- After The Fact: Judge Raul Pangalangan has just completed his term at the International Criminal Court, an important body established as a court of last resort when states are unable or unwilling to genuinely prosecute individuals for genocide, war crimes, and crimes against humanity.
But nearly 20 years since it was created under the Rome Statute, the ICC has had its share of successes as well as failures often criticized for allegedly being ineffective, inefficient, or even biased. much of these, of course, are largely because of the complex nature of cases brought before it and the lack of cooperation of member states. The Philippines, for instance, officially withdrew from the ICC in 2019 apparently in response to a preliminary inquiry into alleged crimes against humanity committed in President Duterte’s brutal drug war.
In this episode, we try to better understand the ICC by going deep into its nature and processes for justice and accountability.

Huh, even the US does not want to be a member of the ICC. And FYI, members of the ICC who will step on American soil and exercise its role as a member of the ICC will be arrested, jailed and prosecuted. They are barred by the American government to do such because it is a form of tarnishing sovereignty.

Not to mention the gratitude we should be expressing for PNoy’s administration, for purposely including Philippines to sign the Rome Statute of ICC last 2011 that DISQUALIFIES the domestic rule of EXEMPTION or IMMUNIZATION for high ranking officials of the government or HEAD OF STATE to be INDICTED. 👏🏻👏🏻👏🏻
However, uncertainty builds on how far ICC can interfere in our national judicial system. I understand from Judge Raul that ICC will need to let the State resolve first, the case of the prosecuted, and that’s going to be a nightmare should the worst comes.
Also, please do make a follow up on whether we need a FRESH RATIFICATION. We obviously have different set of “leaders” now, not to mention our Senatorial line is pretty much a… joke.

Judge pangalanan, one big question is, can any future ICC ruling, be enforced in the Philippines if the people do not recognize this ruling? is there a world police that can enforce this?
All they can do is to wish that Duterte will go to other countries for a vacation, a country of which is a member of icc, only then they can enforce the law to capture Duterte and put into jail.

The next thing to be determined is whether the local investigation is believable or the country is unwilling to prosecute or if willing, whether its intention is genuine.

Funny about the mention o Yamashita’s case. He was tried in a kangaroo court & quickly executed and his driver ( a pinoy) was tortured for the purpose of finding out the whereabouts of the treasure, looted from a dozen Asian nations ( most from China) deposited in 175 sites ( caves & tunnels) , worth Gazzillions. So it is actually admitted there is a bias. Now who would make the ICC accountable for those bias? The answer is none, and that is the main reason for members of the security council does not want to be a member of the ICC. It is prone to be politicized.
The criteria for lCC Tribunal intervention.
Questions before the court.
1. Is there a crime committed?
2. Is there a law before the crime was committed? 3. What's the decision of the court?
4. Is there a legislative remedy?
That's how you will know it a crime was " exhausted " in Philippine courts.

What are the rights of the victims who were fleeced out of their money due to drugs? The criminals, drug pushers and distributors care about the money but what about the human toll? The victims addiction, the deterioration of their bodies, the estrangement from their loved ones. Who speaks for these victims while the ICC gives the privileges and the rights to these criminals, the perpetrator of their victims misery? Filipinos are passive and pacifist.

I am not convince the way Atty. Pangalangan explained. It looks away from the point whereby the head of state couldn't be investigated. ? Let me have these view. The EJK was on Senate trial and investigation for a couple of years now but , does it not prosper the filing of the case involving primary player of the case at ICC. ? Despite of withdrawal from Rome Stature , the ICC is still had the authority and jurisdiction over it.
