I thank all of you who have contributed to this episode. Last month, my aunt told me that her son was sick (fever and cough) since moving to the new home. I remembered this episode and told her to check the home for mold. She told me last week that they checked the home and found mold all over the attic.

My dad was a contractor and always warns of the dangers of mold. A friend who was also a builder dealt with this mold with a family. He told them they had to leave everything behind for safety. The wife decided to sneak a photo album out, and put it in the barn with things they could save that were stored outside. A while later, the mold infested the barn, and she admitted to the builder that she’d put the album inside. The barn was burned down, they lost everything, so sad. She just wanted a few pictures of her kids, and thought a small thing wouldn’t hurt.

@@FlawlessImperfectionBeauty Sorry, my first post was not clear. Reading your story, it was clear the house was burned. I should have asked : it seems burning a moldy house is the safest thing to do. Why the Allison's house was not burn ASAP? • @FlawlessImperfectionBeauty

@@nathalie_desrosiers I agree, I just think most people don’t there are really dangerous molds out there. I think it was Chicago where all those kids died years ago? Then there’s the family who all died after an insane insurance battle over fixing a leak that caused mold they couldn’t see. They had a multi million dollar mansion, the son started having severe neurological symptoms the doctors couldn’t figure out. Then the husband got early onset Alzheimer’s, the wife was crying on a flight, right next to a mold specialist. He flew out, discovered the mold it’s so sad. There’s at least one Forensic file episode on UA-cam, but all three people have sadly passed since it aired. The house was boarded up with warning signs, it’s a nightmare. 😞

The 32-million-dollar jury award was reduced to 4 million. Later the insurance 4 million settlement was raised to an undisclosed amount. Most likely the original 6 million dollar amount the property was appraised at in 2001. Still there should have been an additional 2 or 3 million for personal injury. Sadly, Melinda Ballard passed away in 2013 at age 55. The toxic mold eventually took her. Strangely, today that 72 acres of hills and lakes North of Austin Texas is worth 50 million with no house.

When my apartment developed mold due to an air conditioner which was leaking-the air conditioner was NOT mine, it was the owner’ that came with the apartment-and I saw the nasty green mold all over the living room, I called the landlord to let him know what was happening, and the response I got was “place a bucket where is leaking, it will solve the problem.” I was appalled and incensed as to his response having my 93-years-old Mom in the living room watching TV and breathing that mold. I argued strongly and was very feisty with the landlord to no avail, then the next day I called The Board of Health of my city, explained the mold situation to them, told them what the landlord had said, and they said they will send an inspector the next day which they did. Upon arrival and looking at the mold and the floor that was getting higher and higher due to the water underneath, the inspector said, “Oh my God!” I remember those 3 words clearly and I told him that I had my Mom living with me, she was 93-years-old, in a wheelchair and we shouldn’t have to breathe that mold because the landlord didn’t want to spend money fixing it.
To make a long story short:
upon knowing what I did, the landlord started threatening me saying, “I will get even with you,” to which I responded “try anything you want, and I you will see how fast I you will wind up in prison!” He bragged to me about connections he had with the Italian Mafia since he was Italian born, blah blah blah….. but to his surprise and disappointment, I wasn’t afraid of him nor anyone else’s, and told him “F” the Mafia, I don’t give a rat ass about YOU OR THEM!” Then I added “You do not intimidated me nor I am afraid of anyone including your so-called “connections with Mafiosos.” And I got the problem solved when the landlord had no other choice but to fix the problem. I bet he was fined for his negligence not fixing the problem. Later on, I moved out from the premises.
He (the landlord) was barking at the wrong tree because one thing I know is that I am not afraid of anyone nor I am intimidated that easily by anyone, and I will take action faster than the speed of light. That’s my temperament what can I say. I get very aggressive especially when I am rightfully correct, and in my case, I was having the Law on my side.
    Moral to my story:
Report problems as soon as they start, otherwise the situation will get worse. And don’t be afraid of landlords, insurance companies, etc. etc., they love to tell threats! 🙄 Stand strongly and you will win.

People ask why Melinda lived in a home this large. This home was built in the mid-1980s, the original owner had financial trouble and could not pay the mortgage, and Melinda bought it in a bank foreclosure sale for like $275K in 1990. Hell of a deal. So when the home started having water leaks, it was only 15 years old; most people with homes that new aren't really paying attention to their water lines and listening/watching for leaks. Defense witnesses testified at trial that although the home material quality was not inferior, it probably wasn't the best to be using in a humid Texas climate. While the fridge leak caused some mold behind the fridge, the major leak that caused the downstairs flooring damage was a bathroom next to the kitchen underneath the stairs overflowing in 1996. Melinda fixed the leak and replaced water-damaged boards -- but moisture remained trapped in the plywood subfloor and hardwood floor -- and it was at the flooring company's suggestion that Melinda file an insurance claim since the wood was not drying out.
Farmers did not allow repairs to be made during its investigation and they wanted to argue over the home's value, whether Melinda was underinsured, other leaks that were uncovered, and the cost of the flooring. Whatever one thinks of Melinda and her lifestyle, the jury (many of whom likely made modest salaries) found that Farmers was the more incompetent party of the two, which was reflected in the amount awarded.

This reminds me of something that happened to a friend and me years ago. My friend was a much older lady living in an apartment with a damp old basement. and she was telling me one day how she always felt sick and tired and just overall not good. So one day I went down to the basement of the apartment and there were damp cardboard boxes with black mold all over them and the walls had black mold all over them. I had remembered watching this forensic files episode years earlier and I told my friend about the mold. She in turn called the local health inspector and it turned out that the mold was Stachybotrys. I think the landlord got in huge trouble with fines and even had to pay for a hotel for my friend. Thanks to Forensic files I saved my friend's life.

