People think of prenups and postnups as being the same thing.
I forgot to get a prenup we didn't have time we were planning the wedding things got crazy, so i can just get a post up right? Isn't it the same thing?
Not so fast! It's NOT THE SAME THING. The difficulty with the postnup is it is negotiated and drafted after you're married. So problem number one is that maybe one of you doesn't feel like cooperating. Maybe you've decided you know what we're already married, I don't really want to deal with this. And the issue with that is there's nothing the other party can do to force the other to cooperate with the postnup. At least when you're dealing with a prenup you're dealing with a well, I wouldn't get married, but this agreement is really important to me prior to getting married.
With a postnup there's really nothing you can do if the other party doesn't want to participate. You can't say "oh i'm going to un-marry you because you won't participate in this postnup," or "oh you promised me that we were going to have this postnup but now you're going back on your word."
There's really nothing that can be done at that point. Postnups can also be more contentious so by the time you're already married you've probably fallen into some type of groove with respect to your finances and how you manage your property. Whether it be marital or separate a postnup then really interrupts that and it can be detrimental to a marriage.
I think postnups can also save marriages. In many instances a lot of people really struggle with finances once they're married and one's a spender one's a saver and a post-nup can be a mechanism that helps the couple come to an agreement on finances and then be able to move forward with their marriage in a really productive way. One of the core issues when we're talking about prenups versus postnups is that postnups are generally just less enforceable than prenups.
