The suspension of a license for refusing breathalyzer seems unconstitutional. I have to potentially incriminate myself in order to potentially keep my license. Insane.
Fast forward and DDT shows a video where a driver does a backflip and of course gets a DUI... also fast forward to the Tayvin Galanakis video where he blows a .000 and still gets arrested.
Even though I never drink and drive (not even a sip), I would still refuse the field sobriety test. I would take the breathalyzer because I know that I would blow 0.000000
I've read that refusal to submit to the breath test results in an automatic suspension of your license. Is that true? Is it only true if you refuse roadside breath test or if you refuse the breath test after they've already arrested you?
It is an automatic suspension yes. HOWEVER you can then go to court on that suspension prior to it taking effect and attempt to have it set aside. So it is really an automatic charge/hearing about suspending your license that will happen.
After being arrested if you refuse blowing at the station or a blood draw, does Illinois have a implied consent hearing ? If you lose the hearing how long is your license suspended for and will you avoid the DUI conviction?
Question... say i am taken to a hospital for a blood draw, and the hospital requires me to sign a waiver, and i refuse, can the cops themselves draw my blood? Like they just stick a needle into my arm and draw the blood out,?
No. Except the core rules. Do not talk do not consent. Possession of weed is legal under a limit. However that doesn't mean they can't use the smell of it to search the car. the admission of your being a user as grounds to investigate if you're impaired. They also have special training to detect drug vs alcohol apparently they claim. They can ask you to consent to one of those and get you on the drug impairment version of the field sobriety test for more Intel.

I refused because I could. I only had 100 community hours. Plus 250 to get out. 200 for my car. 4 grand for the lawyer.

I'm afraid that if I start doing backflips on top of my car in front of the cops they might charge me with something else, like disorderly conduct.
