Mililtary Protective Orders - UCMJ Lawyer Cody Harnish Shares Insights
Think a military protective order is just like a civilian restraining order.
Wrong.
It can last indefinitely and keep you away from your family.
I'm Cody Harnish, UCMJ attorney.
You see, unlike civilian restraining orders, which require a court hearing, military protective orders or MPOs are issued at the discretion of your commander, and they can last indefinitely.
Meaning like forever.
No trial, no hearing, no chance to present your side.
You could be barred from going to your own home, prevented from seeing your children, talking to your spouse, based solely on an allegation and your commander's order.
But here's where it gets tricky.
The Constitution, you know, the document that you're fighting for and some of your buddies died for.
Well, that protects your fundamental right to privacy and family life.
The Supreme Court stated “a parent's desire for and the right to the companionship, care, custody and management of their children is an important interest that undeniably warrants deference, and absent a powerful countervailing interest, protection.”
What sucks is MPOs are generally considered be lawful orders.
Under the UCMJ to protect good order and discipline.
But their legality becomes questionable when it solely impacts your personal family life.
Without a direct military necessity, the line between a lawful order and an overreach of authority gets blurred when your fundamental rights are at stake.
So what can you do?
First, ask your commander for a modification, a reasonable modification, and document those requests.
Second, gather evidence.
Document how this MPO is affecting your family life and how it lacks connection to any military necessity or duty, and seek counsel.
An experienced military attorney can advocate for your behalf.
And show why this MPO is unnecessarily invasive and may exceed its legal boundaries.
What's crazy is that Congress and the president have not put in the law, in the UCMJ a mechanism for a military judge, to overrule an MPO.
So if things really get hairy, consider a 138 complaint against your command.
An MPO isn't just a piece of paper, it can control you, your family, and your personal life indefinitely.

    Hahahahaha! Not quite. 100% search of everything in the barracks, with everything unlocked. Yes, you can say, "no, you can't search my locked wardrobe, which the government owns." Then, they'll come cut the lock, and you'll get in trouble for disobeying a lawful order.

    Hey boss does this include if a drill sergeant asks for a personal belonging such as say a shaker cup? I just got ucmj because a drill sergeant asked me to open and sip my “water” and it was alcohol. Would like some help with this situation I blew a 0.0 in a breathalyzer btw if that helps

    Like many rights, using it doesn't mean you're free from all consequences, just legal consequences. For example, I know an Army Major who was soft denied promotion due to invoking his rights (refused a breathalyzer when there wasn't cause)

    Ok I got my DD214 from the VA archive department. In line 24 Character of Service it says “UNCHARACTIZED” ?????? But I also got a Fomat500 from my reserve that says Honorable Discharge. Do I have the Ability to get VA benefits???

    I'm confused on this video and two others that seem conflicting. On one video you said that a service member may be njp by just a probable cause (20% or less), this video you state that the burden of proof at an article 15, "51% more than likely that you did it", on the other video you state that a commander can't punish on an article 15 / njp unless evidence prove beyond reasonable doubt (95% and up) which states on block 2 of DA 2627. I'm a bit confused on the burden of proof on an article 15 / njp with these 3 video. You can get NJP for just probable cause or proponderance of evidence? But punish only by beyond reasonable doubt? But if choose to proceed with njp you will most likely be found guilty, so this tells me that a commander during the njp will just deliberately categorize the evidence from probable cause to beyond reasonable doubt somehow in order for him to be able to sign that 2627 form and punish the service member and call it a win for the commander. Can this abuse of the commander's authority play out this way?

      In July of 2023, the President signed an executive order that changed the burden of proof for Article 15, and those changes went into effect in Dec 2023. Block 2 used to state "Beyond a Reasonable Doubt." But now it states "preponderance." My video discussing Beyond a Reasonable Doubt at NJP (Article 15) was before the change in the law. Lastly, yes, Probable Cause might initiate the Article 15 process, but it is not supposed to be the standard to be found guilty at an Article 15 . . . sadly, the commanders at an Art 15 do not understand the law or the burden of proof anyways. That is why if you elect to go through with the Article 15 process, you should expect to be found guilty at the Article 15/NJP.

    Its business law. Military is enacts as a Business in the Feds, so due to Business Law, the nature of Service Members are like Employees to commit to a Employment Contract. That also revokes Civilian Rights to receive a Jury. Contextualization is important
