a state that has stand your ground, castle law, and CC carry/open carry state! I’m weary of being afraid of the law, as much as the criminals. Crooked needs to be set straight. It is getting harder for law abiding citizens who respect and honor others. That alone is tragic.
Sir you're as always on point .You also understand reality .The problem is the civil suit, if the person is in the process of committing a crime that could harm another . Their family should be barred from filing a suit ,and any attorney taking that case should be disbarred .
The standard here is the Kansas Personal and Family Protection Act of 2010 wherein you have a right to your defense and the defense others and your and their property. The KPFPA also establishes that if there is no criminal prosecution for the person defending such then there can be no civil protection. So if the determination of the criminal prosecutor is self defense then the assailant and their family have no legal standing for a civil prosecution.
Indiana has a similar law. If one can't be convicted in criminal court, then they can't be subject to double jeopardy in civil court for the exact same scenario that even landed that person in the court system in the fist place. It's one of the most humane and just laws that this and every first-world country needs.

Well said, sir. In my State of residence, there is a condition of preclusion written into the concealed carry statute, and I find it both reasonable and advisable. Of course this only pertains to matters that can be determined in advance of conflict, and when such can be done safely. As you say, it would be difficult to imagine that any rational person would not want to avoid armed conflict if possible. Far too many citizens fail to understand the level of responsibility that comes with carrying a firearm for defense, and the complexity of law in this regard. As with so many other aspects of living, the more I learn about this, the more I realize there is to learn.
IF an attack happens in my home, there is no other place on earth where I have more right to be present... so I will NOT retreat... not even to a different room. I will defend myself.
I usually retreat to a safe room then come up with a plan of attack by setting booby traps such as swinging paint cans and rusty nails with tar on the steps. That teaches those thugs to never come back to the McAllister house ever again!

A lot of churches are forming security teams to keep their congregation safe. Think of sheep dogs protecting the flock. What advice does Massad have for armed members of those teams?
My 2 cents. I suspect that everything discussed in this article pertains to use of deadly force, be it at church, in your home, on the street, etc. If you have a right to be in that location, and did not initiate the conflict, you have a Constitutionally protected right to self defense. That extends in part to third parties. The largest issue in third party matters derives from the factors involved in what initiated the conflict. In a church environment, it will be easier [ not easy ] to monitor the actions of those in attendance, if the protective team is of sufficient numbers. I would advise that each member have attended at least two individual classes in firearm use for self defense, not including a concealed carry class. These classes should be taught and certified by current or former LEO, preferably members of IALEFI or ASLET. I can't address specifics as each church will have specific needs. Become very familiar with the laws in your State, your county prosecutors office and record of actions in this regard, and what, if any, liability insurance the church or diocese might have and whether or not it will cover the team. You may also want to contact other church protective teams in your State for additional information.
I'd highly recommend his books, any and all of them. They might not b specific to church security teams but, they're packed with the best I go available. N my opinion, Ayoob is the authority on all things concealed carry and deadly force, concerning equipment, legalities, and tactics. and
Like Massad says, finding case law about these things in your state is absolutely crucial to understanding the differences between the stand-your-ground laws between states, although most of them are very similar to the Florida statutes in language and legal consequence. The trouble with some random lay individual (Let me be clear, I am not referring to Massad, I mean the general public) just reading a statute and thinking they now understand it is that there is almost always underlying nuance. It has every appearance of being written in English, but actually it isn't even though the typeface may look familiar. It is written in lawyer. Law is written by lawyers in the language of lawyers for other lawyers to read and do lawyer things with. For the layman, it's like being able to read and write except he has no knowledge of punctuation whatsoever, even of a period. For instance, in the state I live in, Iowa, the opposite of what the Florida Supreme Court decided with regard to the immunity hearing common to stand your ground legislation across states has occured: In State vs Wilson (2020) the Iowa Supreme Court held that the immunity hearing applies only to civil trial on the grounds that the text of the statute grants immunity from liability, not immunity from prosecution as in other states. From the opinion: "On appeal, the defendant argues that Iowa Code section 704.13 entitled him to a pretrial evidentiary hearing where he could have presented his justification defense and been vindicated without need for a trial. See Iowa Code § 704.13. We conclude, however, that the 2017 legislation does not require pretrial hearings. Significantly, section 704.13 provides an immunity from "liability," id., not an immunity from "prosecution" as in some other states with stand-your-ground laws." Obviously, most of us would hold that this is not the intent of that law given that the statute itself uses the phrasing "criminal or civil liability" but the state supreme court ruled and we now need to approach it with corrective legislation or hope for clarification from the US Supreme Court (not likely).
Also for whatever it's worth the defendant in State Vs Wilson was, by even his own account of the events he gave to police, not justified in his use of deadly force and the jury rendered a guilty verdict, convicting him of voluntary manslaughter.
As someone that has dealt with this personally what it comes down to is you best better keep your cool when you first talk to the police and tell your side in detail of what made the situation escalate to the point that it did
Even animals in the wild know that if they can’t retreat safely then they must defend themselves. I’m reminded of a baboon attempting to run from a lion but at some point it had to turn and fight in some form because it couldn’t get away. As well I’ve seen law enforcement trip a perpetrator while running behind them trying to catch them. Not all physiques are equal and there can be a big disparity between an aggressor and someone trying to defend themselves. Cf. disparity of force laws as well.
Very informative for the criminal prosecution side but lacking on the civil prosecution side. The civil system is an absolutely disgusting process. It has been abused by "ambulance chasers" and will just as easily RUIN your life. You will be forced to hire a civil attorney if you can afford to. If you don't hire an attorney, for whatever reason, you will lose in court, 100%. And they will take everything you own, garnish wages, etc. It is pathetic and shame on the SYSTEM for allowing it.
I appreciate responsible gun people. I was trained on basic hunting firearms a long time ago, so I've never had a problem with gun people. To make it clear, I don't own any firearm and have not for a very long time. I am not afraid of firearms in the hands of responsible people. I would love to see my current fear addressed that being a lunatic disguising themself as an RCMP officer that performed a mass shooting spree in Nova Scotia, Canada. My argument is that IF we were permitted to be armed citizens, the odds might have changed massively.

