7:30 what is the islamic logic behind this? If your father is dead while your grandfather is still alive, you are not supposed to be the heir in property.
    Can anyone explain?

    • @thisismeagain86

As the Maxim goes, "There are two parts of Sharia, the law for everything and the law for Bequest", The Simple explanation and an extremely condensed version is this.
In normal situations, The Inheritance is by direct heirs only. The Inheritance is on the wealth accumulated by a living person while he/she was alive, to be inherited on their death by their direct heirs.
e.g. If The wealth of my grand-father cannot inherited and acquired and be in the ownership of my father during my father's life if my father dies before the death of my grand-father, therefore i cannot inherit from that wealth.
However Islam allows people leave on 1/3rd of their property so they may Explicitly bequest anything from 1/3rd of their wealth to anyone, including their grandchildren, or a charity trust or some random person. but this has to be done consciously.
The purpose for this is to not create animosity between direct heirs against the indirect heirs. incase a person did not explicitly stipulate his/her will on the 1/3rd property that they had leave by Allah for bequest.
Hope this clarifies the matter for you and as is always said in matters of Sharia .. of everything that is True from what I said those are from the commands Allah, the Exalted. if there is any mistake in what I say that mistake is my own and by my own limitations and from my own faults and Allah knows best

One matter that the the Advocate Rafaqat did not mention, and i'm sure this was not deliberate but a consiquence of the short video format, that daughters have half a share of the man because the women in Islam have no legal or financial obligation towards the upkeep of the household, the obligation falls on the men even if the women are wealthier. So the sisters are to be provided for their upkeep by the brother(S) who take up the mantle of "head of household". same is the case for mothers .
And where men are delinquent in fulfilling their obligation , women have the right to legal recourse. That is Islamic law, unfortunately (and I say this with a heavy heart) The issue of Pakistan is not of Law enactment, but of Law enforcement and the judicial mechanism and corruption.

and the most important matter these days are that sons and brothers are not willing to give even half legal share to women the logic they gave is you will get it from your husband which is false if a women doesn't have any son then this property goes to siblings of deceased husband not to the women or her daughters secondily in case of haq mehr they tried that women take khula so she have to give up the haq mehr to seek seperation which is nothing but manipulation

    • @asmasiddiqi1
      @asmasiddiqi1 2 роки тому

@@exquisitenature9321 That is so true. All the arguments for not giving women their share in inheritance are meant to deprive women of economic security so that women continue to silently serve the male members of their families and accept the abuse they are subjected to. It is unfortunate that mothers support their sons and other male family members instead of fighting for the rights of their daughters. Media productions don't discuss this problem at all. The only television play which has addressed the issue of women's inheritance is "Ullu baraye farokht nahin".

@@asmasiddiqi1 sad reality of pakistani law i think in west they don't discrimnate on the basis of gender religion and ethinicity wether you are a woman or a men nobody can take you share which is equal there is no repercussions for males only female gets manipulated in the name of religion. In pakistan you are lucky if you got good male members that don't deprive you of your legal right otherwise your life would suck a women should get more support from the law because she is the only one who would take care of her kids while male enjoy all the priviliges procreate and leave no justice will ever be served

My cousin Yasmeen possessed my mother's flat and possessions on her death in 2019. I live in UK. My mother had suffered a stroke few months before her death. She was invalid. Mum was a widow. I am the only child. Mum's niece Yasmeen induced mother to handover her jewellery in the bank locker and bank balance. Mother didn't write a will. Yasmeen claimed mother's bank balance using her ID card and death certificate to claim it. I messaged Yasmeen on messenger to hand over my mum's jewellery and bank balance to me. But she refused. I told her I would take legal action. She threatened with counter action. What should I do ?

You are a confused guy. Womens share in property is half yes but this share is her and only hers. On the other hand the male brother is supposed to take care of her sister if she is not married. He is to take care of her if she gets divorce from her husband. He is responsible for taking care of parents as well. There are too many responsibilities for him that is the reason he was given double the share. However, with such kind of responsibilities the share looks as good as 20% for his own use. Most of the time the remaining gets used in taking care of his responsibilities as a Muslim. You are very very confused guy.
Moreover, yes Women is not allowed to marry more than one husband at a time. Its true. The wisdom in it is that the how would the child know about his father then if there are more than one husbands. Moreover, sexually transmitted disease do not happen in case with a single male. Aids can also be transmitted if women having more than one man. U know.
      You are very confused.
There is wisdom in everything u just need to see it.

Unfortunately it's true, that in Pakistan , the Sharia is limited to personal law and family law and Islam is barred out from all other areas of legislation, even thought he constitution states that "Any law repugnant to Quran and Sunnah , shall not be passed" or words to that effect. However Riba is legal in Pakistan and the Pakistani Economy , when Allah said
"O you who believe, fear Allah and give up what still remains of ribā, if you are believers. But if you do not (give it up), then listen to the declaration of war from Allah and His Messenger. However, If you repent, yours is your principal. Neither wrong, nor be wronged." [Al Baqarah : 278-279]
