    For those quoting law: On dual citizenship, International law allows the authorities of the country you're visiting (if its one of the ones you hold citizenship of) to treat you while you are there as if that is your only nationality. For example, if you hold a british citizenship, the British representative in Nigeria cannot give you assistance or protection against Nigerian authorities whilst in Nigeria.

      Simple and short. Any nationality that you travel with is what you are. If your Nigerian passport has expired, start the process of renewal immediately, and the embassy will give you a "travel certificate " to travel and come back to continue with the process. Please save yourself time and embarrassment. Go for TC

      @@LEFTIE61 you're allowed to travel with an expired passport if you have started the process but have not yet received your passport.
      If she hadn't applied or didn't intend to apply then she should have applied for a visa. You don't really need a travel certificate as the government waived the need for that

    Hey Funke! First of all, congratulations on the award and well done on the good job on your channel. However, I would like to correct some assertions made by yourself in the above video with regard to the incident involving ‘Summer Aku’ and please by no means is this an indictment on your part.
    In order to understand the immigration rules at play here, I’ll try to explain to you (and to anyone interested in learning) in simple sequential steps as follows;
    1. The Nigerian government (irrespective of their reasons) passed a courteous policy that allows for Nigerians living abroad to be able to return/visit Nigeria on their expired Nigerian passport. However, no where was it mentioned that once you arrive Nigeria you must renew your passport before exiting. In legal terms this is referred to as a ‘loophole’ - until such time as to when the specified ambiguity is correctly defined by the government, no one should be harassing any passenger.
    Funke it would appear in your comments in the video that you were trying to help the Nigeria government say what you thought/believe they had intended with the policy, that in itself is an assumption until the government gives a clearcut directive.
    2. The immigration officials and in fact the Nigerian government unfortunately do NOT have the right to stop a passport holder or citizen of another country from leaving Nigeria once they are travelling on their valid foreign document. Once the immigration officer can ascertain how they entered into Nigeria (which is already registered on their system upon arrival into the country) and are not a threat to national security or a person of interest (wanted person). That is why whenever I visit Nigeria and upon arrival at my port of entry, I present both my Nigeria and my foreign passports to the immigration officer ….so in the unlikely event that I have issue with my Nigerian passport eg. lost, I won’t be delayed with questions of my entry when trying to exit. In summary as long as Nigeria allows for and recognises dual nationality, it is unlawful for anyone to try to deny/detain/withhold citizens of other countries from leaving.
    Let me be clear that those immigration officials at MM airport did not do Summer Aku favour by eventually letting her through, she was simply exercising her rights as a British Citizen.
    I applaud Summer’s standing her ground and handling of the situation contrary to some opinions and comments below which referred to her being rude, you and I know that when you don’t know your rights, you will be extorted by some unscrupulous officials going through MM airport. The rule as it stands allows for Nigerian citizens abroad to travel freely into Nigeria with expired Nigerian passport but does not mandate these sets of travellers to renew their expired passport before exiting. While every sane Nigerian would want to renew their expired passport while in Nigeria, unfortunately the issue with obtaining the NIM is what’s causing the problem with people not being able to renew their expired passport for the duration of their stay.
    Once again congratulations on the award and keep up the great job Sassy Funke 👏🏾.

    It just occurred to me that the NIS could set up a booth in the airport and offer the option of same day passport for a premium for people coming into the country on an expired passport.
    You can just pick it up in the airport on your way out.
    Good revenue driver and many people will take that option.

      This is not feasible. It will get misused. There will also be a crowded airport. That said, equipment and materials needed for printing might not always be available. Might even take longer waiting time to get emergency passport renewal. It's doable, however, no country is willing to do this 'cause of bereaucracy.

      This is a fantastic idea. However, I suspect the majority with an expired Nigerian passport will prefer this option rather than visiting the Nigerian embassy which will then lead to a high demand for this service but I think the NIS will lack the capacity to process these demands based on what we have seen so far, A proper infrastructure, processes and resource will be required to make this happen as the process would still involve some sort of verification and not just a simple passport issuing exercise. For example, in the UK, an inview and some sort of verfication is required for a same day British passport processing just to ensure you are who you are.

