    Disability attorneys Gregory Dell and Stephen Jessup have a very thorough discussion regarding disability claims for depression and anxiety disorders.
    These claims are the claims which are most highly challenged by the disability insurance companies because the condition is purely subjective and based on self-reported symptoms. There is no way to objectively prove you suffer from depression or anxiety, such as a blood test or x-ray. Disability insurance companies take advantage of this fact and will deny claims for lack of clinical evidence of disability due to the depression and anxiety disorder.
    Making sure your psychologist or psychiatrist is keeping detailed and legible records of each visit is key. The records must provide documentation of why your depression or anxiety disorder is causing an inability to perform your job.
    A red flag to look out for if you have are receiving disability benefits for depression or anxiety, is if the disability insurance company sends you for an "Independent" or "Compulsory" Medical Examination with a psychiatrist or if they send you for neuropsychological testing. These exams are used to disprove your claim and look for malingering or overstating/exaggeration of your symptoms.
    Most disability insurance policies have a limitation for mental/nervous conditions, which include depression and anxiety. A claimant is typically limited to a maximum of 12-24 months of benefits if approved.

    As a licensed psychotherapist I absolutely can't stand to apply..... You said it Subjective. I have practiced for 25 years clinically and I hate it. I feel dismissed, disrespected and it angers me that my clients really need to be off. Unless I say someone is suicidal or involuntarily committed to a psych hospital they get denied by people who have absolutely no clinical experience. I am seeing people twice a week and treating them with evidenced based EMDR they get denied. The other day I had to ream into an employee for Segdwick because she said if everyone was approved due to psychosocial issues then everyone would be approved. A treatment summary has been challenged and I always say what is in the summary of treatment done that you need. I get really specific. Yes this email is long because I am so frustrated. These people PAY for these benefits. It is class action lawsuit time. Medication is treatment, psychotherapy is treatment....Hospitalization is not the issue its being able to perform on jobs where the training is inadequate, the folks in leadership are horrible and the hours are long not to mention the pay.

      Thanks, you give me hope and faith to see my psychiatrist. My primary care doctor is getting me referred which has taken almost a year. I suffer from panic attacks from prior S.A. At gunpoint and I have triggers plus I have depression and I suffer from migraines .I applied because I feel like it is only right but I k ow what will happen and the. I will have to pay for an attorney. ❤

    Thanks! That help me to understand a lot about my own issues. My therapists always ask am I feeling like I want to hurt myself. I often lie. I many times sit and think of suicide. A many times I get every medication bottle in the house and think of taking them all, but I fear that I will only wake up in a hospital... The life a total failure. I've been fighting my case for 6 years on and off but it's been consistent the last year and a half. I have a lawyer, but at times I can't tell. At any rate thanks for the info guys

    great information .it's sad how people like me who have depression.. anxiety and bpd which is a huge problem in my life might not receive benefits because there is still such a stigma and misunderstand on how this is truly a serious illness that caused me to overdosed 4 times .

      Leighann, I hope you are still fighting anxiety and depression as I suffer from severe social anxiety and severe depression. I'm 29 now and to this day, my family is convinced that I do not have a mental illness but they called the police twice these past 2 years to only take an ambulance ride to the psych ward which truly made a negative impact on myself. I have done everything that I can to help my family understand that just because in the Polish community, seeing a therapist and a psychiatrist makes individuals a "weak" person as they try to tell me the 5 words that I despise as it makes me furious when I open up about my depression and I get told, "it is in my head" as if I was not on Paxil which helps my social anxiety by 90%, I would not be on earth as I don't believe in any higher power. I worked as a car salesman for 5 years which before being on paxil, just thinking about any sales job would make me very anxious. After my third year is when I finally was able to small talk with any stranger. 99% of my progress to keep fighting for my life came from the unbelievable compliments customers spoke about me as I have over 800+ 5 star reviews on Google, Dealerrater, Edmunds, Cars.com and Yelp. 50% of the reviews online for our dealership has my name and the incredible compliments about me. Because of that, I learned that I get joy out of helping others as I care more for others before myself and I never lied to my clients. I will say that I have become a completely different individual, I am more confident as the compliments gave me a reason to fight and keep going to handle my illnesses. My #1 wish is to say the words before bedtime is "I felt happiness and content for the first time in my 29 year old life. Leighann, I do not know if you have heard about the swab DNA test that is capable of knowing the exact medication individuals would most benefit from as with antidepressants, it was tough because they take 6-8 weeks to see results and if you get worse, they try another SSRI to which you have repeat the cycle to find the correct medication which is a struggle.

