One wasn't even established at the trial.

The prosecution case has been torn to shreds by numerous experts but I'm worried that the appeal will again be refused. Unbelievable as it is, the appeal judges can dismiss relevant evidence purely on the basis that the Defence didn't call the witnesses at the trial. That's what they did at the first appeal. Our pathetic and morally bankrupt justice system will not admit errors but we can hope that public pressure might make a difference this time.

That's probably because the nearest thing to 'proof' was statistical. But we all know you can prove anything with statistics. In her trial the statistics were derived not from all cases at her hospital, but from those selected, presumably by the management and police.

It matters to the Parents of the Babies and our judicial system that we get to the bottom of what happened. Letby should be retried without the "expert witness". What about the "confession note" which turned out to be notes from Letby's counselling. What about the shift rota. I'm not saying Letby is innocent of all crimes, but i believe that "beyond reasonable doubt" has not been proven on all counts.

This isn't the first time someone has been sent to prison for a crime they didn't commit though, and the courts are still standing. The only positive of people getting it wrong (for whatever reason..) was the eventual outlawing of the death sentence.
Mr McDonald KC is an excellent barrister he, David Davis MP and many others know that Lucy Letby is innocent and subject to a miscarriage of justice. One day the parents of these babies will know that their infants tragically died due complications and not with malice.

The jury couldn't even agree. They had to be unanimous. And then one juror mysteriously had to leave, and so the judge instructed that it could instead be a majority verdict, and suddenly, within actual hours, the very same day, they returned their guilty verdict. The whole thing from start to finish was a joke. Then again, the court room has never been about finding the truth. It's just a pantomime and always has been.

My instinct is she didn’t do it and time will probably prove that to be the case. I don’t believe there is much chance of the Court of Appeal hearing the case again just because the defence solicitor demands it. The only realistic option of getting the case back into court is through the CCRC.

12 people can still arrive at the wrong conclusion, there are plenty of instances where that has happened. Incidentally I didn’t say she was innocent, for that precise reason I never sat in on the case. But nevertheless the whole thing seems quite dodgy to me.

This isn't the first time someone has been sent to prison for a crime they didn't commit though, and the courts are still standing. The only positive of people getting it wrong (for whatever reason..) was the eventual outlawing of the death sentence.
Mr McDonald KC is an excellent barrister he, David Davis MP and many others know that Lucy Letby is innocent and subject to a miscarriage of justice. One day the parents of these babies will know that their infants tragically died due complications and not with malice.
There is nothing worse than being tried and and convicted on false / fake/ unacceptable/ unaccurate / inaccurate so called evidence, it used to be beyond "ALL REASONABLE DOUBT" and now is at the whim of politics or whom is more important in a trial????????

The jury couldn't even agree. They had to be unanimous. And then one juror mysteriously had to leave, and so the judge instructed that it could instead be a majority verdict, and suddenly, within actual hours, the very same day, they returned their guilty verdict. The whole thing from start to finish was a joke. Then again, the court room has never been about finding the truth. It's just a pantomime and always has been.

My instinct is she didn’t do it and time will probably prove that to be the case.
I don’t believe there is much chance of the Court of Appeal hearing the case again just because the defence solicitor demands it.
The only realistic option of getting the case back into court is through the CCRC.

@mfh848 I don't know if she is guilty, neither do you, and there is no concrete evidence to base the verdict on, so it's all circumstantial and opinion based evidence, and I always thought circumstantial evidence can ONLY be used to support REAL evidence, In other words circumstantial evidence can't stand on it's own, but they seem to have made an exception in this case. As a victim of a miscarriage of justice, I know just how easy it is for them to get it wrong!😮😮😵💫😵💫

12 people can still arrive at the wrong conclusion, there are plenty of instances where that has happened. Incidentally I didn’t say she was innocent, for that precise reason I never sat in on the case. But nevertheless the whole thing seems quite dodgy to me.
How can the COA or the CCRC reverse previous recent decisions and avoid losing face and looking incompetent? MM has got a mountain to climb, because he's fighting against the system and people who have reputations to protect. Good luck to MM.

Justice needs to done. Lots of comments on here about what happened, I personally have doubts about the evidence BUT the chances of it being her are high but is that beyond reasonable doubt I’m not sure. Denying an appeal isnt making sure justice is being served

By my counting, of thefouteen convictions in total that still leaves 10 solid convictions, supported by the evidence. She might get an appeal hearing on these four convictions but she is staying in jail for the rest of them.
