    Love this. Any serious injury cases ived settled were always the following: (1) well respected mediator that the parties agreed upon to conduct private mediation; (2) lunch was always provided; (3) the mediator strongly advised the parties not speak before caucus (note: the mediation was at a point where all discovery was done and dispositive motions were are pending or all denied; and (4) the mediator allowed the attorneys conduct the s caucus and negotiations the way the attorneys wanted to (this is all for serious personal injury cases)

    EEOC mediator in pittsburgh was freelance, very nice but did nothing to help. I did learn that Def accommodated others so that was key, but not me.

      PghCHR did a great job investigating. Hopefully the mediator in my case follows up and gets it right.

    From Toronto Canada on my mediation my lawyer didn't started high amount and sold me out for 18k all he was talking about was about my safety violations at work he wasn't prepared, cause we never spoke 1and 1, he told me take it that's it done push it cause I won't win in court but after deposition he told me he will put higher amount on a lawsuit but on mediation was over in 1 hours he was gone very fast that's after years working for the company second employer and I was there 12 years and I was on EI what should I do? Good mediation but unprofessional lawyer

    Thank you Vince. I am in Whistleblower retaliation/FMLA interference retaliation litigation with my previous employer. I work in health care and refused a directive to violate the Medicare Conditions of Participation. My case was filed in State Court in December 2021 and the defendant had it moved to Federal Court. We sent our discovery in September 2022. The defense immediately asked for more time to complete their discovery and the deadlines have been extended. I was supposed to be in a deposition in October 2022 and the defense canceled that too. The mediation report is supposed to be in to the judge by the beginning of May. Question, can you do a video on what to expect in a Whistleblower retaliation deposition? Also, any thoughts on why the defense delayed their discovery after we sent ours? They also wanted me to sign a confidentiality agreement before they send discovery. My attorney is willing to sign only the HIPPA portion of the confidentiality agreement. He said he thinks the defense does not want us to report the bad acts to Medicare. Thank you, I enjoy your videos and gain much knowledge from them.

    I wish i would have seen this video 6 weeks ago before my mediation. My mediator was a bully. I walked away from the mediation. He had the nerve to have the mediation via zoom and he was on a beach with palm trees swaying in his background leaving on us on hold an hour at a time. He recently re-contacted my attorney and I'm not interested in dealing with him at all.

      This is shocking to me as a mediator, but probably shouldn't be. All mediators are different, plesse don't allow this experience to dissuade you from at least considering mediation in the future.

    Great information. If mandatory mediation and mandatory conciliation are the same thing, why is mediation offered before the investigation and the conciliation during or after the investigation?

Wanted to ask you how do you determine what the settlement will be for misclassifing and employees as an independent contractor. but what is the settlement calculation for misclassifying an employee? How do they come up with a settlement? I guess it is what I'm trying to say. Thanks 😊

    Is it employer's statement on why I was terminated considered confidential because it was presented during mediation? There's nothing confidential in the statement. There's pretext and and false.
    Explanations explanations, can I? Show someone the the statement I received.Or inot allowed

    i didnt agree with the mediator first offer.. I let lawyer know and she left my case and said my case and worth going to trail, but i thought as a client i could negotiate from the first offer?

    This attorney uses simple words which makes his sentences understandable. However, by the time I finish his video, I still don’t understand what he’s trying to drive at. It feels like riding a Ferris wheel… my head spins! For example, this video is titled, “What Do I Expect from a Bad Mediator.” He jumps from one topic to another, and talks about irrelevant stuff. Is he really an attorney? It looks like he’s just sitting in front of the camera to release stress and try to look cute, which he is not!

      Basically, how do you know if it's a good or bad investigator and how do you handle a bad one?

    I have a question, if both parties agree to mediate but it’s scheduled 3 months from now, is there anyway to negotiate prior to mediation without a lawyer?

      Don't do it. They will eat you alive unless you've done your research in full extent.

    So what would you do if in divorce the attorney I hired who embezzled 60 thousand from me put in docket a mediation was held and there was NO mediation. Do I make a police report? (Fraud on court. What else?

      Sorry, I am only an employment attorney. But if an attorney embezzled from you I would contact your State's BAR association as soon as possible and contact law enforcement authorities as well.
