      Even if you tried to argue constructive dismissal, the bar for an employer creating a toxic work environment from a legal standpoint is quite difficult to prove.

      @@Xiacium1Wrong, it is the only way to ensure you get treated properly. No company with a strong HR department like these are will risk a frivolous complaint against an employee who stands up for themselves. I’m impressed with the company, lots are willing to talk dignity at work, this one has followed that. This line manager will either leave or adjust his ways, hopefully he has been assessed for his own benefit as the message and behaviour can also be a stress indicator.

      ​@@morganseppy5180 It's not showing your hand, it's putting g the company on warning, which the law always likes to see. By stating that you are expecting retaliation and letting the co.pany know you will not tolerate any such action, you now put the onus of watching and preventing constructive dismissal on the company. Prior to such a statement, the company can get away with saying "we were not aware there was an issue with such a tiny cog in the great machine." If you speak up, give them the heads up, and it happens anyway, not only is the retaliation case going to be open and shut for your lawyer, but you get to hit the company with a charge of professional negligence to boot.

      @@morganseppy5180 No, because at least in America that is retaliation and is heavily punished under the law. However, it is only retaliation if they are aware of your status as a whistle-blower or victim. If you cannot prove that they knew (as in america, the burden of proof is on the accuser), they can just claim it was an at-will firing. Most companies willing to do this will create a lot of fake paperwork to solidify this idea, too, so you need to get ahead of the ball and show that all this paperwork was drummed up to turn their own beauracracy (I can never spell this fucking word right) against them

      Sometimes a supervisor acting like a dick is a stress indicator, they need help. Sometimes a supervisor acting like a dick means they are a dick and need retraining, warning or dismissal. Why should you look for another job, unless you are the issue?

      @@SweetPea2022 Don’t you think having a little resilience is a good thing? Have you never had an issue you didn’t run away from? I bet you have, so why leave a job you like when it is someone else’s issue? What happens if this guy does something again and is dismissed, after all he’s had his written warning which is a final warning. What happens if he gets a grip and learns from it? I’ve had both, I’ve also had issues that have subtly carried on. It’s all part of living your life rather than a life where you get pushed around. I’ve never run from a problem at work, no one there is going to kill or injure you.

      @@gruffy4967 because we live in a system that usually rewards finding new jobs with better pay and advancement - at least in the West.
      Objectively speaking it often makes sense for people to chase this new meta rather than losing out, because it often rewards them more than being loyal to a badly run company
      Hoping for change that the company is not incentivised to fix is wishful thinking - better to cut your losses than waste your time and sanity (a much more expensive commodity) at a badly run company. Especially if you are a nobody in the hierarchy.
      It's not running away, it's walking away from a problem that has nothing to do with you, and won't be fixed by you, nor their HR (whose only interest is protecting the higher ups).
      You usually have so much choice today that willingly staying in a shitty work environment and bad company culture is on you. Nor do you want to be in one where grudges are held against you and said boss plays passive aggressive instead to get away with it and stay on the final warning.

      In this case they are protecting the company from a lawsuit so you are correct yes, they are not protecting her, but his indications could be breaking the law and causing the company a lot of money on fines and lawsuits!

      Based on just getting a "formal warning" the manger must lick a lot of bag of the managers above him.

    I must admit that I am rather stunned that HR actually took action on this against the manager. So often, they subtly come down on the employee instead.

    I know it wouldn't have helped their mental health or workplace confidence. But I would have kind of liked Mark to come back a final time like, are you serious?! why did you do that?! and literally get the boot 😅 I loved his reaction in part 2 when he was like no don't do that, panic mode, call-call-call 😂

    In Debenhams, this used to be rife and HR would refuse to do anything if the accused was a senior member of staff. My now wife, who was subject to bullying and racism, was told to try buying cakes and doughnuts for the team when she raises her concerns.

      Not where I work. If you get a formal warning, you don't get a raise or a bonus if they're offered for the entire year. We take that stuff seriously and only use it as a last resort before firing someone.

      Not at my work. It goes into a file and when promotions and bonuses come up they use it as an opportunity to deny both. You have to get two years of no further marks to start getting into the running again.

      I had a colleague who got one years ago and every time she applied to another position within the company she is dropped from consideration or ignored completely.

      That being said my boss is great so I have no complaints but if I did there would only be the option of getting rid of one of us,

We have seven(?) protected classes, and common decency is never mentioned. Toxic workplaces are only actionable if they are egregious, like many documented interactions. And the lawyers are rational and don't see the profit in helping you when there are easier cases to win. We don't have labor boards; there is no one to turn to.

