Why does his line not dip down and go through 1867, 1876 and Section 6, before going back up to 1982 and Section 35? In other words, how is Section 6 of the Indian Act (1876) invalidated today? Is it because the IA violates the spirit of the Treaty of Niagara? I suppose this is why he says to the audience, who I presume consists of many indigenous individuals, that it is "up to you..."
Re-listening and answering my own question, along with info from other places: The IA's intent was to get rid of the self-identification of indigenous peoples as members of their various nations. An outside bureaucrat in Gatineau cannot legitimately determine who is and is not a member of a separate, sovereign nation (nations whose sovereignty was recognized in 1764). It is the sovereign nations who determine who their own members are. Provisions in the IA, for example, reduced the status of indigenous women (who previously held great importance, for example in matriarchical nations) to chattel among chattel and exterminated their "Indian" status if they married outside their community. "We have not defined what our treaty freedoms are." On re-listening, I realize Chief(?) Derek Nepinak covers a lot of ground in these few minutes.

Because the 1700s is when first fleet of whites here were brought here as slaves on steam boats and squatted on the land, so if there was a clear mistake on who were actual Indians at and who were living among or near by Indians the time, then that clearly needs to be addressed.