    There is a gross confusion here. There is no law that says you should have a valid Nigerian passport to travel out of Nigeria if you have a valid travel document to where you are going.
    I do not need a Nigerian passport to live in Nigeria.
    Passports are merely identity documents to travel. The authority of the Nigerian government may deny me entry into Nigeria but can not deny exit if I have a valid document to my destination.
    The law on representation as a dual citizenship does not apply here. It addresses a different issue.

    Came to Nigeria on 30 years old passport in February 2024. Yes I had not been back in 30 years. Long story. 😢 Attempted to renew back in September 2023. What I was advised by the vendors who helped me renew my passport in UK was to go with expired passport and evidence that I had completed application for renewal. I took everything, NIN, application renewal form with detail of date of appointment at Nigerian embassy in London. Immigration took one look at my passport renewal form and let me go through. Same thing for when I left the country a month later. Very straightforward. Got my new 10 year Nigerian passport last week. Will be going every year to make up for lost time. Hope this helps someone!

      Very simple. I don't know if it's still there, but on the Nigerian Immigration site a couple of years ago it stated all of this. It's annoying when people who claim to be "enlighten" do dumb shit and are quick to turn on their camera to record it.

      This was similar to my experience except that I paid online and booked the biometrics data capturing appointment to coincide with my time in Nigeria. So I used the appointment and payment slips to enter Nigeria in December 2021, and used the biometrics slip to exit in January 2022 without any issue. So when the passport was ready I returned to Nigeria to pick it up with all the aforementioned slips.

    My question is, do you need an exit visa to leave Nigeria? If you don't, there's no need for the immigration officer asking for her Nigeria passport. You need to know the law and be able to provide when asked. When you travel to other civilized countries. Once you get to immigration officer, there's no unnecessary questions, and if you don't understand their laws. They provide it to you plan and simple.

      I think she made a mistake, she doesn't understand the idea of passport for security. The moment you used a passport in , and stamped, you cannot used another passport ( not stamped) to go without the stamped passport in question. She can't do anywhere. Do you stamp 2 passport abroad. It is one, she needs to decide the one she wants to travel with

      You don’t need a visa to exit Nigeria. You only need the passport of the destination country or a visa to enter your destination country. So, the immigration guy was wrong.

Summer followed the waiver that the Nigerian government introduced (without any associated clause), no one has the right to assume a clause to it. The instruction should be carried out on its face value. Period.

      So they can continue to exploit the system by avoiding both payment for a new Nigerian passport and payment for a Nigerian visa on their foreign passport, but continue to fly into Nigeria and depart as they wish?

      @@godwinella No, not in perpetuity. Only for the period allowed by the Nigerian government. The Nigerian government will not leave the clause in perpetuity. There's a reason why they made the waiver; it's probably to address the backlog.

    I entered Nigeria with my expired Nigerian passport and left with my valid American passport. No one have me any problem. They just nicely advised me to apply for a new one as soon as I have the time. Summer’s attitude fueled them to bother her.

    You cannot come to Nigeria with an expired passport, and expect to be able to renew your passport before leaving, even if you are spending up to a month. It’s not possible in Nigeria. Everything in Nigeria is slow. Only God knows why that is. It never used to be like that. Just to correct the name on my NIN, to tally with the name on my passport, is taking 4 months. Can you imagine that?

      Nigerian Online Passport portal is offering a week processing time for new passport and renewal if you have your NIN, birth confirmatin, and other documents ready. This is a new administration and things are beginning to shake up. Even in Nigeria, I believe within a month, you should be able to get your passport renewed. Just make sure due diligence is done before travelling.

      You can now correct your NIN data by using the self service portal available at NIMC.
      selfservicemodification.nimc.gov.ng
      It’s not free and it only accepts Mastercard. I think each data change costs $20.78. I have used it to change my phone number.

    This is absolutely confusing. How can they use discretion before you can leave? This is why Summer was confused. Please can the Nigerian government be clear and transparent about their expectations if you travel with an expired Nigerian passport. Saying they are applying discretion sounds like they have the power to refuse or give you grief if they feel like it.

    I think the immigration officer was right to question her about this. They are 100% correct. Why did I say this?, she entered Nigeria with a expired Nigerian passport which is allowed as a Nigerian citizen, otherwise if she is using her foreign passport, she would have needed a visa to enter Nigeria. So when leaving, they can ask her how was she able to come in which was via the expired passport, so why not renew it before leaving or attempt to renew it. They will definitely let her leave or believe me, fine her for not doing so. Otherwise, next time, just get a Nigerian visa in your foreign passport for your journey, simple.