      Normally an individual would say I'm sorry to hear that you overdosed 4 times but I will tell you the truth which is a fact that you are strong and have been through alot. I truly wish you a future with nothing but happiness and a better future. I was 2 seconds away from taking barbiturates that I doubled the dose to make sure I would be gone forever but the last thought in my head that stopped me was knowing that my beagle puppy will never see me again.

      The system is designed to make it difficult for people who are truly Ill in some way shape or form to get disability. I was documented. I got denied. I got an attorney. They asked the right question and they got the right answer.

    I am at the hearing stage of my disability claim. I live in Louisiana and i am having a hard time getting any of my medical records and finding an attorney who even sounds competent to represent me. My husband committed suicide a decade ago and i havent worked in over 15 yrs. I have ptsd, bipolar/manic depression, panic disorder as well as hbp, fibromyalgia etc... im on 16 diff meds and i can barely concentrate enough to handle this case on my own and my survival depends on this right now! This was very helpful but i still dont know how im going to be able to do this on my own.

    What makes this whole process exponentially more difficult for sufferers of depression and anxiety is that these are very often symptoms of deeper illness or disorder in which a variety of other symptoms that may not be as obvious are present. And despite all this, insurance companies insist on jumping claimants through a million hoops and act as the administrator of your own claim. That means gathering records, compiling notes, answering questions, and coordinating all of this between four or more parties. If I could do all of that, I could do my job. The application of financial pressure through delays and the eventual loss of employment doesn’t make this process easier or even more likely. For me, it has the exact opposite effect: I shut down completely and my disability becomes so pronounced that the possibility of suicide becomes a very real fear.
    I find it both telling and staggeringly tragic that 95% of suicides were diagnosed with some form of mental illness. That means the vast majority were at least once evaluated by a professional and the outcome of that encounter (or subsequent encounters) left them without hope. Might be interesting to see how many of them were subjected to the endlessly frustrating and demoralizing process of proving they’re not lying. And how many of those insurance companies’ claims denials may have played a role in the wholly avoidable outcomes? It has occurred to me more than once that my suicide would, if nothing else, satisfy the insurance company’s demand for proof of disability. I wish I were joking. Really.
    What I’m trying to do, though, is survive this with as much of a record of the experience as I can manage so that when it’s over, I’ll be able to write/blog/podcast about it for the benefit of others and maybe get someone out there to reconsider the way our insurance industry actually operates relative to its intended purpose. The number of policy holders is far, far greater than the number or amount of annual claims (if it weren’t they’d already be insolvent). So, besides the obvious incomprehensible level of greed, why don’t they just take claimants at their word and pay their claims? The number of corrupt or intentionally fraudulent players is only going to be 5%-15% (5% for certain, another 10% on the fence depending upon Social and economic factors and ease of opportunity), which could be investigated after the fact. The rest of us, 85%, are still law abiding, basically honest people. They know this as surely as I do and it’s their business. The whole situation just creates even greater distrust for institutions in America. What is the point of paying for insurance that covers nothing? Like health insurance that you pay in excess of $500 a month for and that STILL carries an annual deductible of $3000 for your family. It’s a racket. If it were any other kind of business, it would be seen as a criminal enterprise and investigated by the DOJ. But, because they’re just regular guys trying to make a buck…wait. Insurance companies should never be for-profit entities - it’s a conflict of interest. The one I work for (home & auto) is a mutual insurance company, as they all should be. Period. Ok. End of rant.       Yup . I had anxiety bad when i was younger, which hadnt really bothered me until i got hurt. Now my anxiety is coming back bc i can't do the work im capable of normally. Can't stand this

      I have major depression and anxiety disorder, while also dealing with insomnia and thyroid imbalance. I needed a rep / attorney just to be approved. I was rejected the first time cause I didn’t “look” disabled. I’m lucky to be able to receive SSI. But my weight gain keeps getting worse and my energy levels are severely depleted and questionable. But many people argue that because I can walk and talk that there’s nothing wrong with me.

