Not judging this situation, but from past experiences. I have seen how family don't show up until the person dies. That could be sick in their last days, family will be well aware of it, but only show up when they can financially benefit from it.
My father passed away in January of this year and my mother is still alive. She got everything of course - as the way it should be. It was not much at all. I personally paid for the food for the wake. I also paid for a dinner get together for everybody. I did not expect or want anything. The amount of in fighting over the whole ordeal between the remaining 3 siblings was rediculous. All they did is complain about what the other siblings did for the wake - which was basically nothing. They were so worried about what everybody else was doing, that they should have worried about themselves.
Yes, I found out when my sister passed how no good my niece could be. She stole as much as she could until I became Executor over the estate. She's been a problem the whole way through, stealing, lying and talking bad about me. I want to ensure my nephew gets his share of his mom's estate and she wants everything for herself.
I agree... seen it firsthand aswell. When my grandma passed in the hospital, my mom was with her, and called the relatives when she passed. My aunt ran and got an atty the second she got the call. She also called the other brothers and sisters and talked them into letting her be appointed her to executor. afterwards she gutted my grandma's house, there was a will prepared but not signed, doesn't matter because it vanished anyway, the aunt(executor) sold her house, car, electronics.. everything. the brothers and sisters were mad they couldn't find her jewelry, or her hidden money, which we assume the aunt kept for herself instead of splitting it like she was supposed to. Sadly my moms house was in my grandma's name too so she lost her house and car because she wasn't credit worthy to keep them.. really kicked her hard but shes back on her feet, this was like 10yrs ago, still the family rarely talks to each other. such a shame.
It seems like she was trying to capitalize on her aunt’s death. Aside from not being the estate executor, she had no proof of how much that stuff was worth. The landlord also gave her enough time to remove everything before finally disposing of it.
Plaintiff is filled to the brim with self-righteous and disgusting greed. Like a vulture. Without a leg to stand on. I think the landlord defendant should get the cost of the disposal bill. Unbelievable.
Funny how for 14 years the plaintiff doesn't show up but when it's near the end supposedly last year she's there. Greed will do a lot of things. If the stuff was valuable and the defendant was a crook she would have sold them not got a waste management company to get rid of the stuff.
The family of the plaintiff never coming back to get whatever items were left in the aunts apartment made the defendants version seem to be how the story really happened.
I doubt considering the aunt was on rent assistance, that she had an estate anywhere near $100K.... likely not even close. Generally, an estate less than that does not have to go through probate.... by the tme her family hires an attorney.... it would be a losing deal. They should have gotten the belongings, all those times they were inside. I did not see anything of great value that was left, I think they got what they wanted. Without a will, her son/children would have become her heir(s)..
The plaintiff and her family camed and went in the apartment multiple times and still didn't get all of her aunt's belongings is sad. Why not call a u-haul and get it done the first time. Smh 🙄

As it happens so often, nobody but the landlady did anything for her, but, like vultures, the family swoops in after the woman dies, looking to collect. That woman didn't have much except what the landlady had given her. The plaintiff didn't deny having her live in the basement.
At the end she said that the lady was getting paid. Maybe one of the family members should have stepped up to take care of her? Maybe if anybody in her family gave a damn she wouldn't need a stranger to take care of her.

This plaintiff is outrageous this this was not her apartment and if she cared about her aunt so much why did anybody have to be paid to take care of her. Never t to take care of her Mr pastor's wife. So the state had to pay somebody to care for her. And I believe that that person took her to chemo not the plaintiff...that's gross. And look at the mess that they left behind and they came in many many times and didn't take everything at once!!. This is new to me, (POA) power of attorney is different from executor of the estate. POA speaks for someone who is alive but the exector of the estate is in charge of finance and assets after the person is deceased.
POA is assigned for different things. Someone should be assigned to legally control your finances ( bills, etc) if you're unable to. People should also have a living Will. Medical Power of Attorney. A Will is important. Name an executor ( a spouse is usually automatic), noone can even take a fork out of the home of the deceased, including the Executor. Choose someone you trust. It doesn't have to be a relative. One of my great aunties gave all Power to our Funeral Home director. Lol. Her kids went nuts!!
Wait. Didn't they testify that the aunt had children. I don't know who to believe. My years of working in senior housing tell me that both of these stories could be true or a combination. Some seniors live independently from their families. I had a client who I and the management staff thought that he was alone in this world as far as family goes. He had a non-family member on all of his important paperwork. Thankfully, she wasn't a scam artist. Upon his death, we learned that he had a brother and other family members on the other side of town. From all indications, that's just the way he was. He chose to stay away/disconnect from his family. Fortunately, the young woman was aware of the family and kept them aprised of everything going on with him. As staff members, we were all shocked. I was especially shocked because we had long conversations, and there was never any indication that he had family. We all knew about the young lady. Even if I could share his name, I can't seem to remember it. A gentle giant. I miss working in that area...sometimes. (definitely an emotional strain)
I have an uncle that was being used by 2 young girls that if they asked for something he owned he would just give it to them including buying cars and tablets because he had plenty of money back then and helped his friends...it was only until after the money was gone that they left him alone after 20 years of using him up,1 girl even showed herself by stealing a gun he loaned to her for protection and then he learns they were pretending to be his friends, now I take care of him and he has nothing left after all those years.

Doing so makes the provider feel necessary and inspires loyalty. Auntie knew how to stay in control. Good for her.
My grandma had money, money. When she died her step-daughters took her valuable stuff. Her widowed husband, of course, trusted his daughters but they robbed her dry. My grandma has 3 kids, her step-daughters had no right to her things. She worked hard for that stuff, her husband surely didn't buy it.

But as a man I've always wondered with women who have nails as long as the plaintiff, how do they clean themselves when going to the bathroom. Not trying to be judgmental but she doesn't even seem the type who would have nails like that after listening to her. But it's just too bad that money changes people generally for the worse as shown in this circumstance.
You know, I've been around cancer patients and as they are in final stages, they will sometimes say things that just aren't true. For example, peeing in a jar, so I think the defendant stretched that one.🙄🤨
Defendant is quite a story teller and liar. She never took care of her Auntie. She used the sick woman. Then she did not like it when the Auntie went to life with her cousin to be treated with respect. Defendant will get hers when she is sick and dying.

If you're not on the proxy you can't claim belongings. The estate would go to the kids, wife/husband parents of they not around then siblings.
