He was aware of her medical situation he must have read her personal emails or communications with doctors. It’s disgusting he had no right to read anything on her phone that I would have to do with personal medical records has nothing to do with his investigation. How did he know this information? Unfortunately, HIPAA only applies to “HIPAA covered entities” which for the most part only includes healthcare providers, health insurance companies, and medical billing companies. The police are not a HIPAA covered entity. Neither are 99% of other entities/companies. For some reason, people always think that HIPAA applies way more broadly than it actually does. He prob breached some other privacy laws or policies that do apply to police/gov entities, though.

Not supportive of the prosecution, prosecution doesn't use the drama and know how to ask the questions correctly. The judge and the prosecutor are afraid to let the truth be known but the defense is making sure the jury hears the truth and no amount of the judge telling the jury to disregard it the jury has heard it and does take it in account when making their decisions. Objecting to a text in evidence and its sustained. Why can’t the trooper answer that question? It’s his own conversation entered into evidences. What is the objection. When have we ever heard a case where one can simply say I object with out reason of the objection. I have been backed into by a vehicle and fell down all I hit was a broken bone and bruises no bites and the bruises are where the car hit me and there was a dent in body of the car.

Objecting to a text in evidence and its sustained. Why can’t the trooper answer that question? It’s his own conversation entered into evidences. What is the objection. When have we ever heard a case where one can simply say I object with out reason of the objection. Let’s not forget ever objection sustained is taken out of the testimony and jury is instructed to only regard what is allowed by the judge.
And if I were his parents I would be mortified also.
