  • Prenuptial Agreements are a no-go area for many soon-to-weds. The stigma surrounding them is still very much present in many societies, consequently perpetuating a disadvantageous system to those who choose family over their careers. To give each other peace of mind and ensure the well-being of their future family, Magdalena and Benedikt not only relished negotiating a prenup, but also turned it into the most romantic gesture they could do for each other. Life is full of surprises, which is one of its joys but it can also be daunting when things don’t go as planned. Having experienced this first-hand on an electric car trip along the Silk Road, Benedikt and Magdalena wanted their marriage to be set up having this uncertainty in mind.     It is agood thing because it declares an agreement for the event of disolving the partnership. That way everyone knows what the outcome will be and there is no need for anxiety about it.

    Prenups should be mandatory for all US marriages. This will reduce marriage fraud.

      That, and heavy enforcement of fraud laws when a spouse violates conditions which (in the civil arena) would result in SERIOUS prison time.

    Prenuptial agreements should be mandatory like car insurance is mandatory!!! Federal minimums for a registered vehicle, and then various categories on things that you can exclude or protect yourself from liability in certain circumstances.
    The institution of marriage has been ruined by government/taxation/legality, and frankly religion as well. Marriage should be a bond between 2 people and absolutely nothing else. However, [in the U.S]marriage is between 2 people, the federal government, the state government, and some religion.
    It has become a legal contract where liability is written in very very fine print. I know several friends making +6 figures and are basically poor because of alimony payments.

      OK, I see you are in the men are so hurt by marriage camp. Yup, I wouldn't like alimony, either. But as a woman I see men who punish ex wives with custody battles that they don't want to win, men who turn to drug dealing so no one can enforce child support, men who really have no interest in parenting, but they like evidence of their virility, In the marriage wars I think we can declare it a mess for men AND women, OK?

      @@debrabarnhardt1103 I absolutely agree with that. I would never argue against the woman's struggle nor could I really have any valuable opinion in the matter. Unfortunately, my viewpoint is very narrow and one-sided and envokes personal fears about marriage. I really just think the whole system is very outdated and needs some desparate overhauling.

      @@debrabarnhardt1103 I should add, as a military vet I've seen too many just out of high school failed marriages, so the "men hurt by marriage camp" is probably exaggerated in this community. (again, not intentionally discounting the female side of this story)

    Sounds reasonable and serves as an example of how people should treat each other if circumstances become difficult.
    I feel a trust fund could do the same while protecting ALL the assets from civil court vultures and even bring money in if your fiduciary is making good investments.

    Prenups are merely a guide in Australia. And basically completely pointless if there are kids involved or the relationship is longer than a few years.

    Excellent talk. the presenters gave a lot to think about and wise counsel.
    Where reasons for prenups are concerned a few others that people don't think about:
    - A spouse who becomes addicted to drugs or alcohol, engages in self-destructive behavior, and refuses treatment. In a case like this, it may be necessary to dissolve the marriage and take the children and most assets, and limit or deny financial support to the addicted spouse.
    - A spouse can be severely injured in an accident, changing plan A completely.
    - Traumatic brain injury or severe psychological problems can cause a loving, well-intentioned spouse to become someone entirely different.
    - In the cases above, especially the second, it can be tempting to say you meant it when you said "for better or worse, till death", but the necessity, esp. needs of the children, can change this completely.
    Just a note, I am a Catholic, and believe that a valid sacramental marriage can't be sundered. But reality may require the **civil and financial aspects** of the marriage to be dissolved.
    I know some Catholics who have had to divorce their spouse to protect themselves and their children from addicted spouses who have become a danger to them. They have not sinned by doing so. They've had to confront something they'd never thought possible, and deserve the love and respect of the church community around them.

    No prenup = no ring/marriage. End of the story. I'm not putting myself in danger just because i "trust" the person. Simp age is over. If you don't wanna sign a prenup, cool. You can keep loving me without a ring, until death breaks us apart :)

      If she is living with you, it is a common-law marriage and she can still take legal action the same as if you were officially married.

    You can have your own opinion, but youtube comments are always so toxic! They are trying to share their experience. We considered getting one, which is not clear as my girl has savings while I'm making more now and much more in the future... we'll have each other's back... and we didn't pnup yet but why not consider options? If it's because of your church community... wtf mother truckers (O Canada) it's 2022!

    Yeah your whole supposition is that people act rationally during a divorce! Not likely. Most are out for blood at that point with one party looking to get everything ""they're owed" regardless of what it costs the other party or what it does to the kids.

    This argument is flawed. There is something called Social Exchange Theory. Essentially, Social Exchange Theory states that people make decisions by consciously or unconsciously measuring the costs and rewards of a relationship. A prenuptial agreement increases the rewards for not being in a relationship.
    Assume one of the partners gets bored by the relationship after 12 years. In such a case, this party is unlikely to resolve minor issues that develop then as way to force a divorce. It is impossible for humans to ignore this fact as a part of the solution if it exists and is easy.
    The only way to prevent a prenup from becoming liability in case of minor differences is to put in place measures that can make it null and void. Prenup is not a solution to marriage troubles. It is a catalyst for divorce in most cases, especially when couples are in conflict that can be easily solved through effective communication.

      Might be because english is not their first language?
      Believe it or not, people from certain other parts of the world get actual quality education, and are taught multiple languages from a very young age- resulting in very good english, but with obvious differences in timbres and tones.
