    Hey everybody, my name is Barry Zlotowicz. Welcome to the LawFull Channel. On this channel. Today I’m here with immigration attorney Alen Takhsh to talk about traveling while you’re here on a green card. To learn more about Alen, check out his website at www.takhshlaw.com/.
    First Alen tells us what it means to have a green card. It means that you are a legal permanent resident of the United States.
    There are two types of green cards, one is a conditional green card and the other is a permanent or non-conditional green card. The conditional green card means that you can stay in the United States for two years. The permanent green card is good for ten years.
    So if you’re in the United States on a green card and you want to travel outside the United States, there are rules that you have to follow especially if you’re going to spend more than 6 months outside the country.
    If you spend five months and 29 days abroad, then, generally speaking, you can return to the U.S. without having jeopardized your LPR status. However, if you spend anywhere from six months and one day up to 11 months and 29 days abroad, then that raises a rebuttable presumption that you have abandoned your legal permanent residence. In other words, the government will presume that you no longer wish to be a Green Card holder. However, that presumption is rebuttable, meaning you can present evidence to show that you never intended to abandon your permanent residency.
    Now if you spend even a single day over 12 months abroad, then you will be presumed to have abandoned your LPR status, i.e. with no opportunity to rebut that presumption. Meaning, your green card is dead.
    People who are in the US are hoping to become a naturalized citizen. So if someone is here on a green card and they travel abroad, the travel could have an impact on your efforts to become a citizen.
    This applies mainly to the time requirement - meaning you have to meet a continuous residence criteria and the physical presence criteria.
    In other words, any time spent abroad cannot, except in limited circumstances, be counted toward the required number of days in the U.S. for purposes of filing for U.S. Citizenship. Generally, in order to become a Citizen, one must have spent at least half of the last 60 months (five years) in the U.S. - or 36 months (three years) if married to a U.S. Citizen. Time spent abroad may disrupt the “continuous residence” and “physical presence” requirements.
    The best way to avoid being deemed to have abandoned one’s LPR status is to apply for a re-entry permit by filing Form I-131. You must file for the re-entry permit while in the U.S. This will allow you to spend up to two years abroad without abandoning your legal permanent residence in the U.S.

    Hello I traveled every year for christmas on my green card I went to the carribean when I lived in NYC. I knew i was not supposed to stay away for 6 months I had no problem have a great day

    My another comment is in regards to COVID era. There was time no flights were available because of lock down. So absence more than 6 months jeopardize Citizenship application or there is waiver from USCIS?

    Reentry pass takes a long time to be approved and sometimes not available till time to return back!

    I was in Canada for exactly 180 days and returned to the US on a Permanent Resident card. I was advised not to exceed 180 days. The customs officer immediately allowed me entry into the US with no difficulties.

      This is exactly what sucks about immigration law. So many things are just in a gray area with not concrete law behind it. I have friends who have stayed outside the US for more than 6 months per year. They have visited the US for 2 week, 3 week etc periods every once in a while. They were never questioned too hard. Just let back in. But all these advice videos makes you think you'll get thrown out of the country if you talk to the wrong officer. Hard to know what to believe.

      @@8rk You can come back to US within one year of your departure. But the residency time you have accumulated prior to departure will be lost. If you plan to stay out of US for more than an year, you should take reentry permit. Permanent Resident means you're going to be staying permanently in USA for purpose of your living and occupation. There are circumstances when you have to leave. Also if you get job or have business overseas. But keeping ties to the US is important to maintain your LPR status.

      @@abbas.30 As of April 26, 2022, lawful permanent residents of the U.S. must show the following documents for all methods of travel to Canada: a valid passport from their country of nationality (or an equivalent acceptable travel document) and. a valid green card (or equivalent valid proof of status in the United States)

    Hi, I'm currently on a trip for 6 months August - Feb. (5 months and a day before the 6 month period to be exact) and I'm planning to stay for 1-2 more months (so 7-8 months overall if possible). I'm a permanent resident in the US and already completed my 5 year statutory in 2020. I'm planning to apply for my citizenship when I get back to the US this year. My question is, will my 5 year period reset back to 0 and have to redo my 5 years before I can apply for my citizenship again?
    I have proof that I'm still a resident and I've been and still living in the same house for 5-6 years, have a US bank account, drivers license and will pay my tax when W2 becomes available. Please advise.

    Yes I travelled outside of US leaving November 2019. My mother was I'll and
    Placed in a care home. I wanted to spend time with her as she was 92. She died and there was the funeral and sorting out her home. I travelled to Spain to see my brother and travel a bit. I went straight into the strictest lockdown around at the time in Spain.
    We weren't allowed to leave the house except to go to the nearest store. Airports were closed etc. i couldn't travel either through airports and airplanes with asthma/COPD immune issues either. I wasn't allowed and when I heard I was allowed I booked a flight and tried to return and was refused at the airport. I tried at the consulate but they were all closed except for special and urgent cases.
    I was only 19 days past a year by this time. Now it's 2022. My green card is dead! I am still married and I have a daughter and niece and family there. My bank account is there. Everything is as I left it but I can't get on a plane.

