    1. Not under regular care of a doctor
    2. Not consulted with a psychiatrist/psychologist
    3. Not doing the recommended treatment
    4. You're not receiving proper treatment (ie., Not just go home and rest, but medical guidelines/best practices)
    5. No documentation

Thanks for summarizing these for everyone! I would clarify #5 to say No documentation or no documentation. Often people have documentation it just isn't up to par with what the insurance company needs to see.

@@ResoluteLegalMoncton In regard to disability and borderline I had a question. Is it normal to have therapy sessions notes that reports your anxiety and anxiousness awaiting a social security hearing? And being ocd about that? Also, is it embarrassing that your sex life is reported to the disability department in your treatment notes? Would they think of you as a bad person?

Have everything in place and still denied.

From someone who has been fighting with the Social Security Adminstration since 2014, Honestly with mental illnesses, it comes down to the judge. ALOT of judges don't consider ANY mental illness as disabling, My case has been remanded from the appeals council 4 TIMES! I still don't have disability. I had it for three years before they found one statement my doctor made that I was better that visit and kicked me off disability. Every judge after has screwed up my case and it's gotten remanded. My last option is taking it federal court because of how many times I've won at the appeals council. So, Keep that in mind. You can do all the right things that he is saying but if the judge doesn't think mental illness is a disabiling condition, you're going to lose. The Social Security system is broken and at this point is not objective, They go in trying to prove your not disabled not to hear out wether you are. They will take any hint of ability to do even the simplest things(i.e.-making your own food, dressing yourself.) and use it against you as proof you can work. just letting you know from my experiences.

Do you mind if I ask did you have attorney present for your remand hearings? I also got denied after remand but with no attorney.

I've been diagnosed with 5 mental health disorders, one of them being labeled as one of the hardest to live with. I've been hospitalized 3 times, gone to a 6 week residential place, I've been on meds, seeing a therapist and psychiatrists. Im doing my best to take care of it. I made an appeal the first time I was denied. Had my hearing and almost a year later....I got denied. A 4 year process. And there's wrong information in their decision. They got certain chains of events completely backwards. I won't give details but instead of saying claimant did ABC...they said I did CBA. And because I have been working part time...they say I'm capable. I can't not work. I'm allowed to work a certain amount of hours. But I'm basically working with family so I actually get accommodations and they understand my issues.
    Now I'm getting a lawyer.

This is why this system is so bad. The disability insurances doesn’t care about your money or your opinion. It care about their point of view. They don’t care if you get throw out of your apt condo because they want you to spend your money on lawyer and healthcare . If you can’t get a job your healthcare will cost $895.00 a month.Your money in your bank account will go very fast with rent ,food, utilities and money for your family .

Hearing voices in your head all day long is no joke, how in the world do they expect folks like this to work? They don't just hear the voices they answer them back and argue with them a lot.
These voices identify themselves as *demons* and I believe they are!

What about autism spectrum disorders? My son turned 18 last September and went through all the testing at the clinic our family doctor referred him to. That took us almost a year to get a diagnosis, got it in December and applied for disability on April 22. They are sending him to do the testing over,s aid they needed more recent tests? Also went through all the testing through his school the year before for his IEP. Autism isn’t curable?

What can you do when your doctor is failing to send requested reports to the insurance company? I am currently caught between the Insurance company that has directly requested reports from my doctor and the doctor who is claiming that he is too busy seeing patients to complete the paperwork. I am currently being held hostage by the process. I have impressed upon the doctor several timesvthe urgency of submitting the requested reports. Any advice would be wonderful.
