    Sir, I have completed my law degree this year and waiting for my License. I went to the Court and introduced myself to a senior lawyer and I asked him if I can practice under him. I am fortunate enough that he agreed to let me practice under him but he asked me wait for the Licence and I understand his point. Sir all I wanted to know what should I do in this time while I am waiting for the Licence and finally I got the answer from this video. Thank you so much Sir

    Namaste Guruji 🙏 , Well explained all points , basic is the liking for the work you do .If done Forcefully or without liking become a bullwork as myself experience in previous profession . Actually instead of Bar Examination the Council should allocate A Senior Advocate to all LLB passing students since many have no access to such . Internship at this Senior Advocate would be more useful than giving exam again & again .

    if high court could not take up a stay case on the fixed day and fixed another date after 4 months.
    is it possible to get it prephoned??
    since earlier there was vacancy of judges which got filled up now

      Yes if there is urgency in the matter of obtaining interim relief then the case can be got circulated for hearing on interim relief, by personally mentioning the case before the judges by the lawyer.

    sir, good evening
    i have a doubt that we filed a petition for quash in high court against criminal case moved by family member , the case is listed nex month december 2022, in connection to the same in lower court last month October 2022 before filing of quash petition ,an absent petition moved in lower court on hearing date held for EXAMINATION of Accused ,now again NEXT HEARING for EXAMINATION of accused posted in November 2022 ,for the same kindly advice whether accused need to attend lower court for examination and parallelly continue with proceeding for Quash moved in High court ,which was listed next month for admission no notice is served to respondent from high court nor from petitioner end. what steps we need to take kindly guide ....literally confused with present situations.

      Mere filing of a petition for quashing does not operate as a stay to the proceedings in the lower Court. Mere filing also does not guarantee that you will definitely get relief of quashing. That will be decided only after the high court actually passes an order of quashing.
      In such a situation the proceedings in the lower Court continue.
      In my opinion the accused in the proceedings in the lower Court will have to do all that he is required to do in law including attending the proceedings, unless of course the lower court itself grants exemption from appearance.

    सर क्या हाईकोर्ट में पहली अपील खारिज होने पर दूसरी अपील लगाई जा सकती है

      जी नहीं। डिस्ट्रिक्ट कोर्ट में पहली अपील खारिज होने के बाद हाईकोर्ट में सेकंड अपील लगाई जा सकती है। इसका प्रावधान सीपीसी के सेक्शन 100 में दिया हुआ है। अगर पहली अपील हाईकोर्ट मे ही है तो हाईकोर्ट में ही दूसरी अपील का प्रावधान नहीं है। पहली अपील के हाई कोर्ट के जजमेंट के खिलाफ आप को सुप्रीम कोर्ट में मामला दायर करना होगा।

    Hi, I am 37 yr old house wife, cleared LLB in 2021 and given AIBE 17 this year,Due to some personal reasons I am not able to do practice in court .So wanted to know if I can do some short term course or diploma course related to law..like for 3/6 months to utilise this time as I don't want to waste this time period or any other options left for me.please suggest...

      Hello and thanks for your comment.
      Certainly to utilise your time in the most productive way you can go ahead with learning some diploma course of short duration. Learning is growing and that knowledge is definitely going to be useful to you in future some way some day some time.
      But I would suggest choose your course carefully. Let your learning be according to your future practical needs. Let it equip you with some skill which you can apply rather than mere theoretical knowledge. For example a course in drafting. Or it could be any other of your choice which you can think of.

    Sir, you emphasized on starting woth a senior lawyer... but what if I am a person who works best being alone ? What if there are no quality seniors to whom we may look up to? Black hat practice, draftings done by third party and then the senior just speaks what is written in those drafts... english speaking quality is far off... where is the real learning? Shortcuts learned cannot take me long way into this profession...

      As a fresher in the legal profession, it can be risky to not seek guidance from a senior lawyer. While acquiring a law degree provides theoretical knowledge, it does not equip one with the practical skills required to conduct a case in court. Conducting a case involves dealing with the rights and liabilities of clients, and it is crucial to handle such matters with the guidance and supervision of an accomplished senior lawyer.
      I understand that finding a good senior lawyer may not be easy, but it is not impossible. Even if you are not immediately able to find a good senior lawyer, it is still advisable to start with whoever you can join and later keep searching for a good senior to join. This way, you at least manage to enter the profession through a senior, even if their quality may not be ideal.
      I agree with you that shortcuts cannot take a fresher in the long run and should be avoided. Therefore, it is important to keep an eye out for good senior lawyers and be on the lookout for an opportunity to join their office. Networking can be a valuable tool in this regard, and by using it wisely, you can potentially find a good senior lawyer to learn from. Even with a not-so-good senior, there are still many things that you can learn and apply your discretion as to what practices to adopt and which ones to avoid.