      ​@@qwazxwas Actually you could sue for that in America too, despite what many people believe the U.S. has many worker rights.
      People mistake At will for having no rights but this simply isn't true.
      If the boss retaliates then all you have to do is continue making a paper trail and email HR with any and all retaliation attempts to show a hostile work environment.
      Judges and juries are not dumb and proving retaliation is easier than most people think so long as you take the necessary steps to create a paper trail.

    A formal warning? Pathetic!! He was responsible for a toxic workplace and abusing authority. Fire him, otherwise he will stay and treat that employee even worse until they quit anyway. HR is so weak with any level of management.

      Fire the line manager? This example is not gross misconduct or criminal. If this was the first occasion, that would be ridiculous and highly likely against policy, but definitely contrary to contractual law and employment legislation.
      Firing someone for a first offence definitely would mean it was a toxic company.

    Ya, this won't end well. Unless they fired him, he'll make their life hell now. I was a team leader and the labeling for the machines and checks took at least 5mins. The product run in all was 2mins. This ended with me being dragged in the office by a new manager after Checks weren't being carried out to spec. I explained it was Mission Impossible. Also, bear in mind a wrong check could cost the company up to ₤500,000. I had to do a product run on their schedule in 2mins, when they knew labelling took at least 5mins. So 7mins in total at least. I quit a few weeks later.
    This company also gave us a CREAM CAKE when I did over ₤50,000+ in production a day.

    At the largest bank in America they would "manage out" the problem people...all the while having HR "take the employees concerns very seriously "
    The moment this happens you simply demand MONEY and the boss's expulsion. Then you leave.. you are NEVER being promoted. I finally got my promotion and then learned how it worked and promptly quit. HR protects the company..they work in tandem with management..don't be fooled.

    Formal warning does nothing. Just like getting a warning for a speeding ticket. Driver knows he can do it without serious consequences. This guy is still going to treat people like crap and may even retaliate against Rebecca.

      It may or may not do anything directly at that time to stop someone, but it does document the situation, which is very important for any future issues that may take place.

    I work for an organization that its management acts exactly like Mark. The difference is that they phone you or speak to you in person. Never anything on paper or any digital trail, that can be kept by the employee. Then later they cookup any story they want about you, generate the "paperwork" with lies and submits it to HR. HR then does a "fact finding" or "inquiry" and it nearly always ends up with them firing the employee that management targeted. It's your word against managers that are considered beyond reproach.
    Its cutthroat, anxiety ridden and stressfulAF. 😢

    In my experience, bosses like this never learn. The bulk of horrible bosses I've had were the owners of a small business, so there was no HR to talk to. And the places where there was HR never saw things my way.

    I find it so odd that these more often than not end with a simple warning. Heck ive seen some say things like "hes got a track record with this kind of behavior in the past" to then be "so we gave him a warning". Feels like a normal employee makes very few or super minor mistakes and get the boot while managers/supervisors seem to be able to get away with so much.
    I know its a much harder and longer process to replace a more senior position, but i just find it crazy how secure some of those positions seems.

      @notroll1279 the HR or Personnel department works only to save the company not the people. They sanctioned the manager because if this case went external and got to court or tribunal the company would be screwed.

    HRs job is to protect the company. Usually when you complain, even if they discipline the other person, their goal will be to get rid of the complainer. In general, if things are bad enough that you need to go to HR, you may as well just find a new job.

    The issue is how are managers not informed and trained on how to manage staff. It’s really not that difficult. Treat people as you wish to be treated.

    HR's response was weaksauce as always. Her supervisor will now take it under advisement that she reported him to HR and will always be looking through her work for the slightest little detail to to have her fired. Either that or he'll drown her in work until she cant keep up and then he'll use that as an excuse to have her fired. Going to HR is always one of the worst things you can do, at least in an American company.

    I don’t think One should ever threaten to resign because that could back you into a corner. If someone else is acting wrong. Just leave it blank. Tell HR to take care of it.

    People often say "Don't go to HR, they work for the company not you!" Yeah, but they likely don't work for your direct supervisor either. If their supervisors behavior is putting the company at risk, they will normally can him. Just don't notice because people rarely go viral for tiktoks about problems that were promptly responded to and properly resolved.
    Carefully pick your battles, but once you've picked them don't be scared to talk to HR (in writing)

    90% of staff would just leave most experience hr as damage limitation for management and are never the employees friend

    Where was the technology when I was younger and had issues with bosses. If we had evidence like this, a lot of companies would change management every month. Especially in the hotel industry

    In Tennessee you would be fired for starting trouble in a right to work state you can be fired for anything if they don't like you or they don't like what you have on or like me I got cancer treatment took a year so there's no way in our state you can ever move ahead or complain.
