to use travel insurance she may have not been able to go on the trip at all... unless the insurance covered xtra unexpected expenses and allowed her to still go...that wouldn't have been an option
It sounds like he needs an amendment on his contract stating that if changes are made by the airline and/or hotel that he is not responsible. When it comes to travel, changes happen all the time. This is why there is travel insurance. Let's think about what she would have done had the original itinerary stayed in place but her flight from Jo-burg was severely delayed. Would she had sued him for the problems and having to stay at a different hotel for the night?
I travel a lot, too often with delays. Never had to activate the travel insurance (check their requirements for how many hours before they will do anything).
@@roxannemoreno2012I've done the almost identical same thing, mine was just longer because my friend and I volunteered in Zimbabwe with schools and Lion reserves, it's not very expensive, we stayed in hostels. The hostel was dirt cheap, the flight was $1100 from Houston to Victoria Falls, stopped in South Africa, and Zimbabwe, everything else was by car. Safari was $1400. I did a lot after my friend left. I'm eventually gonna do it again, not staying in a hostel though. We booked through a place called Zambezi tours.
@peryole wow congratulations 🎊 That sounds fun except for the hostels. I think this now on my bucket list sinceI thought it would be way more expensive.
what a fascinating case! I think one thing that the defendant should consider is building in a buffer between arrival and departure. as an example, when you take a cruise they discourage you from flying in on the same day the ship leaves just in case your flight gets delayed. I'm glad they got to go - and also sorry that this defendant might have lost a client
If the lodge changed the plaintiff's flight to and from their lodge, paid for the their layover stay, that is on the lodge not the defendant. She should have tried to get her money from the lodge. She really sued the wrong person. It was not his fault why should he pay, what did he do wrong? Why is it on the defendant?
I think had she mentioned in her reply back to him something about partial compensation while agreeing to the change the judge might have awarded a little more back to her. But since she was well aware I guess the judge is implying she can’t change her mind about how ok she was with the adjustment after the fact. Also, I love when JM seems to genuinely enjoy a family’s event. It’s like she wants to appreciate a happy moment before she has to rule.
I cannot IMAGINE traveling to Africa for 6 days. It takes 2 days to get there without the delays. You need a couple days to adjust time change... soon as you are adjusted, it's time to head back. Uggggh.
That is one thing that is keeping me from booking a trip to Botswana. Then there is the $1,000 cost of travels insurance (once you pass 70 cost jump up. Better to book with a tour that offers insurance.
@boomerputt 2 weeks minimum. That gives you 10 days in country. I have gone to a Uganda several times (missionary). It's worth the money, and even the time on the plane. I'm praying I may return someday.
@NubianP6 true. And to get the trip of a lifetime for your granddaughter, any time would be worth it. That being said, if you are planning to go, I strongly recommend 2 weeks minimum. The cost difference is nominal once you have paid for airfare. That's 2 days travel each way, and 8-10 days to spend in country.
While i think both sides are really nice and civil, i disagree with the judgement. Its not the agents fault, but the plaintiff has the right to sue and get the money from wich of the partys she wants. She should have gotten whole thing. The agent could then sue the lodge if he wanted to.
Should never have planned a connection on the same day as arrival even if it is not international travel. Many circumstances can delay that initial flight.
After traveling the world to many countries, sometimes when you get in a foreign country there isn't much you can do. They realize you're not in America and in would cause you 1,000's to sue and on guarantee. Only time we got satisfaction when we were being screwed out about $40,000 was to slip the local authorities a few grand and then they made it right.
Travel insurance isn't for her taxis and meals. Trip insurance would cover medical expenses if she had to cancel the trip and various other things. It was out of his hands, and he really seemed genuine about trying his best to make this right. Losses would never include her 2 days that they were unable to stay at the lodgethat is not on a travel insurance agency. Ive had to obtain travel insurance and as most insurance its cut and dry on what they cover very strict. She likely did have trip insurance, and it seems she may travel frequently.