It's pretty much going to be a problem for any victims. As stated, No one is clear on anything under any circumstances in any state at any time, it's going to be expensive and no matter what , you will be victimized by the courts as well as the criminal. In the mean time the law says you can defend your self. Just listen to the attorneys who sell you insurance !

In both cases, you are allowed to use lethal force if you’re in serious danger. If you can safely retreat you are probably not in serious danger. In a completely fair world there is very little difference.

I have a question about something I experienced. I am an excellent driver and because of my history, I am VERY aware of my surroundings, even when driving. A man in a car came up behind me and started honking non stop. He came from way back, so I looked at the person next to me and held up my hands, basically asking without words if they knew what was going on. They mimicked my mystification. The light turned and we pulled up to the next light which had just turned red and here he comes. The guy comes up totally irate saying I cut him off. He is so irate that I have my hand on my permitted, concealed weapon, not sure what he has in mind. This finally leads to my question... I'm stuck in traffic, even though I left room in front, the traffic coming has me blocked in, and by him from behind. I feel if I try to exit the car, that he will do possibly life threatening damage to me. So could this be considered being held against my will? The reason I'm asking, is because I want to be able to tell this person like this that I will use deadly force to release myself from the entrapment, because this WILL happen again because although I don't break the law, or endanger people, I do drive fast, which pisses people off because they feel that if they can't drive that fast safely, than no one can. (it's too bad that they don't realize that speed limits were designed to include 90 year old gramma who can barely see over the steering wheel)

Stand Your Ground and Castle Doctrine laws just simply state the obvious of protections that I still can’t believe aren’t obvious to certain states or political figures and many citizens to this day.
The best way is to be aware of the situation and get out before a gun is needed. This means swallowing ones pride and leaving while being taunted, teased or challenged. If I can get out safely, I will leave. We have to be aware that when armed, we can't have the luxury of talking smack. If some one challenges you and you can get out safely, do it!
This is exactly the purpose of the laws, it's amazing how people misconstrue them for their political purposes

Used to read his articles in gun magazines before the internet, I was in highschool still. I remember one article was about using a flashlight in a home defense situation to avoid shooting a family member. He talked about it decades before all the weapon lights we have available today. Glad to see him still going strong!