      Omg! Did you try to get an attorney? I heard that if it’s a covid related reason, they were waiving. Hope you can get your residency back!

      @@valeriecuan4189 you have a very valid reason. I’d try another attorney and scale this up in the justice system. You were literally unable to come back, you have valid reasons to be outside the US. Did you keep working for an US company (even remotely)? Did you keep filing taxes to the US?

      @@Antoniocastagnoli r u an attorney? Do you know America? They don't care what the reason is if you stay out of the country for more than a year you are not let on the plane. If you manage to get to a border then you will be taken to a room for a three hour interrogation. I know someone who went through the same and was told you can go to a cell until u get a court date!! How long noone knows.

    They forgot to mention one very important thing. Green card being dead is only to the USCIS side. IRS will still consider you a permanent resident for tax purposes unless you officially withdraw your residency by application. So just because you have been outside US more that a year doesn't mean you are off the hook.

      It's written on the SS web sites. I do my own research. Now I wonder why theirs isn't being taxed. Are they collecting yet?

    Does it matter which country abroad they are visiting? For example, my wife is planning to immigrate to the U.S. from Canada. She is a naturally born Canadian citizen. If she decides to visit her family in Canada, or Ethiopia (her parents birth place) will that affect her if the duration of her visit does not exceed 6 months?

      How are you All ? Pls advise .My mother was granted a 10 year green card ,,and she càme to Ethiopia,,while preparing to immediately go after a month she got totally sick and hospitalized in ,and out for many years.This situation hasn't enabled her to come /be on plane and just come. It has been almost 5 years now. The thing is now she feels better,, afraid to come as she stays more than six months .       Bad idea.
      Don't leave the US again before 2022.
      Those 3-5 months you planning to go soon, forget it. you go next year.
      You wanna have at least 180 days in the US of each calendar year.

    Hi , Actually I was arrested for domestic battery 243e1 in California. During case my lawyer negotiated with DA and DA amended my charge and reduce and give me deal for pc415 (1) I accepted nolo contendere for pc415 . Judge give me 1 year to complete 40 hours community service and 12 hours anger management after that case will be dismissed. So my hearing set on this July 2023 . So my question is case is still open can I travel internationally before complete my case . Will be any issue when I will come come USA At airport with poe.

      Kindly avoid travel in your situation to be on safer side. Once you have your permanent card with out any restrictions, then you can travel and return safely.

    I have a green card. What’s the rule if I decide to go for 2-year graduate program outside of the US? I mean… I’d definitely live outside of the United States for over than 1 year. Of course, I’d still be able to return to visit the US, but, in this case, I wouldn’t be living here. How does it work in those situations?

      My case started since 2014 when I was coming from Abroad and found that I have used a different name for asylum and never follow up since 1995. I got my feet card through Diversity lottery and granted in 1996.

    What ? If I holding a green card and stayed more than two years outside USA as my mother was a dementia patient and I was taking care of her during Covid travel restrictions plus more health issues of my daughter.

    Hello,l want to know,what stage my Green Card is.l usely left USA for only two or three weeks,but now I retired last year.l got my Green Card since 1982 and started working since 1982,I just retired last year 2022 in January. I called the Immigration before,because when l came back to USA,the Custom told me that I need a new picture,so I call the Immigration here in USA,they told me no,If I put a new picture,my Green Card will limit,Example,2yrs or 5 yrs,then I have to renew it every two years or five years,but I’m fine because there is no limit on mine and keep on using it. The customs problems is because my picture is younger then now I’m older. Like they told me that my Green Card is not limit..Please let me know because I’m going on a trip soon..Thank you.

    I'm a new green card holder and I went home in November 2020, my country's borders ate closed so one has to apply for exemption to fly in and out. I now back in the us. No fuss,just stay under 6 months. People abuse their status and that is why things gets messed up. Don't abandon your status..

    Hello sir,im a Filipino,ive been here eight years now,i want to apply for US citizenship,but due to this COVID 19,i cannot,ive been here since January 21,2012... and i was five years staying here last year 2017,then i took a vacation to our country last Oct.1,2017, then return to the US April 6,2018...which was six months,can i still take another vacation this year 2020?     My dear, I applied for naturalization on Oct 03 2019, during 2014, I was outside of the USA for family obligation (1 year and 10 days) but I had Reentry permit during that time. UCSIS is asking evidence that I did not abandonment my US residence for that period but I don’t understand why they are asking for it since I had Reentry permit.

      Hello, I have no idea to be honest. Perhaps go to the US Embassy? Call or file a complaint with the Better Business Bureau here in the states? If you know what state he is in you can complain to that state's chamber of commerce perhaps???

      Hey when you went to Philippines for 5 months and came back did you have any problem at customs at the airport? Did they question you or did they let you in easily because it was under the 6 months mark?
