Re: strict liability of proprietors of building How do we factor in the fact that the building is leased. Does it affect the liability of building owner, when the person actually uses and maintains the building is the lessee? Pwede bang defense yun to escape the liability?
If the building is poorly maintained, it's the liability of the lessor or owner. In a contract of lease, it is the lessor who is liable to make necessary repairs. The exception is when the lessor and lessee agreed in the contract that it is the lessee who will assume the necessary repairs.

atty. clarification. in intentional act in criminal law there must be freedom, intelligence, and intent for one to be liable. while in criminal negligence, one is lost. there is freedom, intelligence, but the intent is lacking substituted by negligence. so criminal negligence is not intentional and thus 365 RPC may come in. so no intent can be appreciated in criminal negligence. right atty? timestamp at 12:40 of the video for referrence atty.