      You are not alone my husband had a simple back injury and you can imagine he had so badd the person because he loved to work hard in his stopped him when he injured himself it was a lot of pain I have very sorry that you suffered depression God-bless you Hope you can get the help you deserve and what God tells you inside fight for your right

    I think winning your case varies from state to state . I see some people win that do not seem to be sick while some people that can't work can not win their case.

    My friend - as a flight attendant was ejected into the ceiling of a jumbo jet due turbulence- not once - twice. Her head injuries somehow worsened over the past decade until she is a walking zombie- Sedgwick Workers Comp has caused her condition to become worse-now she has not only injuries but the added anxiety and depression.

    And don't forget this....when you all of a sudden experience a episode of mental illness it takes forever to get any help in my area it's almost impossible to get a mental.health doctor in a timely manner and cigna is asking for a lot of paperwork from a doctor you haven't even seen yet

      Here is what you do go to the er saying u having suicidal thoughts and feelings when they ask if u have a pan say yea and make up on how u would hurt yourself they will send you to a mental health hospital for 72 hours some times the most will be 2 weeks before they will release you you will be set up with a mental health dr in your area true story

    Wow you really nailed it. I was refused and the judge threw out my Psychiatrist's notes and I had an attorney that said nothing. I then got a new attorney (fingers crossed) and had a neuropsychological evaluation that supported everything my psychiatrist said and more. I also have physical disabilities that have worsened degenerative disc disease and osteoarthritis (spine and knees) that has me in pain everyday. Cortisone shots do nothing to ease the pain and with the "opioid crisis" Doctors will not give me medication that works, due to past "issues" with alcohol and such. I have won an appeal but it has been months since I got that approval letter. I am not EXACTLY confident in my attorney but he was the only one that would take my case, and I called many. By the way, my diagnosis is bipolar, depression, anxiety disorder, compulsive behavior, and scored lower than anyone in my age group in all the tests, except for vocabulary on my neuro psych eval. I really hope that I don't get sent back to that same judge. That will definitely be a problem.

    A lot of times I can't afford my medication, because of bad spending habits(casino), then when I get on prescriptions that I really need, I get harrassed by people.

    Me 6-ft 2- 290lbs 50yrs old Working heavy construction and before that a industrial tire tec. {press-on forklift tires MOBILE]
    Had my life planned out to the day I was going fishing whenever I wanted.
    3 rods 6 pins Bone stimulator in my back blood clot from 2nd surgery so now blood thinners.
    Sciatic nerve was pinched by fully extruded disc.
    Pain all the time.
    I'll never lift more then 25lb lbs and that Maybe 3 times a day.
    insurance wants to cancel the shrink.
    These guys are dead on.

    Well not like everyone else on here I live in Ohio and I went to a doctor that my attorney set up for my depression and anxiety and to be honest I don't see how anyone with a work injury gets around without having this because this is pure hell but anyway the BWC wanted me to go see their doctor so my first thought was their doctor was going to lie just like the so called IME doctors do but I was wrong the BWC doctor said that I have bad depression and anxiety so the BWC granted me adjustment disorder with depressed mood but the insurance company has 14 days to appeal it so I'm not getting my hopes up just yet because I know how they are but I have 2 doctors and the BWC RN who agree to this so I don't think they stand a chance at stopping this I'm just glad I can go get the help I need and thank you so much for the video most attorneys don't give out enough info when it comes to this.

    I have physical and mental disabilities from my years in the Navy. It was embarrassing at first but I have worked hard from the age of 16 to 51. Sorry really don't feel like dealing with people yelling, long hours or negative people.

      Hello, very good information. I’m Linda and 55 yrs old. I have acute anxiety and depression and have been treated for 20 yrs.
      I’m in 4 different medications and have a major nervous breakdown in 1996 had to take a 3 month leave from work. I have a very understanding boss and have been there for 33 yrs. unfortunately I can no longer handle my job responsibilities due to my anxiety. I m separated from a Alcoholic and my father passed and mother had a stroke. To much for me to mentally handle even taking meds for 20 yrs. where should I start to apply for SSD?

