Hey everyone, Dan Henderson here. Just want to say a huge thank you to the Kitguru team for giving me the opportunity to tell my side of the story. It's been a wild ride so far, but as many have said in the comments, accountability and the truth are everything, and we shouldn't stand for less. Finally, thanks to anyone who has watched/listened, taking the time and energy to hear my side of the story means a lot.
Enjoy the lawsuits! You should have just taken EKWB to court for payments not made instead of resorting to defamation. Going through a judge/magistrate is a better path to determine who is lying and who isn't, not social media platforms.
Dan, you came across well. And the way you are fighting this company can only be seen as very brave - I dont know the whole story, no one does, but based on the edvard interview and all the information presented at this stage. they need bought out , and the excellent staff who make the great products under a much cleaner, safer, fair environment.

I had no idea who was right or wrong in this, but having heard from both Edie and now Dan, Dan comes across as clear and calm. Edie came across as confused not the sort of guy I would want to buy a used car from. Good luck Dan in your future ventures. Such a shame about EK.
The thing about being a self-employed contractor and, in terms of your contract, not being solely reliant on one company for income even though you effectively work full time is a common way for companies to skirt the law - here in Slovenia, if you work full time in terms of hours, which is 40 per week, you are, by law, entitled to all employee benefits even if you are a self-employed contractor.
The same is true in many US states and Canada as well. Frankly, as someone who freelanced for about half of my professional career, everything Dan said about employment conditions sounded to me like EK has specifically set things up to evade taxes and shift the blame onto their contractors. They sound like employees and I suspect a judge would think the same, which means there would be stiff penalties and fines for systemic breaches of labour laws.

Watching the interview between Dan Henderson and the initial one with Edvard König are wildly different. Dan was clear, and gave lots of pertinent information. Edvard appeared evasive, and seemed to be only interested in doing damage control in order to save his own skin. Also, good job Leo for investigation this further. Very eye opening indeed!
It’s quite confusing but Sean Scott is right. Edvard completely blew his interview and didn’t address the questions really and came across as flippant.
The amount of money EK owes Henderson, vs the amount of money they lost due to these negative stories and their fallout. If they go out of business, it’s due to a stubborn unwillingness to settle.
Timeline is very tricky. I think they paid him by accident the money they owed but said they didn’t owe it. Then when they realised they paid it they used it as a four month advance payment on a new contract which had him earning more. 😮

That bit about refusing to pay commissions owed, and essentially threatening to fire you unless you signed a new contract, that meant they didn't have to pay you your owed commissions, only to then pay you the amount invoiced for the commission instead of your 4 months salary on the new contract, is some next-level scumbagery and mind-f-ery
The thing for me is that Edvard seemed almost Blatantly arrogant in his video. Almost as if he would crush dan after calling him a liar. I can only judge people by their actions and anyone who sides with edvard after his interview with Leo seems very misguided. He even started it off with a computex advert !!
Great interview, found Dan incredible respective and credible. EKWB are in breach of employment contract by not paying Dan for four months. As there was no express agreement between him and EKWB stating agreement of receiving x amount in lieu of his monthly wages. If there was such an agreement then Edvard would have mentioned it as that would have completely undercut Dan and Dan's credibility completely.
Great job Allan, Leo and the rest of Kitguru for doing these interviews! I stopped buying their products a few years ago due to bad QC and terrible prices, i can't see myself ever choosing them again with all of these issues surfacing. Lastly the fact that Eddy had the stomach to "advertise" their upcoming computex attendence, in the allegation/answers video just leaves a bad taste in the mouth.
Former EK employee here 👋🏾 I’ve worked with Dan many times, he’s a phenomenal guy. It’s unfortunate that this issue is still ongoing with EK and him. To answer the question why none of us are sending an email to what EK has mentioned us to respond to is simple. We want this crap to be over with. We know how EK is with communication, why would we expect them to be different on this side of the fence? None of us from the Texas office want to reach out to EK because they didn’t want to talk whilst we were apart of the team. Honestly, just focus on rebuilding your brand, and leave us be to move on with our lives.
You all should have sent the emails to them and kept a record of it. Doesn't matter how they are with communication, let the record show; especially with this matter.

