It's not quite confirmed that this has happened. Nintendo has revoked individual certificates for online play if they're connected to online services at the same time, but they likely only console ban for dumps that are on the public internet, not a dump that less than a dozen people have access to.
But what if you buy legit original used games on Gamestop, and someone dumped that game before, you get banned when you are using legit games? That is messed up. Also if you want to use the MigSwitch and not get banned with blacklisted games, have a second Switch on airplane mode always with a separate account than your original Switch and play all your downloaded games to your hearts content. Buy games you want to physically own and pirate the rest. 2 Nintendo Switches, no issues. You will never get banned on your first Switch with your online account, and you can still enjoy all the benefits of the MigSwitch with no risks of bans. You can get a Switch lite for like $100, sometimes less on the used market and a MigSwitch and have all the games you want for free and still keep your main Switch and account safe.
@RealBullbear also, the Switch 2 is coming this year, so my main account is migrating to the Switch 2 with all my original games, and a MigSwitch cartridge is gonna go to my Switch 1 to play all the games I didn't purchased, I missed on but wanted to play. Also, I don't like purchasing digital only titles, but with a MigSwitch, you can kinda have a digital only title on a cartridge.

@gearsandtech it is a huge problem for buying used games because the sellers think they can just copy the game for themselves and sell the real copy so both the seller and buyer can have the same game, but it’s not like that so both would get blocked

Do you want to risk it, I have stopped buying used switch games, and also stoped buying as many switch games (even new ones) because of this problem, as you never know if some out bought a game, dumped it resealed it and returned it to the store, so you think you buy a new game, but it not new but dumped, still a "small" chance but not 0. Unless nintendo does something to protect legit buyers (and you know they will not because that might cost money, and selling a new unbanded switch makes them money they will not do anything)

Are all requests to nintendos server blocked? If yes, then they have 0 information about your console, it wont show up at all, they dont even know whether the console is on or not.
@ I’m pretty sure yes I did all the safe checks and continue to always check if the servers are blocked, I always keep it disconnected to turn the internet when not playing a game.

TL;DR every game has a unique serial number, once a duplicate serial number is detected it's considered a pirate copy, and any console running that gets banned. If you want to pirate AND play online, you're going to need two consoles, one for legit games, one for "backups."
Well, if I ever have or run into an older Switch that can basically be a burner, I'm getting one of these or the Switchit card that does the same thing and is preloaded with 400 games
i doubt that will ever happen, because you can't get custom apps/games on the switch, because all games are signed with a special key from nintendo and the only way to bypass it would be to mod it. if it were to happen, we would need to see bootlegs on the nintendo switch
Another thing i dont know is if nintendo only checks your console or also your dock station... imagine nintendo blocks/bans you cause you used a docking station that came in contact with a banned switch

Since there is such a high risk of someone dumping and then reselling, I would think they would want to avoid bad publicity of banning someone who just bought a legit secondhand copy. It would seem like having a higher number of dupe certificates before a ban would probably be what they would want to do, like at least 3.
There is evidence of same certificate being used twice leading to a ban But I suspect it's the 5, 10, 50 instances of same certificate that are the easy targets
@@k-d-n I think the log could be erased because of factory reset, though Nintendo could also choose to keep the log. If you have a used console purchase scenario like this: Gamer A played some pirated games with the Mig then did a factory reset and sell the console to Gamer B. From the Gamer B's perspective, it would make sense that all the logs get erased because they didn't play those games. But from the console's perspective, the logs should be kept because those are the games played on the console, not necessarily by any individual. What happens to the log ultimately is determined by what Nintendo thinks its purpose is; and whether the log is removed or not can also change in the future when Nintendo updates the firmware even if you test what happens now.
I still have not received my Mig switch dumper and I ordered it last year in August! Has anyone even actually gotten theirs that they ordered yet? I have the switch but it’s useless without the dumper and they just keep stringing me along telling me oh sorry for the inconvenience we’ll get it out to you as soon as possible and then another month goes by and then another month goes by I really think they’re scamming people out of their money nobody I know has actually received one!

Your account gets flagged too. For those of us that let's say use Pokémon Home or maybe NSO or whatever, we're screwed. Get a second hand switch for the mig, it will be the price of 5-6 games... so if you play more than 6 pirated games on the mig+2nd hand switch, financally you are on the win side... also use/create another account for the mig/switch
also question if a person used the dumper for a backed up game or copy etc.. could say you use zelda get all the updates on the console with the actual game... then use mig switch zelda that was dumped will the updates still hold up while playing dumped offline games not the bulk downloaded ones .. would i still be able to say go online with my real copy of animal crossing as long as i didnt use a blacklisted game .. games i would use are dumped ?? your thoughts on this
At this point every time some new flash cart is announced hacking the switch makes more and more sense. To me pirated games aren’t worth the hassle, but i want to play hack roms and use emulators on my switch. I haven’t modded my switch yet, but unless a new flash cart will mimic one of my games to nintendo and open a different thing to play emulators and Pokémon hack Roms i don’t get the advantage

I just hope I won't have any problem using all my games I bought sealed in the next Nintendo console but I plan to create a new account for the next console even tho I register many games when they were new for the nintendo points in the old account, that makes me a bit worry 😅
@@GearsAndTech Yes. Factory reset does not delete telemetry. You need to restore NAND or use something like Haku33 to fully reset a NAND to actual factory.
@@DukePaul it's about restoring it to a clean state where it doesn't have an event for "launched a game with a known pirate certificate" in the telemetry buffer. carts are all customized with a unique certificate at the factory and the ones that land on the internet get flagged for bans. even if you play offline, the console will just tell the servers next time it can. unless you restore to a clean NAND. (going online and then restoring a previous state will also get you banned though) and yes, you can get an unmodded switch that never touched a mig cart banned if you dump your game, put it on the internet, get nintendo to add it to their naughty list and then play that original cart. all copies are considered piracy.
Funny that you say the purpose of the mig switch is to only make copies of your own games when we all know its not ... the purpose is to get pirated games so that you dont pay the huge prices for ok-ish games on nintendo... So best is to get a 2nd cheap switch and use the mig switch with copied games on that one and never go online and use the regular one for online... or you dont care about online and profit with the mig switch... i mean depending on the price for a used switch, i think with the mig, in total it would be the same price as 5-6 switch games... so if you planned to buy 5-6 switch games anyway... just get a 2nd hand switch and the mig and all other games after those 5-6 are for free... except if its and online game, you still need to pay normally for your first switch... with this nintendo move it will just hurt resellers as you need to check if a console is blacklisted /banned and makes a second games market a huge risk as you dont know if a game got its certificate copied ...

I got banned because of a game I bought from a secondhand store. I called 1-800 number (which no longer gets a real person btw) and explained what had happened to Jeremy at Nintendo, returned the game and no longer buy used. They unbanned me because I threatened to sue for all my games locked to the account to be refunded plus hours of my life put into the games lost. They unbanned me faster than I could say my lawyer is on the line with us listening in.

I have mig switch, I just remove the cartridge every time I want to connect to the internet. It's been 2 months and I haven't been banned at all.
If you're using your own backups it'll always work

What if you use airplane mode, play your pirated games, and when your are done, restore the Switch to factory defaults? How can they ban you?
They keep log of all games played. As soon as you connect that log is uploaded