    Yes...These guys are dead on...With a Good Lawyer..and a Good Doctor you can win your Disability Claim. I won against Sun Life..and in Canada...Sun Life Insurance play hard ball all the time...and they will attempt to Bully you into submission...But you must fight all Bad Faith Insurance Companies...Sadly that's just the way it is..!     I have depression and anxiety treatment since 2004 (I think) and am taking the same medication since 2006. It was changed after I was hospitalized for suicidal ideations. In 2001 and 2012.....I told my PCP that it wasn't working anymore. He ignored me and raised the dosage up to 40mg. I still see it doesn't work....and have frequent anger outbursts and crying spells. Do I need to get this past information from the other doctor I had during this psychiatric episode? Do I need to submit this the judge for the hearing?

    Cigna just denied the request for TMS. This is after years of meds and therapy. Their justification is that the therapy did not detail the problem enough.

    im working with drs currently im supposed to get a evaluation for adhd but earliest apt is in a year. otherwise i keep struggling doing poor in school. but im trying still trying for a therapist. already have social axiety. now just gotta keep up but i do have a son with severe autistm but idk how to even help him with a claim

    What if you are telling your Dr that your in pain and told the doctor the over the counter medicine doesn’t work and is offering pain medicine but never sends it to the pharmacy

    I am started getting depressed for 2 years and I'm on SSI and I just feel numb never happy and just feel sad all the time especially with the pan damn me that really brings you down so they up my dosage on me so long so I was wondering if that's a where I can get my disability or I don't know and my I got a bad heart rhythm you know something's wrong with my heart that it goes faster and it comes outside my chest feels tight so I don't know if that's got you know anything to do with it so thank you and goodbye

    i am 54 .two year ago i treated for brest cancer,they did surgery and revove tumor and also remove my limph not under my arm.i also did chemotherephy. after recover 8 months i back to work with some restriction. iworked 24 years for this company..now my manager told me i am not perfoming my job expection.i am try ing my best they know but now they want me to leave company . otherwise they fire me.i am in depration what to do after loosing job for giving my 24yr to company. do i qualify for ssi i am 54 running

    Q; I have both medical and psychological disorders. I can't even finish the forms they send me due to not finishing projects, tremors, apathy from depression or a mix of so many limiting factors.
    I asked my worker to do a home visit for my psych and medical evaluation due to agoraphobia from severe panic attacks. It was brief and he seemed to only care about panic, bipolar and schizo affective disorder and the plethora of meds. I had much more to add like family issues...but everyone was home.
    They now want me to go to a medical evaluation today due to lack of medical support and info. If I make it what am I to expect, I'm anxious and overall imbalanced. I will mention severe and treatment resistant irritable bowel syndrome, heital hernia, pain from leg spasms, gastritis and so on.
    Is there any advice u can give on the info provided? It feels extremely complicated and like I'm on a slippery slope.

      XsHiLLerOMG AleXander If it is a mental health evaluation you can expect it to be very similar to an initial appoint with a psychiatrist/psychologist with the possibility of psychological testing being administered. If it is an evaluation for a physical examination you can expect the doctor to provide a cursory exam. Regardless it sounds like your carrier is setting your claim up to be limited to the applicable mental illness limitation in the policy (typically 24 months).     I should have mentioned earlier that I have a medical disability case pending in appeals.....and that the depression is secondary. Neither the previous judge nor the attorney has addressed this issue.

    Be also enrolled in one on one therapy with a counselor
    Be also enrolled in a group therapy session
    Be on several heavy duty medications also get a attorney also after your 1st denial letter contact your state senator and congressman and state representative even if u have a attorney do it
    Your lawmakers can help you with this
    Also you will be reviewed every 3 to 5 years so

    Is it true that as of March 23, 2017 it's nationwide from SSA that the claimant must be given 75 days notice before a hearing date is set, if the hearing is scheduled after May 21, 2017?

    I was denied LTD for post partum depression because it was ruled as a pre existing condition since it started before LTD coverage started. I gave birth 10/11/20 and starting care with a psychology 12/18 and with a psychiatrist on 1/20. LTD coverage started 1/25. Any case here for an appeal?

      Pre-existing condition denials can be very difficult to overcome if there was treatment during the “look back” period used in the policy, which is typically three months. If you were treating with a mental health professional prior to effective coverage date, then your case would be difficult to win. That being said, there is no harm or downside in you filing an appeal as to the applicability of the pre-existing condition provision.

