I’m interested in how this will affect applications to Canada. The last time Trump cracked down on immigration, tech companies started hiring on this side of the border to avoid restrictions. This was good for Canada. Although our government has had to restrict immigration somewhat lately, this is just a political reaction to a public over reaction (encouraged by a focus on immigration in social and regular media because it generates clicks). In the future, we stand to benefit from highly qualified people coming to work in our country, especially those who have already been working or studying in the U.S.

Since my EB2 NIW petition was filed under the policies in place as of January 2024, it would typically be reviewed under those existing guidelines, even if new immigration policies were introduced later. Changes to processing times or additional review steps could theoretically slow things down, but petitions already in the pipeline are usually less vulnerable to sudden eligibility changes or restrictions.
Hmm not really, that's not how the system works. The US immigration system leaves a lot of room for officers discretion, and changes in guidance can also trickle down pretty quickly. That being said, if you filed in January, hopefully your case will be adjudicated soon.

He went on a podcast not too long ago and spoke about how he thought international students who graduate from american colleges should be awarded a green card so they can take and create jobs here in America, rather than take their expertise somewhere else. He’s very pro high skilled immigration, but always been very opposed to just having people come over the border with no documentation and taking on thousands of dollars in welfare, which happens in a lot of states.

According to lawyers, if you started a process this can't be just stopped. It can be later denied, according to the case's own merits, but not cancelled out of mere wish.
I-140s will not get cancelled..or the probability of that happening is very low. Another thing is that they impose certain bans like he did in 2017 with the muslim ban, that prevents certain foreigners even with a DS-260 approved come the USA.

I can see the processing times are getting higher as you already mentioned, most due to the increase of petitions placed. Hi Flavio, thanks for your words. The visa bulletin has little to do with the President. That is unless they change the law (and the President alone can't do it, he needs Congress). Processing times on the other hand can be affected by the President's actions, because he will appoint the higher ups in the agencies, who will oversee and eventually affect how the personnel behaves

Hey Oscar you are sure, that premium processing take 45 business days in case of EB2 NIW? I used premium processing for my EB2 NIW with consular processing (I-140) and it was per definition 15 calender days in 2023. I got my approval within 11 days.

Yes, as for many of the things he says. We'll have to wait and see, but I (highly) doubt there will be green cards for all students; and I am quite positive there will be stricter H-1Bs
It is likely that H-1B visas will be harder to get due to stricter rules, but once you prove to be extraordinarily skilled, you are given a green card automatically. That's one way to strike a balance between "American first" and attracting international talent which could contribute to the country.

Let's be optimistic and assume no big changes will happen. But yes, in the past there have been bans like the ones I mentioned. The Muslim ban was not a ban on Muslims but on people from certain countries, which happened to be Muslim majority countries , hence the informal name
If premium processing is paid, it is unlikely that they will cancel it. They might make it longer tough by giving several RFEs that reset the premium processing clock!
They should made a reform for path pf cotizenship. Remove the instant citizenship. People need to work for certain years like 10 years with no criminal record can apply for green card

I mailed it in July but USCIS returned it to me for the 4th time due to “incorrect payment amount”, and of course I called them every time and double checked - it’s $715 for I-140, I have a money order for $715. @ I did when I sent it the 3rd time: 2 separate money orders of $715 and $300 as an “individual petitioner” but they returned it and I called and they said I’m not an asylum program seeker so I confused them with the $300. It has always been 45 days for NIW, it has only existed for a couple of years.
the only difference is that since April 2024 it is business days, not calendar days. It got slower in that sense recently

Unfortunately I have not looked at approval rates that far back and there's no reliable statistics on RFEs

Let's be optimistic and assume no big changes will happen. But yes, in the past there have been bans like the ones I mentioned. The Muslim ban was not a ban on Muslims but on people from certain countries, which happened to be Muslim majority countries , hence the informal name

If premium processing is paid, it is unlikely that they will cancel it. They might make it longer tough by giving several RFEs that reset the premium processing clock!

I have a big issue with submitting my NIW case. I mailed it in July but USCIS returned it to me for the 4th time due to “incorrect payment amount”, and of course I called them every time and double checked - it’s $715 for I-140, I have a money order for $715. But they keep returning my case, this is insane and I don’t want to hire a lawyer just to submit a case I’ve made myself in June. Could you please help answering this question about the fee or giving an idea what I can do 🙏🏻🙏🏻

@ I did when I sent it the 3rd time: 2 separate money orders of $715 and $300 as an “individual petitioner” but they returned it and I called and they said I’m not an asylum program seeker so I confused them with the $300. So they told me to mail it back with only $715, and I did and they returned it again…

My NIW petition was submitted earlier this week and I am considering upgrading to PP for exactly this reason. As as a follow up, in your opinion does any increased risk of RFE via PP outweight the risk of the uncertainty of waiting potentially a year for normal processing?