      I guess it's because they do not have a trusted database. Countries that do not physically put a stamp on your passport have a record of your entry and exit. That's how they know when people overstay.

    Presumably neither her expired Nigerian passport nor her GBR passport was stamped on entry. So what is the big deal if neither were stamped on exit. The immigration officer was just being a difficult jobsworth.

    People need to do better, she was been rude with her answer initially. Ignorance of the law is not an excuse. You came in as a Nigerian, you are to leave as a Nigerian. If you come in with your American passport, you need to have a visa Nigerian visa on it with entry and exit stamp. She should be grateful she met officers who decided to use their descretion. If she had met people who follow the book alone as its done in UK civil services, she will most likely be missing that flight.

    The lady came into the country as a Nigerian citizen so she doesn’t need a visa to enter the country. However, the immigration officer have to stamp her date of entry but she can leave the country with another passport of which she is a citizen.

    You do realize that these rules will not stand up in the court of law!!?
    The condition must be specified that it is on condition that the passports were renewed.
    Otherwise the government will lose the case every day!
    For them to give that condition, they must make it possible to renew the passport expressly!
    My husband went to Nigeria this way, and they COULD NOT complete the renewal in the 2 weeks.
    He went to the airport with all the documents to show that his passport was still with immigration and they gave him a HARRD time.
    So your assumption is incorrect.
    Let us all stop assuming things and get it right!

      Thank you for your comment, the average Nigerian na dullard, the woman didn’t break any law, the airport make new “laws” up everyday that really isn’t the law, and Nigerians try to reason with oppressors all the time, “yeah but the woman should have done this and she should have done that”… question did she break the law ? NO let her leave.

      The allowance is that you should prove that you have started the renewal process.
      I travelled to Nigeria last year on an expired passport.
      On my way back, I showed them proof that I had started the renewal process and they allowed me to travel with my British passport.
      She was quite rude and disrespectful, if she were this rude to British immigration, they'd take her into a room and it would be worse in the US.
      She could and should have managed it better.
      They understand the rules around immigration better than she does.
      I know some of these people can be annoying but you've got to be tactful especially when travelling with an expired passport.

    There is a book called Travel information manual, TIM, gives informations like
    1)you can come in to your country with an expired passport its not only Nigeria thing, even if you a uk citizen you can travel to the uk with an expired passport but you cant transit through any country, meaning if you are in Nigeria you have to use airlines like virgin atlantic, ba, you cant use qatar or turkish
    2)once the airline security that profiled you allowed you, and you have a valid passport, the immgration officer cant stop you, because if the country you are traveling to deport you as an inad, the fine goes to the airline that admitted you not the immgration officer.

    The London embassy should be SHUT DOWN. Don’t waste your time there. It’s been two years and I’ve still not received mine. The best advice is to get a visa and travel with your western passport.

    I traveled to Nigeria a few years ago on an expired passport and all of these was explained to me by the immigration officers at the airport. She was being unnecessarily rude. She can't be stamped out on an expired passport or a passport without a valid visa.

      She was travelling out on a foreign (valid) passport, so she didn't need a visa. She'd been allowed in on her expired Nigerian passport by an express instruction from the Nigerian government.
      I hope you now understand how different her situation was from your own.

      @minilo2935 my situation was not different from hers. I had my valid foreign passport as well. You get stamped in and out of a country on the same passport. The only purpose the foreign passport serves here is that you are eligible to enter your destination country.

      Why would she need a visa when she is a dual citizen with a valid passport of her final destination?
      It's the immigration officers who got it all wrong. As far as she presented her British Passport on Exit, they should have accepted it rather than asking her why she didn't renew her old Nigerian passport.

    Nigeria is the only country that i know that stamps her passport in and out. When i leave or enter the Uk, my British passport never gets stamped. There shouldn't be any problem leaving Nigeria with an expired passport.

      The reason behind this is that the UK electronically records departures made on commercial flights so stamping is pointless. Perhaps Nigeria does not have as robust a system so resorts to manual stamping.

    The simple logic to the issue is, would she now require a british visa on the Nigerian passport to return to London? She doesn't, she holds a btitish passport to grant her entry into Britain.