      I have turned down all medicines they have ordered. I'm not taking muscle relaxers or psych meds for sleep. Which is what they offer me. But in reality i can't sleep with this shoulder injury, id rather not sleep than feel out of my mind

    Hello I have a question,I applied for short term disability and was approved
    My employer uses sedwick but with my employer, if a disability claim is approved by sedgwick my employer issues my disability payments.
    So once I was advised of my approval I called my employer to find out when I will be paid.HR then advised me that I was terminated . I asked why?????? And I was told that it was because I abandoned my job and I did a no call no show.I then told the HR manager that I did call them to let them know that I will be out of work and I was filing a STD claim and i was approved.
    She then stated that I was supposed to have called them (the employer) every single day untill my std claim was approved.
    Now I was not advised of that However , when I filed my claim originally sedgwick stated that they had informed my employer and there was nothing else I needed to do.
    Do you think I may have a case to sue my employer for wrongful termination especially since I was out on disability???........and to add to this my employer requested for me to send them a copy of my approval that sedgwick sent me

    I have a physical disability that has lead to a serious mental illness to where I think of suicide a lot and I keep getting denied I have 5 screws and a staple pin in the right ankle a plate and screw in left knee need a replacement knee and shoulder on the left side my neck and back is all screwed up as well I have lost movement in both legs and loss of feeling

      A daily symptom log could certainly prove important in the future. Ancillary information that builds upon and adds context to medical records is incredibly helpful in presenting a complete picture. In some instances Courts have cited to daily symptom logs as proof in support of disability that was the deciding factor in prevailing in court.

      @@lenoradennis5913 I use 5-HTP stress & mood by Natrol but I think like Nature's Way brand better, they're very cheap in Kroger. Im going get back on my Progesterone cream and coconut oil. Also they claim diet has a lot to do with helping depression so hopefully Im going to start this Mediterranean diet Sunday. ...Be Blessed

      I am stressing out because of this and I had an panic attack after he told me this. I did work for 8months because one of the associate at the firm told me it was ok to work . My doctor told me that I was not stable for work and up my meds. I have Mdd,anxiety,ptsd,phycosis, and insomania taking levorthyroxine . He did not information the judge all the information of all the doctors nor had any proof from me. I am sick I really need a Good Lawyer. He even told me after the hearing that I was indeed deny. But the judge didnt say a decision . And also told me he been in practice long enough that he pretty much know it is deny. I stressed beyond out.

      You will need to discuss with your SSDI attorney. We only handle disability claims under employer provided or private disability insurance policies and as such would not be able to properly advise you as it relates to Social Security disability.

    I'm 39 and only worked the past 4 years of my life because of clinical depression. I have tried so hard to hold down a job because I have 3 kids. Now I'm getting severe anxiety. I get home from work and cry until bedtime. I have ocd also and intrusive thoughts. Does working the past 4 yrs hurt me

      Preston Jones It is not uncommon for people to be hesitant to use prescribed medication, and it is certainly a personal decision. However, as a word of caution when dealing with disability insurance companies that it could be deemed as not complying with the appropriate care provisions of a disability insurance policy, or used as an argument by a disability carrier that a condition must not be severe if one is not taking medication to alleviate symptoms.

      +sir MAXX I too am not using Rx drugs but natural supplements which has worked for me better that the RX. SSA see seen where I haven't worked in 10+ yrs cause of my depression and yet they denied me again in 2014 which will be the second time at least this time they did have me to see physicarist who did advise me to start seeing someone, tried doing that but like Dell & Schaefer said they don't hear you but prescribe some dam meds that make you feel like you're going insane which I want be taking anymore of . Refiled last week. . Depression has manifest worst last 3yrs due to perimenopause. Look like Im struggling every other day to stay alive for the last 3 weeks but I know this journey want be much longer cause Im tired. Anyone interested Ive been taking 5-HTP Natures Way brand and St John Worts..Ladies the Vitex, Borage Seed Oil and Evening Primrose Oil has been helping with the hormones. Also Nican is good for Depression..Hope this helps someone.

    Pts from army, 12 + pysc. Hospitals, 20+ doctors, 12 or more types of meds, spanning 35 years, 3 different diagnosis, 4 suicide attempts, ok, they're welcome to check, I hate to say it but yes I have a mental disability, I have harm myself and others, not proud of that at all, received benefits since 2007, if I lost my benefits I would end it for myself real quick. I think the government realizes that people denied of this treatment will eventually backfire on them in ways that affect society, in the worst possible way. In no way would I harm anyone, but myself, so with that said , I feel I have a good reason to receive SSDI, plus my case was approved through the social security Administration, not a judge, in a 20 psychiatrist don't get the message after that many years they need to take up another profession they know a Disturbed individual when they see them.

