Depending on the state, but for most, a mental institution is arguably a lot worse than regular prison since you are grouped with others who definitely do have a lot of problems, faking it only means lots of pain since you are in for as long as the professional think is enough, which is often life. And keep in mind, these defenses usually fail anyway.
