      Posted a vacation video with a song on Facebook. Within 1 minute got a reply that the song had copyrights, and 197 countries would not hear the music.
      STUPID !!! It is a post not a sell point for $$$$$.
      I have a MPC and create music, so I used one of mine, but still I rather used my first selection.

      "Bull" is when you can create something (like a song) that is easily recognizable in pop culture and appears all over the place, used to hustle ads or to popularize other people's content and you can't control it nor get any significant financial restitution. UA-cam runs these filters not to benefit any music or artist, but to make sure they themselves can get maximum dollar for its usage..

      ASCAP and BMI have entire teams dedicated to this. They'll get back to you. It's not like you're emailing a Very Famous Person and they are the ones giving permission--they don't even have that right on their own.

    If copyright is so damned important, why isn't the process to request the ability to use a licensed work made super simple? Wouldn't that promote increased respect for copyright as a whole? The current structure of copyright seems to be counter-productive to itself. Not to mention the ungodly court costs I assume are involved in suing someone for infringement!

      LilKing420s you make a good point. It’s a complex system that was devised long before most people had access to the means of production (or reproduction)... new technologies have made copying so simple, it’s natural to expect every aspect of life to be simple. Sadly, that’s not the case.
      While it’s easy to break the law, and somewhat difficult to get caught, following the law is REQUIRED. The consequences when you get caught (eventually, you will) are quite dire. Costs incurred by a successful plaintiff get shifted to the defendant... so cost isn’t often a deterrent.

      @@woabeatz9717 Lawyers who do this kind of litigation generally charge on an hourly basis,. Rates probably start at around $300/hr and rise as high as $1000/hr. depending on the lawyer's level of experience, specialization, and city\. Since copyright litigation can take years to reach resolution, it's not unusual for total fees for a copyright case to reach 6-figures, and even into 7 figures. It's increasingly rare for such cases to be handled on contingency basis.

      I got a copyright strike on a 20 SECOND edit. The second video I had ever posted. If YT is punishing me for not giving proper license credits, then at least TEACH ME crediting, to make sure I don't do it again.

    I have a question that is not related to this content. sometimes I watch other Shorts using the original music BUT the sounds are not the same as the Original music should be, I take the "Can you feel my heart" song as an example. When other Shorts playing the part of a Original music and start playing "Can you hear the silence?
    Can you see the dark?
    Can you fix the broken?
    Can you feel my heart?" Then the music plays the Theme of the song with little low deep, so I tried the same thing but it goes the same thing without the low deep in the theme. like why I can't make the same music and how they make it? there is no features to make it.

      Some music is licensed for such uses by the platforms. But I'm not sure what you're experiencing... sorry i can't be more help.

    I've tried this so many times, it never works. Every website dedicated to it costs like, half of my weekly budget for one song. To be honest, I'll probably stop making videos because of fing copyright claims. Even my own songs have been removed from my channel. I'm just so damn tired of it.

    i finally found the place to contact them, but when i was filling up the details, it asked for what state am i and the zip code, but the only states to choose from are all states of America, even tho im a filipino, but i cant complete the form because tge only choices in there was all from america and i dont even live in america, thats why i couldn't do it :(

    Just I looked up the music i was looking for. It would cost around 1200.00 for the licence, for one song on my anniversary video. No wonder most just steal it.

      IF you can show it is personal use only you can probably get a much better quote. Stealing is not the solution. Go about it the right way is.. If yo like the piece so much you want to integrate it in a piece of media you are creating you still have to do the right thing.

    Question: I want to use “ Pachelbel's Canon in D “ - that I will play and record on my keyboard.
    Google said “ Pachelbel died in 1706, long before copyright existed in its modern form, and so the composition is most definitely in the public domain. This means that if you can get an orchestra together, you can perform Pachelbel's Canon in D major without having to get permission from Pachelbel's heirs, estate or agents.”
    So, do I consider Google search as legitimate under the law that I can use that song for free?
    Where to ask You Tube owners if this is true? I suppose they do not have a phone or email?

      A lot of performers are playing classical music and posting it on UA-cam. I don't think you have any problem with doing this. If its in the public domain then you shouldn't get any copyright strikes.

