When I was divorcing my dreadful husband who loved to run up bills, he extorted me to pay off a loan he had taken out against my wishes so he would sign the papers. Idk if this helps or makes it worse. Added, I’ve been blissfully happily married to a great guy for 30 years and we’re crazy about our lives together.

      It would be fine with me. I have a few million and a lady friend has almost double what I have. I would want prenups to protect both of our assets. In 10 years she may have 4 times what I have and that’s cool, but I could have more than her.

    A prenup should be viewed as a will for a marriage. If the marriage dies, the prenup avoids a fight over the marital estate. Having a prenup doesn't mean the parties don't love one another or that one spouse necessarily wants to oppress the other --it means they've agreed not to fight over their assets in the event of divorce by agreeing how the assets will be distributed from the outset.

    A prenup is like a seat belt. No one wants to crash their car but it still happens. When it does happen, you'll be glad you had the prenup because that prevented you from getting seriously hurt. If you never use the seatbelt then it was just there and it had no effect on your experience. No harm no foul. It's better to have it and not need it than to need it and not have it.

      So what would you tell the wife who has been taking care of the kids for 10 years full time and never had the chance to build wealth while the husband had been putting thousands and thousands into savings? How is that fair to her at all? Sure she gets some child support, but that doesn’t nearly justify the income she could have saved up if she was working.

      So I hate it when a lady comes out and say "but I raised your kids....."
      No it is "Our kids" These are human beings we are taking about not some pets.....
      If a woman has truly made a huge sacrifice in raising kids the proper way, those kids will love her more and she will reap the fruit of her hard work. ...
      So the day my wife boast about raising Our kids and refers to them as my kids, then she has automatically made herself my nanny.....

    A professional fighter never gets into the ring without a signed contract explaining how things will be paid. Never give a ring without talking and having both her lawyer and your lawyer break down the rules of prior assets. That said, when you marry you marry the Government. A judge can throw out a prenup. Talk to multiple lawyers.

      When she's presented with a prenup, she MUST have an attorney review it with her, in detail. If this step doesn't happen, the prenup can easily be voided by the judge in a later divorce proceedingf.

      Great post. It's a real tragedy that most guys think a prenup is the answer, when, like you stated, a judge can throw out even the best written prenup(s). Unfortunately, IMO, American divorce law system does not help people, it exists to financially subsidize itself.

    The way I see it, a prenup is like insurance. You have it to protect everything you bring to the table incase it may get lost in a fire (divorce).If you decide you no longer need the insurance then get rid of it later down the line.

      I think it's because typically the woman gets stuck with the majority of household duties, and the man often expects her to acquiesce to doing many things his way. I sure don't care to clean up after someone who can't be bothered to not be a slob, and Don't want to deal with someone acting like a spoiled child because everything doesn't go 100% his way. Yeah, I've been with some real winners. I know not all men are like this.

      Well, lawyers will probably say to get one . . . unless you don't have any money. This is out of self interest because they lawyer is the person you pay to write the prenup! Dave is at least an impartial third party.

      J Williams- yep!! Why rush getting married! If she is truly frugal and down to earth she will be with you regardless, and will be willing to sign a prenup if she knows you have that type of net worth. I’m in a similar situation with my BF. My net worth isn’t 1M but it’s sizable for my age. His is over 1M and we have already agreed if we are to ever marry, than there will definitely be a prenup involved. It’s just out of respect to everything he’s worked for all those years.

      TenksILike2Ple so they have always been able to do that. So nothings changed. There are 7 legal reasons that prenups get tossed. But if you avoid those 7 *might be 5 cant remember* you are golden. (Rules post money action also matter).

    Take your time on the marriage thing! Never rush it! I heard a counselor give some fantastic advice in regards to this topic. He said take 10 percent of the budget for the wedding and use it for a year of pre marriage counseling. This is a great way to find out who you are marrying. And for both people to deal with their issues. It’s better to deal with this stuff sooner rather than later.