I am an amputee and unable to run from danger. I am a legal ccw and carry a S&W 649 2" with laser sight system in the wood grips; if the dot is on target and I pull the trigger that spot is hit with 125 grain jacket hollow point. You comments on civil liability is on point and the laws need to be changed when a criminal is shot in LEGAL SELF DEFENSE the defender should have IMMUNITY FROM CIVIL LIABILITY; in fact turn the pancake over and make the perp and family liability for causing the victim's new nightmare of killing another human being.
Capt. Ayoob, I would LOVE to see you legally analyze the scene in "Gran Torino" where Clint Eastwood draws his .45 pistol on the blacks. MANY concealed carriers thinks they could this, with no repercussions!

Well said, sir. In my State of residence, there is a condition of preclusion written into the concealed carry statute, and I find it both reasonable and advisable. Of course this only pertains to matters that can be determined in advance of conflict, and when such can be done safely. As you say, it would be difficult to imagine that any rational person would not want to avoid armed conflict if possible.
Far too many citizens fail to understand the level of responsibility that comes with carrying a firearm for defense, and the complexity of law in this regard. As with so many other aspects of living, the more I learn about this, the more I realize there is to learn.

IF an attack happens in my home, there is no other place on earth where I have more right to be present... so I will NOT retreat... not even to a different room. I will defend myself.
I usually retreat to a safe room then come up with a plan of attack by setting booby traps such as swinging paint cans and rusty nails with tar on the steps. That teaches those thugs to never come back to the McAllister house ever again!
What about Massachusetts back in the day Ma's? We just about had to dive out our 2nd floor window and start our vehicle B4 we took defensive action to protect ourselves and our families.

A lot of churches are forming security teams to keep their congregation safe. Think of sheep dogs protecting the flock. What advice does Massad have for armed members of those teams?
My 2 cents. I suspect that everything discussed in this article pertains to use of deadly force, be it at church, in your home, on the street, etc. If you have a right to be in that location, and did not initiate the conflict, you have a Constitutionally protected right to self defense. That extends in part to third parties. The largest issue in third party matters derives from the factors involved in what initiated the conflict. In a church environment, it will be easier [ not easy ] to monitor the actions of those in attendance, if the protective team is of sufficient numbers. I would advise that each member have attended at least two individual classes in firearm use for self defense, not including a concealed carry class. These classes should be taught and certified by current or former LEO, preferably members of IALEFI or ASLET.
I can't address specifics as each church will have specific needs. Become very familiar with the laws in your State, your county prosecutors office and record of actions in this regard, and what, if any, liability insurance the church or diocese might have and whether or not it will cover the team. You may also want to contact other church protective teams in your State for additional information.
I'd highly recommend his books, any and all of them. They might not b specific to church security teams but, they're packed with the best I go available. N my opinion, Ayoob is the authority on all things concealed carry and deadly force, concerning equipment, legalities, and tactics. and

Like Massad says, finding case law about these things in your state is absolutely crucial to understanding the differences between the stand-your-ground laws between states, although most of them are very similar to the Florida statutes in language and legal consequence. The trouble with some random lay individual (Let me be clear, I am not referring to Massad, I mean the general public) just reading a statute and thinking they now understand it is that there is almost always underlying nuance. It has every appearance of being written in English, but actually it isn't even though the typeface may look familiar. It is written in lawyer. Law is written by lawyers in the language of lawyers for other lawyers to read and do lawyer things with. For the layman, it's like being able to read and write except he has no knowledge of punctuation whatsoever, even of a period. For instance, in the state I live in, Iowa, the opposite of what the Florida Supreme Court decided with regard to the immunity hearing common to stand your ground legislation across states has occured: In State vs Wilson (2020) the Iowa Supreme Court held that the immunity hearing applies only to civil trial on the grounds that the text of the statute grants immunity from liability, not immunity from prosecution as in other states.
From the opinion:
"On appeal, the defendant argues that Iowa Code section 704.13 entitled him to a pretrial evidentiary hearing where he could have presented his justification defense and been vindicated without need for a trial. See Iowa Code § 704.13. We conclude, however, that the 2017 legislation does not require pretrial hearings. Significantly, section 704.13 provides an immunity from "liability," id., not an immunity from "prosecution" as in some other states with stand-your-ground laws."
Obviously, most of us would hold that this is not the intent of that law given that the statute itself uses the phrasing "criminal or civil liability" but the state supreme court ruled and we now need to approach it with corrective legislation or hope for clarification from the US Supreme Court (not likely).
Also for whatever it's worth the defendant in State Vs Wilson was, by even his own account of the events he gave to police, not justified in his use of deadly force and the jury rendered a guilty verdict, convicting him of voluntary manslaughter.