      @@slanderxtezz I've not found a solution other than disputing the claim each time. Also at times my dispute has then been dismissed and the claim has been reinstated and then I have to appeal their decision. It's a whole lot of work!
      One tip I've learned is; save your license or proof of permission for use to google drive and link it in your submission when disputing claims.

    Royalty free music can be a good option, but real commercial music that people recognize really helps boost your work to the next level. Too bad the process is so needlessly difficult and expensive.

    Hi 👋 I have two copy right claims one is just that and the second one is partially blocked in Denmark from what I heard is some UA-cam videos are blocked in Denmark. I honestly didn’t know about this until I saw it because I thought by covering a song on an instrument won’t do that can you still get permission even tho it’s a copyright claim that’s my question.

      Curiosity, here... how do you propose to change copyright laws to accommodate the 21st Century? Remember, you've got to incentivize the creation of works... not just make everything free for anyone to use.
      So, how would you protect the Songwriter, Recording Artist, Publisher, Record Label and everyone else, including the person or business who wants to use the material?

    Personally I always thought it was ridiculous to make a big deal out of using songs for your videos, I mean if you're getting paid by UA-cam for using the content that's a different story but I shouldn't have to go through so much trouble just to use a song for a good video.     Intricate! I often just want to post a song to reflect on how I'm feeling. The publicity incurred should be royalty enough. I don't post for-profit and songs often songs forgotten excite people to remember. Times change...I believe we no choice but to adapt.

      Edward Tamsi maybe you should adapt to the idea that musicians, songwriters etc have a right to be paid when their work gets used. I’m fact they have a right to decide who gets to use it at all.

      Yes you could get permision for the whole album. But sometimes different songs on the same album can be owned by different people.

I'm fine with that because I live in, and posted from, a country that is not on the list. Do I need to respond? And if so, where? Or can I just let it ride? Thanx, TVW

      James Lau it can cost from $0 to tens of thousands. It really depends on the song and how it’s being used. Many songs are now pre-licensed for some uses on YT. Check the index of cover songs.

    This video is almost 3 years old and there's almost 300 comments so I'm sorry if I'm asking a repeat question. I've got some parodies that I've written (more in progress.) Is this pretty much the same process I need to go through to publish them? I plan on recording and editing myself and going no farther than Facebook and/or UA-cam with it. It's something I'm doing for fun and do not plan to make any money on but I want to be covered just in case anything happens.

    When you say publisher, are you talking about the company through which an album or song was released? For example; Avenged Sevenfold makes an album then releases it through Warner Records, would I have to contact Warner Records to get a proper license to use their songs in my videos?
    Let's say I wanted to use their songs in most of, if not all of, my videos in the future. How would I go about asking for a contract like that? How do I make sure I'm not being screwed over?
    What happens when my license (the contract) runs out, will my videos get copyrighted or does the license apply to videos released under a certain time period / amount of videos which is stated in the contract?
    Edit to cram in another question: If a band makes a demo for a song but doesn't release it to the public yet it is found years later by fans, who should I contact for a license then?

    Hey, thanks for the video. It answered a lot of questions.
    I am running into a problem though. I contacted the songwriters, and they're both under the same publisher. Fortunately the publisher is owned by the head songwriter. But it also looks like the "master" is owned by Water Tower Music, a much larger company. I don't know what a song "master" is.
    The songwriter's information is listed on BMI, but Water Tower's is not. I also couldn't find their contact information anywhere.
    Do I need permission from the company that owns the master as well?

    Does it also cover musical scores from movies like the Star Wars original trilogy? I have over a dozen videos of myself playing Star Wars Jedi Knight II: Jedi Outcast, which makes heavy use of the original trilogy score, mostly when I fight enemies within that game. I actually emailed UMG (which owns the Star Wars score) twice about the matter.

    I know I’m late but how exactly do you contact an owner, like let’s say I want to use part of an Iron Maiden song in a film and put it on tubi, would I just email them or something?

      You’d contact both the record label and the publisher of the composition. Many now have online license request forms. But some still require a written request. They’ll want lots of details about how it’s being used, what’s happening on screen, how long the clip to be used is, etc.

