How can an Indian Advocate Practice Law in Australia ?

  • Following is the COMPLETE PROCESS for an Indian Lawyer / Advocate for getting enrolled as an advocate in Australia. After this, you would be eligible to practice in any court in Australia.
    ********1st Option :
    You get a degree from Australia and clear the Bar Exam - You may get a bachelors or masters degree in law degree from any state in Australia and then write the bar council exam and if you clear it, you are enrolled as an advocate.
    ***** 2nd option :
    You write a mail to any Legal Admission Board of any state, as a foreign graduate or lawyer wishing to practice Australian Law. After you get a reply you will then apply to their Legal Admissions Board for a skills assessment, this is done online and chargeable. Dependant upon your academic and work history, the Board will seek additional academic study and practical legal training be undertaken as part of any assessment along with English Language Proficiency testing if required.
    SUMMARY of Steps must be followed by Indian Advocates :
    1. Get a law degree from India, and then write a mail to any Legal Admission Board / Bar council of any particular state in Australia asking about assessment.
    2. You get a skill assessment - They will reply you with how you can get your skill assessment. If you have already got it done from any other country like Canada or anywhere else, ask them if they will consider it. If not then, you will have to do it through their channel.
    -In this assessment they will verify your degree, ask your work experience and based on that, THEY WILL TELL YOU WHAT EXAMS YOU HAVE TO GIVE from INDIA or AUSTRALIA.
    - If your work experience is less or not eligible, they may ask you to do an articleship in Australia which is like an internship under a lawyer or firm.
    - English Proficiency, in most cases they will require proof of English Language which is IELTS (Academic or General, please check). They may ask a minimum score of 8 in Listening, Reading, Speaking & Writing, individually. I suggest study hard, give mock and then appear for IELTS, as it is demoralising if you miss the 8 band, again and again.
    - After you complete their above criteria which is skill assessment, then you would have to give a BAR council exam and after you clear the exam, you would be eligible for getting enrolled as an advocate in any State Bar Council of Australia. Thereby making you eligible for practicing in any court in the country. The process is lengthy and tuff but if you have the dedication, nothing is impossible.

    Let us Focus on other countries - Yes if the law permits, which in majority of cases it does if you know the local language. Now this is simple in English speaking countries like the UK, US, Canada, Australia. But it may become difficult if you are looking at countries like japan, Korea, Germany, France, which have the court proceedings in their local language and first step is fluency in that language. You shouldn't be able to just talk, but you must be able to fight in that language