But ultimately I have a life to live outside of them. I have a family to take care of. I’m here in the comments in support of Dan because he’s a great friend. I dont know who is right or wrong, but that opening statement is brilliant. Three sides to every story is 100% correct. presenting both sides and letting us make up our own minds without KitGuru making a 'final judgement' or statement is really a great way of doing it. Its nice to be treated like an adult on youtube like this.
I wouldn't say Micro Center has "a lot" of stores in the US. There's only 26...and those aren't even in half the states. Believe me, we wish there were many more. For context, Best Buy has over 900 stores in the US. Micro Center is considered extremely small here in the US, but definitely a Gold standard that us PC folks wish was much larger.
What EK doesn't understand is that the complaints is coming from multiple sources, multiple similar complaints, it's too much to be a coincidence. They like to act Dan had an agenda against them but clearly all these other accounts prove that it is not a vendetta.

It sets out the fundamental rights and freedoms that everyone in the UK is entitled to. It incorporates the rights set out in the European Convention on Human Rights (ECHR) into domestic British law. The Human Rights Act came into force in the UK in October 2000. Thus the UK has a Human Rights constitution that goes way beyond what the Americans have in their Constitution and Bill of Rights There are 13 main articles which can run to 100s of pages Kit you may want to read and understand: Article 9: Freedom of thought, belief and religion Article 10: Freedom of expression
All contracts are supposed to have definitions that outline what specific terms (words) mean in the scope of the contract. If they do not have such definitions and are deliberately left vague as Leo pointed out, this effectively renders the contract legally unenforceable as it becomes far too broad and all encompassing. For example the clause in the contract about posts effectively means Dan cannot post anything if it was legally enforceable. Then there's the violation of fair clause laws and regulations (as well as various employment laws and regulations etc) which governs the enforceability of contractual clauses as well as the fairness of legal contracts. I.e. once terms signed by employee, the employer cannot change the terms after the fact unless expressly agreed by the employee -and- by signing a new contract or addendum or memorandum of understanding which is then attached to the old contract. All changed terms and agreements etc need to be outlined in the addendum or memorandum of understanding. Then there's the added complexity of a company having to abide by rules, laws and regulations of all countries where they do business - they cannot pick and choose what law etc they want to follow as that would result in absolute legal anarchy.
EKWB shills in comments. I dont want to see Ek fail as a company but as a consumer I won't tolerate current behavior and remain a customer. Makes for a toxic work environment and then a poor product eventually. Thanks Kitguru!
Companies deal with disgruntled employees and contractors all the time. That's why they have Legal departments and lawyers. Dan Henderson is going to get sued big time and he will lose. I note that he states he lives an expensive lifestyle so he's going to end up filing for bankruptcy in the future.

I've been stiffed by companies before but I know what a NDA is and I know that Dan Henderson "going public" is merely an attempt to extort money he feels he is owed. Hence his own admission with threats to EKWB. Any sane person would just take EKWB to court for money owed if there is evidence for it but he went through social media and that was unintelligent.
Yes that sums it up completely. Edvard needed to show some humility. That company make great products but he is not a leader. Like the 15 percent shareholder he let run his company for years. They need a takeover.
Wow the drama continues. I watched the interview with edvard and came away feeling he wasn’t telling the whole truth. After watching this one. I’m just stunned that it’s gotten this far. Surely it would have made more sense to pay dan on time. Dan has hurt Ekwb immensely. Must be millions of damages now in lost sales and company reputation. Having these videos up must be stopping Ekwb getting investment.