As someone that has dealt with this personally what it comes down to is you best better keep your cool when you first talk to the police and tell your side in detail of what made the situation escalate to the point that it did
Even animals in the wild know that if they can’t retreat safely then they must defend themselves. I’m reminded of a baboon attempting to run from a lion but at some point it had to turn and fight in some form because it couldn’t get away. As well I’ve seen law enforcement trip a perpetrator while running behind them trying to catch them. Not all physiques are equal and there can be a big disparity between an aggressor and someone trying to defend themselves. Cf. disparity of force laws as well.

Very informative for the criminal prosecution side but lacking on the civil prosecution side. The civil system is an absolutely disgusting process. It has been abused by "ambulance chasers" and will just as easily RUIN your life. You will be forced to hire a civil attorney if you can afford to. If you don't hire an attorney, for whatever reason, you will lose in court, 100%. And they will take everything you own, garnish wages, etc. It is pathetic and shame on the SYSTEM for allowing it.
The criminals should be terrified to be in public and see the light of day.
I appreciate responsible gun people. I was trained on basic hunting firearms a long time ago, so I've never had a problem with gun people. To make it clear, I don't own any firearm and have not for a very long time.
I am not afraid of firearms in the hands of responsible people. I would love to see my current fear addressed that being a lunatic disguising themself as an RCMP officer that performed a mass shooting spree in Nova Scotia, Canada. My argument is that IF we were permitted to be armed citizens, the odds might have changed massively.
To be honest, I still even to this day don't feel comfortable being pulled over by a single cruiser...you can't live your life being fearful o lightning, but this incident certainly changed my permanent frame of reference of trust.
I've never understood why civil suits are allowed after being aquitted in criminal court. Why isn't this a violation of the Constitution's prohibition against double Jeopardy.

It's pretty much going to be a problem for any victims. As stated, No one is clear on anything under any circumstances in any state at any time, it's going to be expensive and no matter what , you will be victimized by the courts as well as the criminal. In the mean time the law says you can defend your self. Just listen to the attorneys who sell you insurance !

I agree that if the law is applied fairly, and that is a big if, there is little difference between stand your ground and duty to retreat. In both cases, you are allowed to use lethal force if you’re in serious danger. If you can safely retreat you are probably not in serious danger. In a completely fair world there is very little difference.
When there is no conceivable malice or malevolence or nefariousness or ingenuousness present, how can someone who had acted to his/her best option in self-defense be treated so unfairly in criminal or civil proceedings? I am aghast.
I have a question about something I experienced. I am an excellent driver and because of my history, I am VERY aware of my surroundings, even when driving. A man in a car came up behind me and started honking non stop. He came from way back, so I looked at the person next to me and held up my hands, basically asking without words if they knew what was going on. They mimicked my mystification. The light turned and we pulled up to the next light which had just turned red and here he comes. The guy comes up totally irate saying I cut him off. He is so irate that I have my hand on my permitted, concealed weapon, not sure what he has in mind. This finally leads to my question... I'm stuck in traffic, even though I left room in front, the traffic coming has me blocked in, and by him from behind. I feel if I try to exit the car, that he will do possibly life threatening damage to me. So could this be considered being held against my will? The reason I'm asking, is because I want to be able to tell this person like this that I will use deadly force to release myself from the entrapment, because this WILL happen again because although I don't break the law, or endanger people, I do drive fast, which pisses people off because they feel that if they can't drive that fast safely, than no one can. (it's too bad that they don't realize that speed limits were designed to include 90 year old gramma who can barely see over the steering wheel)
Hello my first time commenting, Recently here in my home town of Houston Texas, a Robber entered a Taco Restaurant waving what appeared to be a Gun and was in the process of robbing the clientele, one patron who was carrying was able to stop the robber who was killed only to find this individual was using a fake gun, it was on national news, many are now questioning his actions, I would like to hear your comments Thank You