I hope that the appeal finally went on Melinda’s side. Time has passed, but hoping they got the $32 million dollars awarded to them. They could certainly use that money for Melinda’s husband and son care. They were victims of GREED, simply put.
This was a very heartbreaking story where two members of the family got sick and couldn’t recover from their illnesses. especially the husband. And all that the insurance company did was to deny their claim. GREED is a deadly sin but this is how business are.: nothing but greedy people running them , and in this case, at the cost of someone’s else health.
I read a comment where it was said that Melinda died in 2013. So very sad and tragic. I don’t know if the husband and son are still living. Imagine being hypersensitive to "industrial pollution". Not quite the same as allergies. Actually much worse.
Gasoline, paint thinner, nail polish, hairspray, black marker, dryer sheets on and on. When exposed the reaction is instant. Inflammation begins throughout the body. Internally as well as externally. At 28, the appendix becomes inflamed. It its removed. A few months later, a urethral stricture causing urinary infections due to inflammation. Another surgery. Then an inflamed prostate. "Exploratory surgery" followed up with medication.
Then inflamed sinuses. Antibiotics for a year then major surgery. 4 1/2 hours.
When exposed to anything toxic (even a whiff), the neurons in the brain begin rapid-firing. Causing a chemical imbalance. Serotonin, a vital neurotransmitter is affected. Running on low levels causes many problems.
Memory, concentration, mood swings. chronic insomnia. high anxiety, chronic depression, chronic fatigue, ADHD, hormone imbalances, swollen joints, poor balance, widespread pain and I know there's more but I just can't think of them.
Oh yeah low potassium too. That was ICU for a day and a half.
This is an autoimmune disease and it is closely related to lupus according to the Mayo Clinic.
Most doctors know very little about it. Most people with this dreaded syndrome live in agony for many years until they are properly diagnosed.
This condition is genetic. My mother and my two older sisters have it as well. As well as my two children.
Well I wonder how many people can figure out what I'm talking about. If you thought Fibromyalgia you are right.
I'm on a mission to make people aware of this.
I had black mold in my house and it had to be gutted twice because they didn't get it all the first time.
Two bathrooms, were gutted and everything thrown. It cost over 20,000 I know that. And that's been quite a few years ago. I had to live in my garage and I really couldn't go in the house at all. It got me pretty sick.
An air purifier with a HEPA filter does wonders. I have one right next to my bed.
We live in a world that is full of toxic crap. I'm kind of like the canary in the coal mine.
What I'm telling you is it's getting worse. Poor quality air and man made chemicals leads to many health problems. This is just one.

Also, any architect or realtor would know that this was balloon construction, why on earth not rip the walls and remove the fire risk? (Thus explosing other issues.) Wow, this was some case. Insurance companies are all the same: making profits. And policy holders pay their insurance payments religiously but when you need them, they are no where to be found……they tell you this and that but will not help you. I am glad the jury awarded Melinda and her husband 32 million dollars for all that they went through. And as far as Melinda’s husband is concerned, my heart goes to out to him for having an impaired memory because of the mold. That house was really infested with mold. My goodness! I hope that the appeal goes in favor of Melinda and her husband for their sake. It is good to know about these cases so people open their eyes about how insurance companies can be and how they work. Hoping and praying that this family’s health Problems are behind for them.
In the apartment that I used to live, mold develops when an air conditioner who was the owner and came with the apartment, didn’t work at all and the landlord didn’t want to repair it but when it rained , water got inside of it and a leak developed. And soon, I saw all that green mold all over the living room floor to the point that the wooden floor was up, and I knew it was mold alright, and that is when I called the landlord . I didn’t want to breath it because is not good to breath that nasty mold, it is a health hazard. So when I called the landlord it was in vain, he didn’t want to take care of the problem; as a matter of facts, he told me to put a “bucket” where the leak was coming from and that’s it. And that was when I hit the roof. I called the Board of Health in my city, told them what was going on, and asked for an inspector to come to my apartment to see for himself the mess that my living room was. They did. They sent a gentleman who saw the mold and was appalled as to what my landlord had said to me about putting a “bucket!” On the leak! He had some friggin nerve to say that to me. Besides, I was not living alone, my Mom and I were living together and Mom was 90 years old. And I said, “ I’ll be damn if I am going to let this POS landlord get away with this, no fucking way!”
To make a long story short: the landlord had no other choice but to fix the problem since he was giving a limited to get things done right by the Board of Health because they will comeback to my apartment to see if the owner had made the necessary repairs . Then, this man (the landlord) when the Board of Health called him or when in person to notify him about the problem with mold, he threaten me with increasing the rent and that’s when I had a very heated argument with him when he raised his voice to me. I told him to go ahead to do whatever he wanted to do BUT that I will see him in court because I will file a lawsuit about everything that was wrong in that apartment. His response was “I will get even with you!” Hey, nothing happened to me physically and he did not raised the rent. His wife was the one to apologize to me on behalf of her husband.
This man had no idea who he was dealing with because when I am right as in this instance I was, I will not going to stop until a problem is fixed whatever the problem might be. Thank God Mom did not develop any of the symptoms that this man had in this story of Forensic Files…..but one thing was for sure: I was determined to have this landlord fix the leak and get rid of the mold, and he had no other choice than to do it, whether he wanted or not or whether he liked it or not. He didn’t want to spend money? Not my problem, it was his; it was NOT my property, it was his! And I was not intimidated by him with all his threats. I am a woman but in my case, he had to respect me, and he had no right to raise his voice to me …..he had no other choice since I demand respect especially when I do respect others. Finally I moved out and I am now very happy where I lived. Mom passed away 9 years ago, and I miss her every single day. Someday I will see her again. End of the story.