You must have other customers, it is likely for countries like Germany. Where they have laws about what they call pretend self-employment. If you are self-employed but only work for one company they say you aren't really self-employed.
Germany has far more strict laws regarding freelance/contract work with companies, especially those that are outside of the EU. Mainly due to the company then being able to avoid paying certain social contributions or a portion of for the “employee”. But to compare German law to another country is a bit extreme. So he may very well be able to work for one company as a contractor, I am not privy to the laws of the UK.
Huh, I always thought EK just sold water blocks. Too bad for them, that's the sort of thing you can keep using from computer to computer. I'm still using my Danger Den water blocks I bought in 2009. I've upgraded CPU/MB almost every year.
Folks that point out the very different attitudes between the two interviewees should keep in mind the restrictions each man is under, what they have to lose, and how they can benefit. Mr. König likely has a team of lawyers that advised him prior to this interview on exactly what he could/couldn’t say. His frequent hesitation is a man in a high pressure situation trying to answer questions without going against his legal experts. He stands to lose his company that he has certainly put a huge amount of effort into, his reputation, and potential legal ramifications easily reaching into the millions of dollars. Mr. Henderson stands to have his reputation ruined, lose a substantial amount of money, and could also face legal ramifications reaching into the millions of dollars. If he hasn’t been advised by lawyers yet, he should seek legal representation. He does NOT have anyone but himself on the line, though. Not stating MY beliefs on right or wrong here, just encouraging a moment of thought.
This whole thing is so messy. Appears to have been going on for many many years. Thought dan got his points over well and clearly has had a lot of legal advice.
enjoyed this video and feel it was very much needed in response to the weak and somewhat suspicious delivery of the responses from Eddie 'EK' - However.........nearly 10 adverts to skip during the video ! ! 1 unacceptable but I don't know how is to blame for this irritating nuisance? An interview is not the type of content that lends itself well to being constantly interrupted mid-sentence literally every few minutes for three quarters of an hour. If it's a setting that needs to be changed on your part then please change it, if not please let us know so that we can complain to UA-cam
This is why I when I just ordered $800 in new water cooling parts for my pc none of it was Ek. I had several EK parts but none of them are going into this build.
I don't see how by not using things you already paid for in a build will affect EK in any way. I will continue to love my EK 3090 block, it was made by good people, not the management.

Im just a guy who does this as a hobby so im on the outside looking in. With that being said, people not getting paid, evading taxes and calling your workers lazy american idiots and making racial slurs in emails really makes me just not like your company.
Soo if I understand this correctly. At one point he says the FG could have been profitable if managed correctly...so it wasn't profitable. And yet again he wants procentage for something that isn't profitable and states it was profitable. You can clearly see how much was the FG(enterprise)making each month with his statement of how much was owed to him by just multiplying that number with 200(0.5%*200=100%). In the end if you think about it, you can even calculate how much PCs were made from that number....and let me tell you it was not a lot for 5 guys let alone 15. So yeah no wonder they closed texas branch

Yes, it kind of is cultural.... A culture of greedy, incompetent CEO's acting like entitled, authoritarian dictators, and a culture of workers expecting to be treated like humans, and being paid fairly.

wait, so all the big buzz about EKWB lay offs is about one former TEMPORARY contractor? wow. some youtubers apparently have blown things out of the proportion. one unhappy "temporary" contractor (kind of like linux part time maintenancers) who demanded to get more from his short period of contract and from unhappy of certain type of "social treatment" from his temporary employers makes all internet going all hell on EKWB? i mean, i supports people who been treated unfairly by their employer even if they are merely in the company part time,have every rights to speak up their discontent. but why the whole youtube PC socieity blow it up as if there is a serious problem in EKWB? i mean, ok, they most certainly bad employer, but i dont see massive lay offs like what some people in their youtube channels are buzzing about. man, youtube.
Just started watching but IMO Dan Henderson should be sued for defamation. I'm a contractor right now and even I know what a NDA is. Dan Henderson clearly violated what he signed and his words were clearly designed to cause EKWB to lose business (as social media influencers like Gamers Nexus and Jayztwocents have clearly tried to do). EKWB should sue Gamers Nexus and Jayztwocents as well.
He doesn’t work for them so no NDA, as it expires when the contract is ended, unless a timeframe is specifically stated, which he says hasn’t been specified? Please explain as you said you were the expert here? Oh, and J2C still hasn’t been paid whats owed by them.
I’m confused, are NDA’s supposed to cover C-Level racism, sexism, harassment? I highly doubt that someone is not allowed to publicly comment on their FORMER employers lack of payment, as well as their blatant racism and discrimination simply because they “promised” they wouldn’t. NDA’s are used to protect confidential company secrets, etc. Unless “not paying anyone” is a trade secret I don’t know about. Have you read any of the NDA’s you have signed as a contractor? Because it doesn’t seem so - but good luck!
Hey @hendo88 and @Kitgurutech, just wanted to propose a possible reason for EK using the statement of "EK is not to be your sole source of income"... I know, at least in Canada, the Canadian tax authority (CRA) has a rule whereby if a contractor works ONLY for one company, then they actually cannot claim the normal tax benefits of being a contractor, and will be considered some form of employee by the CRA. I'm a bit foggy on what the exact rules and implications are, and it's been a while since I've been a contractor so I don't know if it is currently this way, but back when I contracted, I know that if I didn't work for at least two companies within a calendar year, then I risked being considered an employee by the CRA, and that came with all sorts of different tax implications, both for myself and for the company I would have worked for. So it was very important for me to ensure that I did at least some sort of work for a secondary company, if my primary source of income was from one company, otherwise I and the company I primarily worked for would be liable for various additional taxes, as well as payments for workers compensation, canada pension plan, and whatnot. This might be why EK said in the contract that Dan had to not use EK as his sole source of income. I'm not at all familiar with Slovenian/European laws, but I am curious if maybe them saying that in the contract might have somehow allowed them to claim they have done their "due diligence" with regard to their contractors and ensuring that they were not acting as employees but claiming to be contractors. I could certainly see there being some sort of law that would allow a company to make a statement in a contract that the expectation was that they were not going to be the sole source of income, and that this statement would relieve said company of any liability if the contractor was to go on to use them as their sole source of income (to me it's kind of logical though too, in that a company can't really control what their contractor does, and whether or not the contractor seeks out additional income other than what comes from this company). Though I'll also say, I would wonder if that would stand up in court, if the company was also requiring the contractor to work what is considered "full time", by the contractual agreement - obviously it kind of puts them in a tenuous legal situation if they are saying "you must find additional work, since you're a contractor" but then later in the agreement they say "you have to work x number of hours" if they know that x number of hours would put the contractor in a situation where it would be unreasonable to expect them to be able to find additional work and have the time to actually do additional work. just some thoughts.

