UPDATE (as taken from my twitter) Things are a bit muddy. - I do have written permission from the artist to use the claimed song. - However; the song uses a sample that has been picked up by Warners content ID bot. So I am being claimed for a sample, not the song. I'm still hoping we can resolve this. And take this as a lesson from me: Not only should you ensure you have complete rights to the music you are using for your videos, but also ensure that you ask about any samples that have been used. Otherwise you could end up in this situation (And you wouldn't want that). Will do a video on Tuesday explaining. I am taking a day off tomorrow!
This is blatant abuse of the copyright claim system. There should absolutely be punishment for doing this, or a limit to claims a person can make. This system is absolutely broken, and has to be fixed.
The Solution would be so simple. A strike system for wrong/frivolous copyright claims 3 Strikes and you loose your ability to claim copyright and all claims that are currently in progress will be dropped as asecurity measure.
That'd be sick, but the company who made the wrong claims are the ones who determine whether the claim is legitimate or not. UA-cam needs to fix that function before the system can heal
But the system claims stuff automatically and the copyright owners just give the algorithm the samples to claim stuff. This would only make sense for manual claims.

This whole thing happened *just* when I was lauching my new UA-cam channel in 2019. When I saw this happen to Mumbo Jumbo, I immediately scrapped my musical intro and went with an intro made up of only street sounds that I recorded myself, and I never use any. music in my videos. I'm really happy that Mumbo Jumbo went public with this so that others could learn from his mistakes. And now "street sounds in place of music" is basically part of my brand. So, thanks!

You're SUPPOSED to be able to sue for false DMCA strikes, but youtube has terms that cockblocks you from having the right. It's a point of contention in their terms of service, but so far that's how it goes. UA-cam's system is heavily geared towards copyright holders.
MUMBO, DO WHAT DANNY GONZALEZ DID! When Danny’s videos were copyrighted, he literally tweeted the company responsible and literally told them he was “reviewing [his] legal options” in order to take action against them. He did this to TWO companies and both companies canceled their claims.

Well, youtube "tries" to show the segment of video that was claimed, but its often right baloney. Fir instance CodysLab got a video claimed for LITERAL SILENCE
And repercussions for false claims. Otherwise the claims can still be used to intimidate, harass, silence and financially hurt creators (even if you as a creator win and get the money, it could be held for more then a month and sometimes livestreams and suprchats are suspended until the dispute is over)
@@techie8359 youtube is still protected by article 230 that means they are not liable for anything their users post, the copyright claim system is a privillage, they could do away with it all together and force the claimants to go after the posters directly. This would be a significant increase in the work of the claimants but at the same time youtuber creators will not have the tools at their disposal to counter claim and will have to go through the courts themselves. Either way youtube isnt liable.
Thus is the insanity of UA-cam law. You're better off hiring a lawyer and suing for loss of income. They're hoping you won't lawyer up and take legal action.

If you look at cases like Rodriguez the singer songwriter who is living in poverty despite his songs being known by almost all South Africans, then it is difficult to say whether breaking copyright agreements really is as harmless as people seem to believe.
UA-cam is on a collection course of its own making and everyone is basically forced to watch it happen because there are no viable alternatives. There are some promising ones but they are fairly obscure and it would take some work to bring them to light and even then they aren't all good. Some are just unintuitive and lack basic features youtube has like key word search which makes finding content a nightmare.
This would be like if someone accused you of stealing their phone, then you have to wait in jail for months before you get proven innocent and the accuser gets off with no punishment at all.
I think a lawyer could get ~5 million subs in a few months by representing these UA-camrs in court and making videos explaining the outcome of each case

UA-cam's system has been broken for a while but 400 videos claimed automatically on a channel with 3 million subscribers without any kind of red flag going off is not something that should happen. I hope UA-cam will step back from their 'don't get involved in copyright claims' stance for this one and help you bulk dispute them all. That being said, as Roomie pointed out on Twitter it is also worth checking if ProleteR actually owns the full rights to all his songs - as I know April Showers is mostly a sample of another song. Also I'm fairly certain that you will not get a strike for 'falsely' disputing a claim for the first time round, although the only person who will decide if you are right is someone from Warner Chappel themselves.

I think that UA-cam actually forgot that they not only need big companies and advertisers but also the creators .. This has been happening for months now, the problem is no one gives a shit til it happens to them. Its happened to big names, but the smaller channels are what suffer most and are preyed upon more often. There have been tons of youtubers that this has happened too, over a period of a year, and UA-cam has yet to give a shit. This worked twice for Danny Gonzalez. Make a tweet that is something along the lines of "@WarnerChappel I'm currently reviewing my legal options." I would recommend getting a lawyer to talk to, along with making sure that the dispute is 100% error free, as if it had been written by a lawyer, then copy/paste the message to each dispute. I would also send a message to both youtube and Warner Chappell, asking youtube why this has happened, and asking Warner (as politely as possible) what claim they think they actually have. If Warner responds, that would give you some time to see if their claim could even be considered possibly valid on any sort of grounds, and if not, sue them. They shouldn't be able to defend it if you've done your research. but getting consultation is a very important first step.

