The reference made to O-7 R- 11 CPC by Chitra Mam is exactly matching with criminal discharge u / ss- 227, 239 and 245 Crpc. Crpc. provision says "The test for discharge or framing charge is to consider whether the statements of the witnesses as they are would attract conviction for the accused " Secondly the broad test to be applied is whether the materials on record if unrebuted would make a conviction reasonably possible ". But these wordings are not found in CPC u/o -7 r- 11. Here it is entirely different from crpc. Anyway it is a fantastic session Thanks a lot.