    I thought Stephen had a lot of helpful information, without attacking the other side. Unfortunately Gregory is trying to pain the insurance company in a bad light to get more business i.e. call an attorney if they request an IME.. it’s not always to challenge the conditions, sometimes it’s to expedite specialist consultation and it is most of the time helpful for the claimant. The Examiner doesn’t work the insurance company, they’re not going to have biased opinion.
    There are test to asses the severity of mental health conditions, depression and anxiety and be objectively measured.
    It seems that Gregory has a notion of painting the disability insurance as the “bad guys” but how would people survive without benefits and who would pay the high premiums if all claims were approved.
    There’s always two sides to one story.

      Thank you for your comment. There are always two sides two a story, but when it comes to neuro psychological compulsory medical exams I see claimants that are being denied daily. Mental nervous disorder claims are denied more than any other claim filed with any disability insurance company. The disability insurance companies use the neuropsychological testing as a method to claim a claimant is malingering or exaggerating symptoms. There is a lot of subjectivity that goes into how the testing is administered and the doctor administering the test can manipulate the results based upon the manner in which the data is recorded. Not every case requires an attorney, but if the insurance company sets a claimant for a psych IME exam then they are questioning the disability of a claimant and a claimant should be concerned. The examiner hired by the disability insurance company does not work for the insurance company, but you may find it interesting to know that the doctors they hire usually do 95% of their work for insurance companies. These hired doctors have a bias to find in favor of insurance company or they may not receive future work. The disability company is not always the bad guy, but they are still multi-billion dollar companies that can easily take advantage of a disability claimant that is not represented. This week alone I have spoken with ten different people that were wrongfully denied mental nervous claims. It happens hundreds of times a month across the country.

      So what’s your motive for putting out videos such as this?
      Obviously you’re using fear mongering techniques to get more business. People should be aware of how frustrating and time consuming it can be to go to an attorney to help with their claim.
      It can 1+ years for a case to come to a resolution. If a case is won against the insurance company the lawyer takes a chunk of the money and the individual may be left with a very little amount.
      I always advise claimants to work with their adjuster and their doctors to go through the appeals process. Sure there are some cases that need representation, but majority can be resolved if the person goes through the appeals process and truly understands why the decision was made and what can be sent as an appeal.
      It would be more helpful if you could make videos about how to navigate through the insurance process and the health care industry rather than scaring people to come and use your services.
      Also I’d love it if you could cite your sources in regards to the stats you’ve provided about the doctors working with the insurance companies. That’s something that you’ve completely made up..

These videos have the dual purpose of educating claimants about the disability insurance process and as a method to market our services to potential claimants that want the help of a disability insurance attorney. You are correct that not every claim requires an attorney. On a daily basis we receive public comments and emails thanking us for the information they receive through our videos. We have many videos discussing the common issues as IME exams, interviews with insurance companies, drafting appeals, videos specific to each disability company and over 100 frequently asked question. When it comes to ERISA appeal for disability denials, most carriers only give a claimant one chance and if a claimant doesn't do a great job, then there is nothing a lawyer can do to supplement the administrative record once the appeal decision is final. I disagree that the majority of claimants are equipped to handle their own appeals and claimants are at a significant disadvantage when trying to take on their insurance company alone. Judges describe the behavior underlying Reliance's claims administration as "arbitrary," "blind," "conclusory," "extreme," "flawed," "fraught," "illogical," "inadequate," "inappropriate," "incomplete," "indifferent," "lax," "misguided," "opportunisti[c]," "precursory," "questionable," "remarkable," "selective," "self-serving," "skewed," "tainted," "troubling," "unfair," "unreasonable," and "unreliable."
      This court opinion was written by a Federal Judge in Mississippi. There are thousands of federal opinions discussing wrongful denials by disability insurance companies. Many of these denials could have been avoided if the claimants had a lawyer to assist with the appeal. The facts in my videos come for handling thousands of disability insurance claims and from a review of thousands of court decisions nationwide over the past 19 years.