There should be a $1,250 fine for each incorrect copyright claim, and no revenue should go to the claimants until the claim has been raised, disputed and finalized in the claimants favour. This is theft from you the creator, it's obtaining money by deception. It should be a civil or criminal offence, and all costs should be born by the claimant, and a $1,250 reparations fee for stress caused should go directly from the claimant to the creator when found to be an incorrect claim

My entire UA-cam channel is dedicated to uploading music compositions I've created - that I made on my own, nobody else. Days, sometimes weeks of time spent making these tracks. No sampling. I don't even use a midi keyboard, just the program. I had been a (hardly) paid UA-cam Partner for a couple of years and then all of a sudden, UA-cam decided to demonetize my channel and all past and future videos, claiming that I was uploading music made by other people. I have not uploaded any music from other people. Just music I have made by myself. Even my status is clear. Absolutely no strikes. No claims. Nothing. I have been through at least 4 or 5, maybe 6 reviews now all coming back saying the same thing - I'm uploading other people's content and my channel cannot be monetized. And of course there is no way to dispute this. They don't even send me any emails. I had found out because I didn't get paid. They won't even tell me what videos I supposedly had stolen.
And then you have to go out of your way to keep checking the status to see if you've been approved or denied, of course only to find out you've been denied and then *they won't allow you to file another review for an entire month.*
I wasn't originally in it for the money, but I'm a single mom without work, and the $100 every three months is better than nothing. Here's the really lovely part... They're still placing ads on my videos.
Yea... companies will exploit it to get money and steal content. So I would recommend you stop uploading music to yt and upload them to SoundCloud or something until this gets resolved. Plus, by claiming your videos, they get access to AND will put a trademark on it and sell it as their own.

There is nothing to resolve. Warner Chappell was correct in claiming the music as they own the original work that was sampled by the artist without him taking a license on it to be eventually used on this channel with a license from the artist who did not have the right to do so. And if WC does not want to give a license, that is their decission.

Lawyer up and go after them for abusing the copyright system. Keep a record of how much money you've lost due to this. I have a strong feeling people would be more than willing to throw a few extra bucks your way to help pay for the expenses. Time to make an example out of them and make sure to drag UA-cam's name through the mud in the process. It's UA-cam's broken system that allows such abuse, and the only way it will stop is if it comes back on them in some way.

@@techie8359 youtube is still protected by article 230 that means they are not liable for anything their users post, the copyright claim system is a privillage, they could do away with it all together and force the claimants to go after the posters directly. This would be a significant increase in the work of the claimants but at the same time youtuber creators will not have the tools at their disposal to counter claim and will have to go through the courts themselves.
Either way youtube isnt liable.

UA-cam's system has been broken for a while but 400 videos claimed automatically on a channel with 3 million subscribers without any kind of red flag going off is not something that should happen. I hope UA-cam will step back from their 'don't get involved in copyright claims' stance for this one and help you bulk dispute them all.
That being said, as Roomie pointed out on Twitter it is also worth checking if ProleteR actually owns the full rights to all his songs - as I know April Showers is mostly a sample of another song.

I would recommend getting a lawyer to talk to, along with making sure that the dispute is 100% error free, as if it had been written by a lawyer, then copy/paste the message to each dispute. I would also send a message to both youtube and Warner Chappell, asking youtube why this has happened, and asking Warner (as politely as possible) what claim they think they actually have. If Warner responds, that would give you some time to see if their claim could even be considered possibly valid on any sort of grounds, and if not, sue them. They shouldn't be able to defend it if you've done your research. but getting consultation is a very important first step.

My entire UA-cam channel is dedicated to uploading music compositions I've created - that I made on my own, nobody else. Days, sometimes weeks of time spent making these tracks. No sampling. I don't even use a midi keyboard, just the program.
I had been a (hardly) paid UA-cam Partner for a couple of years and then all of a sudden, UA-cam decided to demonetize my channel and all past and future videos, claiming that I was uploading music made by other people. I have not uploaded any music from other people. Just music I have made by myself. Even my status is clear. Absolutely no strikes. No claims. Nothing. I have been through at least 4 or 5, maybe 6 reviews now all coming back saying the same thing - I'm uploading other people's content and my channel cannot be monetized. And of course there is no way to dispute this. They don't even send me any emails. I had found out because I didn't get paid. They won't even tell me what videos I supposedly had stolen.
And then you have to go out of your way to keep checking the status to see if you've been approved or denied, of course only to find out you've been denied and then *they won't allow you to file another review for an entire month.*
Working on a similar project with live music. I may not be on it for the money, but accusations against originality that are false is just absurd.

What UA-cam is doing can be seen as illegal. You cannot take away revenue. And you cannot spam users... AND you cannot allow Corporations to spam fake copyright claims. There is nothing to resolve. Warner Chappell was correct in claiming the music as they own the original work that was sampled by the artist without him taking a license on it to be eventually used on this channel with a license from the artist who did not have the right to do so. And if WC does not want to give a license, that is their decission.

Lawyer up and go after them for abusing the copyright system. Keep a record of how much money you've lost due to this.
I have a strong feeling people would be more than willing to throw a few extra bucks your way to help pay for the expenses.
Time to make an example out of them and make sure to drag UA-cam's name through the mud in the process.
It's UA-cam's broken system that allows such abuse, and the only way it will stop is if it comes back on them in some way.
You should know it would be a bit hard to sue a Company since they may have alot of lawyers which is usually the thing with them.

Thing is, UA-cam are forced by law to act this way. Unless the law changes (The DMCA) then UA-cam can't change.
@@alfredo42o the American justice system isnt about how fair or clear your case is, its about how well you can defend yourself. And since defense is buyable. Big companies usually run free. (Plus some laws tend to work in their favor)
@@matteste they could not reward these people until after the dispute is finalized, not giving either party the ad revenue and keeping it all in a pot. Then the only reason to do that would be to troll rather than to (somehow legally) steal money.