I dont know who is right or wrong, but that opening statement is brilliant. Three sides to every story is 100% correct. presenting both sides and letting us make up our own minds without KitGuru making a 'final judgement' or statement is really a great way of doing it. I wouldn't say Micro Center has "a lot" of stores in the US. There's only 26...and those aren't even in half the states. Believe me, we wish there were many more. For context, Best Buy has over 900 stores in the US. Micro Center is considered extremely small here in the US, but definitely a Gold standard that us PC folks wish was much larger.

What EK doesn't understand is that the complaints is coming from multiple sources, multiple similar complaints, it's too much to be a coincidence. They like to act Dan had an agenda against them but clearly all these other accounts prove that it is not a vendetta.

All contracts are supposed to have definitions that outline what specific terms (words) mean in the scope of the contract. If they do not have such definitions and are deliberately left vague as Leo pointed out, this effectively renders the contract legally unenforceable as it becomes far too broad and all encompassing. For example the clause in the contract about posts effectively means Dan cannot post anything if it was legally enforceable. Then there's the violation of fair clause laws and regulations (as well as various employment laws and regulations etc) which governs the enforceability of contractual clauses as well as the fairness of legal contracts. I.e. once terms signed by employee, the employer cannot change the terms after the fact unless expressly agreed by the employee -and- by signing a new contract or addendum or memorandum of understanding which is then attached to the old contract. All changed terms and agreements etc need to be outlined in the addendum or memorandum of understanding. Then there's the added complexity of a company having to abide by rules, laws and regulations of all countries where they do business - they cannot pick and choose what law etc they want to follow as that would result in absolute legal anarchy.

Companies deal with disgruntled employees and contractors all the time. That's why they have Legal departments and lawyers. Dan Henderson is going to get sued big time and he will lose. I note that he states he lives an expensive lifestyle so he's going to end up filing for bankruptcy in the future.

Wow the drama continues. I watched the interview with edvard and came away feeling he wasn’t telling the whole truth. After watching this one. I’m just stunned that it’s gotten this far. Surely it would have made more sense to pay dan on time. Dan has hurt Ekwb immensely. Must be millions of damages now in lost sales and company reputation. Having these videos up must be stopping Ekwb getting investment.

If you are self-employed but only work for one company they say you aren't really self-employed.
Germany has far more strict laws regarding freelance/contract work with companies, especially those that are outside of the EU. Mainly due to the company then being able to avoid paying certain social contributions or a portion of for the “employee”. But to compare German law to another country is a bit extreme. So he may very well be able to work for one company as a contractor, I am not privy to the laws of the UK.