    Below is my exact response in the summer video that im replicating here...in Nigeria, we like putting ourselves through hardship and unnecessary pain...and instead of us as a traveling community to say it is wrong, we try to explain away systems that cause hardships.
    The Immigration officers are WRONG!
    The travel documents you need to proceed on international travel are the documents that allow you entry into the said country of final destination.
    I'm in the US, there are 3 popular documents needed to leave Nigeria for instance to the US:
    1... US visa of any category on Nigerian passport
    2... US Green card with Nigerian passport
    3... US passport.
    The US passport automatically trumps the other 2 documents.
    Denying a traveller access because the document they used to come into Nigeria is expired is illegal.
    If I'm leaving the US to Nigeria and I have an expired US visa, will US customs stop me from boarding my flight when I have a valid Nigerian passport????
    She showed them her Nigerian passport in which she used in accessing the country, expired or not, it is irrelevant if she's exiting Nigeria!
    But
    If she presented an EXPIRED BRITISH PASSPORT to gain access to GB, then Immigration can stop her because she doesn't have the required document, to access the country....
    Unless...... there's a law that allows someone with an expired passport to come into the country...just like Nigeria allows citizens to return on expired passport.
    Please, Summer was in the right! A lot of us have traveled internationally, we don't experience any of these, it's only in Nigeria that they want to stamp you out ONLY on your Nigerian passport...No! The stamp can be placed on the foreign passport in which she's using to access the country of destination. They'll only stamp your Nigerian passport if it has documents (visa or with permanent resident card) that is used to access entry into the final destination!
    When I went to Nigeria last year, it was the same nonsense they did....wasted people's time on that line, asking for personal information which I refused to put down my actual info cause I don't know who they will give my data to in that country to track me!
    Let's stop supporting what's wrong!
    The more people that get to that Immigration spot and oppose those officers and let them know they're wrong, the quicker they'll scrap it out but if we keep blaming ourselves, it is easy to keep oppressing us and making it seem as if we don't understand how things work!

      You didn't get the gist. You're not a Ghanaian, so none of your passports (Nigerian or American) would be prioritized when traveling out of the country (Ghana).
      Had it been that you're Ghanaian with both Ghanaian and American passports but entered Ghana with Ghanaian passport, it would be required you go out with same Ghanaian passport as it would be prioritized over passport of any other country with you.

      You're right, I travelled to Nigeria last year with my expired Nigeria passport and returned back to Ireland with my Irish passport. Even when we landed in Nigeria, the immigration officers were telling me there was no problem cos I was worried at first. Let's be honest, Summer's attitude is horrible in this video, and they also were purposefully making things difficult for her in hopes that she will leave something for them but summer stubborn pass goat..

    It’s a shame that you agreed with the nonsense that Immigration man was saying about getting a visa on her passport.
    Rules allowed her entry on her expired passport and that should have been stamped on arrival and also on departure.
    Our passports are only valid for 5yrs compared to 10yrs with other countries and it makes for common sense to allow travel with an expired passport especially if it is still under 10yrs.

      My point is that ALL passports AS A STANDARD should last for 10 years.
      All my British passports since the 80s have always been for 10yrs.
      As a people we need to engage our common sense more!

      Can you travel to the USA without a USA visa? Regardless of her dual citizenship, the laws says once you are entering Nigeria. If you don’t have a Nigerian passport you need to get a Nigerian visa stamped on your foreign passport. Your foreign passport shows you’re a citizen of a foreign country and not Nigerian.

    I personally think there should be more clarity from the Nigerian Govt on this idea of travelling to Nigeria with an expired Nigerian passport. Otherwise, there will always be confusion. If people are allowed to travel to Nigeria with an expired passport and at the same time can travel out of Nigeria with that expired passport, why would they want to renew thier passport. I think the condition to travel to Nigeria with an expired passport should be that an application has been made to renew.

    How interesting, was in the same situation and i tried to renew in Nigeria. 1. I have to get NIN, 2 book an appointment online for capturing. The availability of appointments is after when i was due to fly back. It's impossible to book capturing in advance if you haven't got NIN number. The question is how do you get an NIN number from abroad if you're a Nigeria citizen with an expired Nigeria passport?

    I think that the immigration law needs to be well structured so that incident like this will not be occurring. If they ask people to come in with their expired passport they should have a fast track process to help people to renew their passport if they have short stay

    Looks like they had ulterior motive: paying a bride. Why do you have to leave Nigeria with a Nigerian passport when you are returning to your current country of dual citizenship to which you’re flying to and holds a passport for, eg returning to the U.S.A use a U.S.A passport. Seems like the local regulations are not smoothly blended with recent & updated international travel operations. Filling out the departure card was necessary but requiring to leave with a Nigerian passport causes some concerns when the traveler have dual citizenship. This lead to more questions than clarity.

