Obtainable legitimately. A lot of items are present in the code from previous games. Like for example BDSP has items like the DNA Splicers in the code. I think you can catch a Delkatty or Skitty in something like ORAS if you hack in a moon ball because they are present in the game due to transfers from HGSS. I'm not sure how they function though. Could be wrong on that though. I do know moon balls are in games they're unobtainable in though.
I had to look up the differences between the water egg groups after it was mentioned: Water 2 contains fish (and Inkay/Malamar), Water 3 has invertebrates, Water 1 is filled with just about everything else that lives in water, mostly semi-aquatic mons.

So Squirtle and seel fit into water 1, Goldeen and magikarp into Water 2, and tentacool, omanyte, and kabutops into water 3. Or at least, that may have been the original intent.