Folks that point out the very different attitudes between the two interviewees should keep in mind the restrictions each man is under, what they have to lose, and how they can benefit.
Mr. König likely has a team of lawyers that advised him prior to this interview on exactly what he could/couldn’t say. His frequent hesitation is a man in a high pressure situation trying to answer questions without going against his legal experts. He stands to lose his company that he has certainly put a huge amount of effort into, his reputation, and potential legal ramifications easily reaching into the millions of dollars.
Mr. Henderson stands to have his reputation ruined, lose a substantial amount of money, and could also face legal ramifications reaching into the millions of dollars. If he hasn’t been advised by lawyers yet, he should seek legal representation. He does NOT have anyone but himself on the line, though.

Soo if I understand this correctly. At one point he says the FG could have been profitable if managed correctly...so it wasn't profitable. And yet again he wants procentage for something that isn't profitable and states it was profitable.
You can clearly see how much was the FG(enterprise)making each month with his statement of how much was owed to him by just multiplying that number with 200(0.5%*200=100%).
In the end if you think about it, you can even calculate how much PCs were made from that number....and let me tell you it was not a lot for 5 guys let alone 15.

Just started watching but IMO Dan Henderson should be sued for defamation. I'm a contractor right now and even I know what a NDA is. Dan Henderson clearly violated what he signed and his words were clearly designed to cause EKWB to lose business (as social media influencers like Gamers Nexus and Jayztwocents have clearly tried to do). EKWB should sue Gamers Nexus and Jayztwocents as well.
He doesn’t work for them so no NDA, as it expires when the contract is ended, unless a timeframe is specifically stated, which he says hasn’t been specified? Please explain as you said you were the expert here? Oh, and J2C still hasn’t been paid whats owed by them.

I’m confused, are NDA’s supposed to cover C-Level racism, sexism, harassment? I highly doubt that someone is not allowed to publicly comment on their FORMER employers lack of payment, as well as their blatant racism and discrimination simply because they “promised” they wouldn’t. NDA’s are used to protect confidential company secrets, etc. Unless “not paying anyone” is a trade secret I don’t know about. Have you read any of the NDA’s you have signed as a contractor? Hey @hendo88 and @Kitgurutech, just wanted to propose a possible reason for EK using the statement of "EK is not to be your sole source of income"... I know, at least in Canada, the Canadian tax authority (CRA) has a rule whereby if a contractor works ONLY for one company, then they actually cannot claim the normal tax benefits of being a contractor, and will be considered some form of employee by the CRA. I'm a bit foggy on what the exact rules and implications are, and it's been a while since I've been a contractor so I don't know if it is currently this way, but back when I contracted, I know that if I didn't work for at least two companies within a calendar year, then I risked being considered an employee by the CRA, and that came with all sorts of different tax implications, both for myself and for the company I would have worked for. So it was very important for me to ensure that I did at least some sort of work for a secondary company, if my primary source of income was from one company, otherwise I and the company I primarily worked for would be liable for various additional taxes, as well as payments for workers compensation, canada pension plan, and whatnot.
This might be why EK said in the contract that Dan had to not use EK as his sole source of income. I'm not at all familiar with Slovenian/European laws, but I am curious if maybe them saying that in the contract might have somehow allowed them to claim they have done their "due diligence" with regard to their contractors and ensuring that they were not acting as employees but claiming to be contractors. I could certainly see there being some sort of law that would allow a company to make a statement in a contract that the expectation was that they were not going to be the sole source of income, and that this statement would relieve said company of any liability if the contractor was to go on to use them as their sole source of income (to me it's kind of logical though too, in that a company can't really control what their contractor does, and whether or not the contractor seeks out additional income other than what comes from this company).
Though I'll also say, I would wonder if that would stand up in court, if the company was also requiring the contractor to work what is considered "full time", by the contractual agreement - obviously it kind of puts them in a tenuous legal situation if they are saying "you must find additional work, since you're a contractor" but then later in the agreement they say "you have to work x number of hours" if they know that x number of hours would put the contractor in a situation where it would be unreasonable to expect them to be able to find additional work and have the time to actually do additional work.