    @SassyFunke I had a similar issue when I came to Nigeria for Easter. I had assumed I could leave with no issue till the supervisor on duty who attended to me said I should have renewed my passport. In my own case i had an appointment at the Nigerian High Commision in London the following day. So i tried to show him the documents and let him know as soon as I arrived London the next morning I was heading straight to the embassy to attend my biometric capture appointment. He refused and said he would send me back if i didn't drop something, I now politely smiled cos I knew he wouldn't do such, He returned my passport and said i could go, after i gave him 2k naira as "something". In all sha I wouldnt have approached them th3 way summer did. But she went there with a camera for a reason. She wanted to create content, fortunately for the immigration officers they remained proffesional even when she seemed aggressive.

    The problem with Nigeria is that every department makes rules and regulations as they wish the communication to the lines and that’s available doesn’t make it clear that you must have a new passport or unexpired passport to depart from Nigeria.I had the same problem when I was departing from Nigeria even due I have applied,paid #55k and have even been in their office for capturing.I applied for passport on the 6th of march and left on the 22nd of march however it is may 13th I still have no current passport and the customs office who was my go between don’t even take or reply to my calls or messages.How do you apply for passport knowing that you may not get it that makes no sense to me just my opinion.what do I know

    I have applied to renew mine in New York City and they have taken my fibgerprints but still haven't giving me the passport and I have to travel soon. So was I supposed to apply for another passpoet while in Nigeria? And should I wait for months to get the passport in Nigeria before leaving? I have my US passport to travel back. These criminals better not try to stress me.

    This was exactly my experience last April. However they let me go. But I told them to add the caveat that one must renew in Nigeria or that one must show evidence of an attempt to renew prior to travelling to Nigeria. It think it's a policy issue that must be clear because it doesn't portray Nigeria immigration in a good light, knowing that their image before now is in tatters because of endemic corruption in that service.

    It's clear that there was no need to have prevented her going back home .She has been admitted to Nigeria already on a expired passport that was difficult to renew .It is no buisiness of any immigration officer to detain foreign citizens holding another passport traveling home once admitted

      @Georgeognonna she's not allowed to travelled to nigeria using foreign passport except she has a nigeria visa on the passport . However , if u have a valid nigeria passport it's fine . U get stamped out from country u coming from with your foreign passport and on arriving in nigeria u tender your nigeria passport . The reasons is that it makes it easy at the airport rather than claiming another national and immigration will treat u 100% like foreigner

    What the Nigerian immigration did is standard practice. One time I was on a layover at Casablanca. I left the airport with my US passport. When I went back to the airport to proceed to Nigeria, I presented my Nigerian passport for stamping. The officer went through the passport and told me that I should bring the passport that I used to exit the airport. I then gave him my US passport for stamping

    Another important thing about NIN:make sure the names on both your NIN & Passports match before you apply for new or renwed passport.I had to apply for modification at NIMC desk(at National Population Commission),it took a while but I eventually got my passport renewed.

    This happened to me😄. I had my Nigerian passport in my checked in bag on Exit and used my foreign passport. Boy, they gave me hell. Tried to bribe them as they were opened to taking some money. They demanded £500. Anyway, in the end I had to go back to the emirates desk and beg them to get my passport out of the suitcase off the plane, which they did and luckily I got my Nigerian passport out. It was scary experience. Never again. The flight was even delayed because of this.

    Whether have dual citizenship or not, passports need to be valid for at least 6 months. She was wrong to travel with an expired passport. Her other passport couldn't be used to exit Nigeria because she didn't use it to get into Nigeria. Her other passport will be stamped on her entry into her second country of citizenship. The immigration officers did indeed use their discretion to let her leave with an expired passport. They couldn't stamp the foreign passport because she did not use it to enter Nigeria.

