Employers do illegal things all the time....because they work most of the time.
If they can intimidate 90% of employees from suing, their average cost per issue is minimized.

Problem with the case ; plaintiff went back and put himself in the position literally. I'm thinking that the plaintiff was interested but backed out at the last minute. This could be looked at as a set up for a lawsuit.
A think a valid response arises from the physiology of sex organs (involuntary) and psychosomatic affect and primal inability to totally separate sex from personal conduct.

Overt sexual advances that have occurred for the first time especially create a surge of hormones associated with a fear response.
Men report depictions of this response was found to be viewing porn (for the first time) (found thru sex addictions counseling) while some women (stat sig ?) have described this in first sexual encounters, unfortunately many appear non consensually in childhood.

He was curious, okay. He could’ve also been in denial and trying to downplay it to himself.. because the initial contacts probably triggered some overthinking and “what do I do” which is understandable.
But any reasonable person understands that this is an uncomfortable situation, and as a manager, he does have the responsibility to use BETTER judgement.

If the employer is aware of a felony, they would be required to report it to law enforcement or to any gov. official. They cannot intentionally conceal a felony crime.
