  • Do you lose your Fourth Amendment rights when you join the military?
    No, you do not lose your rights against unreasonable searches and seizures.
    Let me explain.
    I'm Cody Harnish, UCMJ attorney.
    The Fourth Amendment protects individuals, including service members, against unreasonable searches and seizures.
    Official intrusions into areas where there is a reasonable expectation of privacy requires a search authorization supported by probable cause.
    So what does this mean?
    Random inspections of military personnel and property or allowed to maintain good order and discipline.
    They actually have to be random.
    They can't just say, Hey, you. Sergeant first class Jimmy, want to look in your car.
    No, it has to be random. Like a random 100% UA your workplace can be searched without your consent because you don't have a reasonable expectation of privacy to the areas in your workplace.
    But within that locked drawer in your room and home, you do have a reasonable expectation of privacy, and they need a warrant.
    Remember, they're always going to ask for your consent.
    A First Sergeant is going to look at you and say, hey, can I can I look in here?
    And if you say yes, you've given consent and they don't need a warrant.
    So don't.
    I understand you have to have balls to say no to a first sergeant, but legally and ethically you can in that situation.

    Lmao you cannot expect people believe in something while other breaks rules. Even animals know this. Of law doesn’t apply to all it doesn’t apply non. EA639

      Military doesn’t give a fuck about privacies or laws. You become property, you lose all your rights