    You are getting it wrong, coming to Nigeria with expired passport can be permitted but you must renewed it before living the country or you entered with a visiting Visa with your foreign visa

    The mistake she made is very simple because if you are using another foreign passport, you gotta declare it to get an entry stamp that will validate your leaving the country with the foreign passport.. even without the Nigeria 🇳🇬 passport because of the agreement between the two countries that allows dual citizenship.. speaking from experience…

    When you are leaving Nigeria, if you're with dual passports, immigration examines both, stamps your Nigerian passport, the date of departure..based on the departure form....so you may not travel with an expired Nigerian document!

    Although not a fan of some of the processes in Nigeria. Yes, they could make their processes much more efficient, but why put yourself through the agony. Why even fly with an expired passport, especially when you have another valid foreign passport. It seems like creating unnecessary headache for yourself, especially when you are not familiar with the laws. When visiting Nigeria, you want to get in and out of the country with as little headache and encounter as possible, that would be my advice.

    Funke, when you enter Nigeria on a Nigerian passport, you get stamped in and you have to present that when departing to be stamped out, even with your foreign passport. You won’t need to present a naija passport, if you came on foreign passport with naija visa in it. You can’t present a foreign passport to leave Nigeria without a Nigerian visa inside it, u have to prove how u entered Nigeria.

    I had this problem in 2008 the first time I left Nigeria after spending 23yrs in Nigeria. I came to Nigeria as a baby but I had British passport but never renewed it until I was an adult. I never had Nigerian passport even though my parents were both Nigerians. I renewed my British passport after my NYSC and decided to travel to UK and immigration said I must present a Nigerian passport when I was about to board the plane. I told them to deport me to UK since I do not have a Nigerian passport and have never applied for one before. They said I have been in the country illegally for 23yrs. I showed them my Nigerian national ID but they refused. I was later allowed after I spoke to one of them in Igbo. He said next time I should know this.

    So i went to Nigeria on my expired passport that had expired for 5years February this year, had no problems coming in. I made sure i did my nin that was the first thing i did, then applied for my passport. They let me leave the country no stress because my passport was not ready and i had proof of applying, plus they could see it on their system. No matter how long you hqve have been away get information to avoid stuff like this.

    I think they usually will expect the person to start the process,at least....when you are in Nigeria. She is looking at where she is returning to and not looking at the rules attached to coming into Nigeria with expired Nigerian airport.
    Last year, i was told at arrival that I need to renew my passport if I was going to stay later than it's valid date.

    I feel like it’s a simple explanation. The passport you use to enter a country is the same passport you should use when exiting because they have to endorse entry and exit. You can’t use one country’s passport on entry and then exit on a different country’s passport. Only that in Africa, some officers can let it slide with you know💰
    So get a visa in your foreign passport and use that if your other passport is expired…….traveling ain’t fun when you have to go through all that chaos

    But they should make it clear once they allow entrance with expired passport that going out you need to show evidence of renewal or processing a new one.
    Sassy you are the one that said that BUT Nigeria authorities do not said that. So they should keep on using there discretion for their communication error.

      Nigerian authorities did mention that they have made accommodations for those with expired passports to renew within 2 weeks.

If you don’t have NIN need to process it, is it within that 2wks? both NIN & Passport will be available in Niger in 2wks”🥹🤷‍♂️ Since we got the news of this expired passport entry have been waiting to hear a saga/show.     Nigeria should either cancel the privilege for traveling in with an expired passport so people can renew in their respective countries of residence before they embark on the journey or they should be willing to stamp the same passport they stamped on arrival to Nigeria

      But what sort of argument is this? On the same token one could say Nigerians will expired passports should either attempt to renew their passports and be open to questioning OR they should go ahead and pay for a visa to enter Nigeria on the foreign passport/pay for an emergency travel certificate.

    I booked for my passport two months before I travelled, my capture taken but still didn't get it. They had to post it to the UK after 6 months leaving Nigeria.

    Please don't explain what you don't know and don't make abnormality seem normal. Since she had s foreign passport without Nigerian visa, the immigration just had to stamp her out. I have travelled expired passport before and I know my experiences with nigi and other countries' immigration services. Nigerian security officers generally tend to make things difficult for their fellow citizens.

    There is no government in the world that can stop you from going back to your country if you have not committed any crime in that country, as long as you have a legal document that allows you to enter your country of destination. Not having a Nigerian passport is not necessary if you are Nigerian in Nigeria. Even if she had a new Nigerian passport, it would still not have an American visa on it for the immigration officer to stamp. I have travelled with a valid visa in an expired passport, and the stamp was put in the new valid passport. All you have to do is carry the two together.