    My situation is slightly different. I make music videos for the band Liliac.. They are independent and own the copyright to their own music. They tell their fans to use and share their music as a way of helping to promote them. When I upload a video, UA-cam says (It's copyrighted, but the owner allows their content to be used on UA-cam) I still get a claim however. I will be seeing them and have a backstage pass to meet them at the end of the month.. My actual question is, When I ask for specific permission (in order to remove the copyright claims) how is that permission submitted to UA-cam? What is the actual physical step(s) needed by me or the band, to tell UA-cam that I have permission? Thank You if you can answer this or point me in the right direction!

    Does this apply to parody videos? If you are parodying a music video is it enough to parody the visual aspects of the video and use the original audio, or must you also make a transformative change to the audio for it to be safe?

      I think as long as you transform the music "enough" you're fine.
      A famous artist in my country would usually rewrite all the lyrics and sing over the tune and keep the rest of the song. He's somewhat despised for that, but as far as I know, it works.
      Oh and no clips allowed. You gotta record your own clip.

    I want to make a fan made music video for one of the new twenty one pilots songs called neon Gravestones. The band is labeled with Fueled by Ramen. So would I call them or Warner bros or who to try and get permission. I don’t wanna make money off of it just make a video for it.

      Yes. exactly the same. Not-for-profit doesn't mean you don't have to pay for rights... but sometimes you can get a better rate, or even a freebie, if the copyright owners are on-board with the cause.

    I probably sound quite stupid but after you get the rights do you just put their quote in the description of your UA-cam video? Or will your video just magically be free of copyright?

    Does this also apply to if I wanted to use someone's song as a tile theme in a video game I'm making and intend to sell? Its 1 persons song, and it's not well known at all, so if I contact them asking for permission, and they say yes, I can use it?

      Yes... if you have a proper (written) license agreement from the OWNER(s ) of the music (recording and composition), you can use it.

      Gordon Firemark Hi 👋 I have two copy right claims one is just that and the second one is partially blocked in Denmark from what I heard is some UA-cam videos are blocked in Denmark. I honestly didn’t know about this until I saw it because I thought by covering a song on an instrument won’t do that can you still get permission even tho it’s a copyright claim that’s my question.

    I run a church service that wants to live broadcast sunday services with covers of songs,we paid ASCAP LICENSE are we allow to use the covered music and if so what dono need to include on the videos as far as license number?

      If you've licensed via ASCAP, then as long as the license covers livestreaming/broadcasts, you should be fine. But depending on the platform you're streaming from, you may have to show some proof of the license. That'll vary by platform, and you'll need to interact with them directly. It's unlikely there's an online way to do this.

      Generally, the music publisher will have the right and authority to grant permission on behalf of the songwriter, but they'll often need to get songwriter approvals, so expect the process to be time consuming. Be sure you get your license from ALL music publishers... Since it's possible each member of a group of songwriters has made a deal with a different publisher.

      Karol Konieczny publishers are usually companies, but if an individual, the heirs will probably be the new owners of copyright. So, that’s who you contact.

    Frustrating for a beginning music video hobbyist using heavily licensed/signed artists/songs for vids. Sure you could do this all but what cost would it be? Ad revenue from an upload is heavily policed i’d imagine so it’d be a hefty toll to use a major label as background. But hey, I respect the holders of content but think there should be some easing, wonder what can be done about that. Thanks for the vid!

    Hi Gordon. We want to use a music piece as part of the score for our film and have contacted the publishers for consent. They came back with a few questions and I wanted to ask some advice? If possible.
    It is a UK-based independent self-funded micro-budget (Under £20k) film.
    Any help with this would be Wonderfully appreciated and apologies in advance for so many questions.
    Is there a brand/product being advertised? If so, please provide details: -- Characters are eating a branded product from a local business that we have consent to use in the film. Would this be categorised as advertising?
    Usage (e.g. background/ opening credits): -- It is played in the last 2 scenes and closing credits of the film and is not heard by character (non-diegetic). Is this what they mean by background music?
    Rights required: (e.g. online only/all media/ TV broadcast/home video): -- You mentioned not giving leverage for future higher rates so do we just say ALL?
    Territory: -- Same as above. Do we just say worldwide? We are hoping for international festivals etc.
    Term: -- Same as above. Do we just say in perpetuity?
    What’s your music budget for this request: -- We obviously want to pay the least amount possible I have no idea how much to say? e.g. would be outrageous to ask to use it for free? Just as an example.
    Is there other music being requested: -- If there might be from other publishers is there a disadvantage to this? Leverage wise.