    I’m also a woman, and I got engaged after six months to a man who lied about his debts, and lied about his former life. And was a preacher of the gospel. You haven’t known her long enough to really know if she’s telling the truth. A prenup is fine if you really love each other.

      Because it would make Dave a hypocrite all of his assets are locked in trusts and llcs, he has said this on air before. That is what this guy needs to do not get prenup. A judge can throw out prenup. Dude needs to sit down with asset protection lawyer and set up some trust and llcs and throw his stuff in them before marriage.

    That's my sweet nephew! He has always had a good head on his shoulders, so I trust his judgement. Hes been through a lot; learned a lot of life's hard lessons, and I know that he is surrounded by a loving family and extended loving family members, who will be honest with him, and will support him in his final decision on this matter.

    As you are dating, little by little let on how much you own. For example, drive by the rental property or stop by to fix an "emergency" or make a quick stop to pick up some paperwork. If she is as wonderful as you say, she will figure it out over time. If you just drop it all on her one night over dinner, she could get overwhelmed. She may also feel betrayed and wonder what other 'secrets' you've been hiding. If she is down to earth, high finances and $$ could scare her, especially if she comes from a modest background and if she herself is humble. She sounds like a prize, so treat her with kindness and respect.

    100% of married couples have pre-nups. Most of them use the pre-nups provided by the government as part of the marriage contract. Their is nothing wrong with setting your own terms.

    Don’t get a sunset clause which erases the prenup after a certain period. If you get a prenup that ends at year 10, when year 9 comes around, all of a sudden it will force you to reevaluate your marriage in an unhealthy way. Divorce lawyers actually advise against it for that reason.

    Date longer!
    There’s a lot of data to indicate that you really don’t know someone until after 6 to 12 to 18 months. People can present a false persona but can’t maintain it for longer than around 6 months to a year.
    Spend the next 6 months communicating more openly and learn more about each other’s financial habits.

    You only see how nice a woman truly is in divorce court. It's also not whether you trust her but whether you trust the lawyer who gets her in a room or the judge who decides everything. Also if she's not in it for the money what's the harm in signing the prenup?

    I think we need to normalize prenups, and anyone with any assets of any kind should get one. Own a car, prenup, have a dog, prenup, inherited grandma's antique kitchen table, prenup, no one gets married expecting to get divorced, but if you really care about the person you're marrying, wouldn't you want them to be protected?

    Everyone should get one. Poor or rich. People seem to think prenup = you get nothing. That's not true. It allows you to both negotiate what will happen if things don't work out. It seems like people think if they don't get one then they won't get divorced or something. It's an important conversation to have with someone you plan on marrying.

      @Sir We Are About to Die I think you have mixed feelings (based on your comments directed at me) about what a woman's role is in society family and marriage. Modern American society has certainly changed some gender role expectations but I do think it's up to the couple to decide together what kind of roles they want to assume in their own relationship. Not everyone wants a modern working wife and not everyone wants a provider type husband. So one size doesn't fit all anymore.

And sell any properties that was brought during the marriage and split the profit or agree to who will take it. Any money saved up in the marriage will be split. But i also believe in 3 accounts during marriage. 1 house account where all bills will be split evenly and our own private accounts. I havent found a guy who wants to agree with that so single I shall stay.

    If you both are 25 when you get married and have zero assets a prenup isn't necessary. If you are older and have over 300k in networth a prenup is necessary.

But if we got divorced, whatever we made gets Split 50/50? Correct? But he's also $50,000 in student loan debt....I would get half that debt to huh or no?

    "Our Money?" Nope. She has her own. Separate accounts only. Anytime I have had a joint account, it never ended well for me. I was married to an honorable woman (RIP) who bore four children.     Yes. Never ever ever get married without a very thorough prenuptial agreement, regardless of assets or incomes, with both parties represented by legal counsel and agreement signed on video so no one can claim they were forced, intimidated or coerced to sign it. It’s not just for the protection of both people, but their kids and their families and friends as well. The ugliness of divorce can literally tear a hundred people apart... not just two.
