Sir good day, regarding sa lump sum contract, example yung tiles homogenius sa contract, then nag change to ceramic yung owner,,.....marerefund ko pa yung sukli ko,... say 35k in contract, then using ceramic cost only 20k,....so may sukli pa akong 15k doon sa contractor as to be deducted on that item?.....thanks
Normally it plays within the range of 5-7% only, depende sa agreement ng owner and contractor. It's not that much, but contractors are safe. Like I said, owner is the one taking the risk. Thanks

Depende po yan sa detalye nung LS contract ninyo, normal lang magkaroon ng changes kahit fixed price. Sa pagkaka alam ko ang standard contract may provision yan sa additive and deductive, applicable yan in case na mag karoon ng changes in the future. Ang importante bayaran ng owner yung nagawa as long as it complies with the contract document. Suggest ko lang mag reconcile kayo with the owner kung tama yung quantity na nai babawas dun sa original, then apply ninyo yung deductable rate na pinag ageehan ninyo sa contract. Take note normally deductabe rate should be direct cost(no profit markup)

Kaya ko nasabi bihira kasi sa structural shell may electrical and plumbing rough-ins incorporated sa concrete normally mga GC binabawi nila profit ng electrical and plumbing pag dating sa supply and install ng fixtures (complete packages). Besides para sa owner na walang experience sa construction mahirap yung ganung set up.
Kung wala po provision sa contract about "liquidated damages" siguro naman po meron silang agreed timeline sa contract. Pwede i terminate ng owner yung contract at award sa iba. Parang gagawa kayo ng amendment sa contract but this time mag establish na kayo ng certain amount of money as a penalty "per day", we call it Liquidated Damages (LD) normal trend is 1/10th of 1% of the total project cost. Mahirap po kasi mag penalize ng contractor pareho kayo ma aabala except kung meron "penalty clause" sa contract na applicable to implement. Kahit sa husgado ina advise nila i settle muna ng two parties between them ang dispute, kaya po ang mai aadvise ko alamin nyo muna ang cause baka ma resolve ninyo sa pag uusap. I hope that helps po