      No. The SONG is copyrighted, which means that only the owner has the right to use it or allow others.
      But you're also operating under a misconception. Your video IS copyrighted, automatically, the moment you create it, unless you specifically transfer it to the public domain. (which requires paperwork)

    I dont understand how so many UA-cam videos have popular music in them... like the mixes... multiple songs melded together for video compilation or a single video, or even just a youtube vid to listen to the song(s)... Do those people actually get copy write permissions for each song and then mold em together for their video? Do you PAY for majority of the copyright permissions or are there any they allow free (but with permission)? Also, if you get permission to use a song....is that permission for just that one pparticular video or is that permission so you can use it whenever you want or in any video afer (do you need to re-request permission for the same song if you use it in several videos...)

    wait so if I want to upload a trip vlog on my UA-cam channel and I want to use a song as an intro I have to contact each person involved in that song to avoid copyright? Do all UA-camrs do that? for each song they use on their videos, they get hundreds of people and wait for them to respond?
    Can I use like 20 seconds of the song and give credit to the owner in the description? Would this do it?

      some songs are pre-licensed thru youtube. Read up. Otherwise, yes, you need permission from the. publisher and record label.

    For the festival release of a film, I have a license in place with an artist who recorded a cover song. That artist properly obtained the license to record & release the song from the copyright owner. Even though we have a license to use THE RECORDING, we still need a NEW license from the original song's copyright owner in order to use it in the film? Is that correct?

      Kenny White yes. You need a synchronization license from the publisher(s)of the song.

    So I personally know the person who made and produced their music. They own their studio. They verbally gave me permission to use their music. Do they have to fill out a form, and where would you submit proof of something like that on a YT video upload?

      Unfortunately, there's no mechanism for users to notify YT in advance of a claim or content ID flag. This is something they really need to find a way to fix. Get the license in writing, and have it handy for when YT notifies you that it found the music. That's best you can do right now.

      No. You must get permission, or operate under a legally recognized defense or exception. Whether you make money is not a factor at all. Copyright ownership means having the right to say "NO" to a use, for any reason at all, regardless of whether there's money involved. Likewise, giving credit is irrelevant, except that it could be the "smoking gun" that proves you knew the material belonged to someone else.

    There's a reason UA-camr's want to use copyrighted things in their videos. Because it's necessary for the video. If we wanted to use copyright free material, we would. But there's no sense in doing that if the copyrighted material is the only possible thing that will make the video tick.

    So is it just a workaround when shows and movies use covers instead? I hear a lot of recognizable songs, if not classics, in shows and movies and I always wondered why the original just wasn't used. 🤔
    I also have wondered if (and I promise I'm not a conspiracy theorist) the lyrics are just ever so slightly changed to avoid copyright. Is that possible or very prone to a lawsuit anyway?

      The “version” doesn’t need to be registered. You get permission for the recording from the record label.
      But the composition is the same across multiple covers of the song, so you need permission from the same publisher for that.
      If the title isn’t showing up in BMI at all,
      Try ASCAP.

How would you change copyright law? Remember that the constitutional mandate is "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries."
      so, how do you incentivize creative work without giving the creators the right to control how, when, and why that work is used by others?

      Ian Mitchell they are businesses. They do have contact email addresses. They have websites... get a phone number or write a letter. Be resourceful.
      Or hire a lawyer to help...

    Long road to nowhere. Unless you're in the circle of the powers that be, they don't even know you're alive. And will not respond to any email inquiries. I been doing this for many years. This is the cold hard truth. Notice how he recommends being better off by using your own music. Sure! That makes it feasible and you will actually get to move forward now instead of waiting for inquiries that will never be answered. Only one problem. Your own music just doesn't have the popularity level as the music you were trying to get. Or the third option. Take any song you wish and USE IT! Since they don't and never will know you even exist on this planet, they will never know you're using the music. Have fun. And always remember ... The powers that be are IN the circle! If you're not in that circle you are OUT!

      A good point, that applies to anything, especially small stuff. Loose change earning products, copyright is designed around corporations, like the Digital millennium copyright act.
