Mr. Noffsinger is a very competent and compassionate attorney. This is a two year old case of a mentally ill man throwing a phone at his aunt. 60 days in jail just doesn’t make sense as a punishment to fit the crime. Judge Middleton on the other hand is trying to do the best to help the defendant within his scope of authority. Just another case of the legal system and jails unfortunately being the largest providers of mental health care in this country when they absolutely shouldn’t be.
The defense lawyer didn’t seem to want to help his client- just to get him out of jail. It almost seemed as if the lawyer had an alternative agenda or knew something that he didn’t want to mention because his behavior didn’t make any sense.
The defense lawyer is doing what his client asked him to do, which he is legally bound to do. The time to try to steer your defendant in one direction or another is before court, not during court.
Right?! The judge was wanting to hear what the man wanted and his lawyer told him to shut up! Only reason I can think of why he did that is the lawyer was concerned his client would go off the rails…even though he was sitting there rather calmly!

I don’t care for Luke very much. Especially after he laughed at an accident victim on his way out the courtroom and actually got confronted by another attorney on the livestream.
The judge was looking out for the defendant's best interest the entire time, trying to help him find a place to stay and keep going down the right path with medication. I mean he even suggested Disability to help the guy have some form of income. That defense attorney just doesn't seem like he gives a flying fig about his client, and only wants the win.
@@johnp.2267 he’s a rare anomaly in public defenders as I’ve seen over the years who usually would’ve stayed quiet and been happy with everything that judge was offering. I don’t know how he normally acts with clients but if this is normal I think the public defenders office needs to look into him
If they had just left the laying dogs lay, they would not be in this mess. He had a place, a life, and a stable situation in that group home, and all was good.
Is it just me, or does it seem like the public defender has an attitude of "I don't really care what happens to the defendant, I just want him off my docket!" It's more than apparent that Judge Middleton has more concerns and compassion to ensure that the defendant gets the help he needs and can hopefully have a successful resolution to have a better life when he completes his sentence.
People are forgetting how defense works. The defense lawyer was going for no probation and limited sentence because that's why the defendant asked of him. What's best for the defendant is irrelevant. The lawyer does what the defendant asks for.
Why is PD fighting so hard to free him with ZERO HELP, that is NOT helping him, its throwing him the keys and releasing him without knowing where he sleeps at night and no way to eat. I understand his role, but if Mr Nofsinger (???) wants Mr Brown out so badly, Mr Brown can come live, and terrorize HIS neighborhood. I get it, but some people have to be seperated from society for our, and his own, safety. This day and age, Mr Brown could be in very real danger crossing the wrong people
The defendant probably told him that he doesn't want probation and wants to go live in some house, so that's what his lawyer shoots for. Unless your client is found incapable of aiding in their own defense by the court, you are legally bound to do what your client asks.
Though it was a case from 2022….. He Still has to pay his debt to society. Just because he’s….Indigent, or SPEACIAL….meaning..has a few clearly Dangerous mental health issues…DOESNT mean he gets a Pass and THAT’s EXACTLY WHAT HIS P.D. is Attempting to do. If he physically assaulted someone and hurt them, he broke the law. He knows What he did..He’s Plainf Up to the Judge. Good thing bout being a Judge in a seemingly SMALL COMMUNITY…… THIS JUDGE…KNIWS ALMOST EVERYONE IN IT. I think this judge it trying to be as gentle and helpful as possible. I believe…This guy should do his time in Jail or Prison and then, be released to an INDEPENDANT living Style Mental Health Facility. That way, he can live Independantly And..BE CLOSELY MONITORED BY MENTAL HEALTH STAFF AND PHYSICIANS. I JUST WONDER….. WAS HE BORN WITH MENTAL HEALTH ISSUES……OR…..DID HE AQUIRE THEM THRU DRUG USE !!??? Either Way, Judge…is stuck between a Rock and a Hard Place….😢😢😢
Schizophrenia usually appears when someone is in their 20's and no one knows why it seems..it's a terrible disease and they often take medication just long enough to feel better then stop and slide back into their world of delusions, hallucinations and often violent behavior. Drug and alcohol use just seems to feed the disease. 😢
That attorney needs to learn when and when not to make an argument. One of the things you learn when dealing with others is when to stop. If you go farther you've gone to fast and lose your gains
I ran into that situation with Probation/Parole as well. Mental health is difficult to monitor, and avenues for housing is limited or not at all. There were times we stretched a bit, to keep the individual off the street, whether mental issues or simply homeless. The Public Defender might have had no experience on the issue, and meant well. After awhile ya see it coming and do what ya can. Peace!

Seems to me the judge was advocating for him a thousand times more than that ridiculous lawyer! What’s wrong with than man?! His lawyer seemed to be okie dokie with his client being put out onto the jail front steps with no money and no place to go…that guy needs to be reported to the Bar!
Why does a defense attorney want his client to be given time served and dumped out on the streets when he has mental issues and family that care about him but cant deal with his mental issues that cause more problems, and why is the attorney so gun ho to just get him out with time served? is he an actual attorney? how about the attorney take him home to his family?
Defendant doesn’t give consent for probation. The court makes the final determination, usually with recommendations from the DA, the Defense and Probation Department. The defendant complies with the conditions or they get violated.
Bless judge Middleton, he tries his best to help, he’s the opposite of judge Boyd for example, who is just there to grease the wheels of the system with blood.
Judge Boyd is in Texas, and he's in Michigan. Judge Boyd runs a felony criminal court, and he's in misdemeanor court where it is more about putting people back on track instead of punishment. After watching these videos, it's clear every judge tries their best. And there is no right way to do things.

I hate when defense attorneys argue just because a crime happened a couple years ago it somehow deserves less of a punishment.

The aunt isn’t required to have him at her home. If he has a guardian, that person is to act in the best interests of Aaron.

Hard disagree. He was representing his clients wishes. If he just wanted him off his caseload he wouldn’t have objected to the sixty day sentence.
