I always love when the cops say “ err why would they lie”. Well, there’s quite a lot of reasons someone would lie mr Officer.
Exactly, same reason the other people would lie. .. some thief punked this guy with a knife, got a gun pulled on him, and in revenge called the cops so they'd catch him drunk driving. All the sudden you're automatically telling the truth if you are the one that called the cops?
Who says they lied, a lot of people panic when they see a gun and their memories run wild. Either way, self defence, doesn’t matter if he pointed the gun at the guys. The cops are either stupid or racist or both. (Racist b/c he couldn’t speak English well and wrote that off as “lying”)

Heck, a screwdriver is a deadly weapon Showing a weapon within 21 feet is a direct threat to life and health and can be met with the threat of deadly force. Within 21 feet an attacker can close to knife range before you could reasonably draw and fire a handgun.
Assuming there was a knife he would have been within his right to fire once the knife was drawn and brandished.

That's the whole point. Cops can brandish their weapons prior to seeing if someone actually has a weapon. Civilians cannot. I am not even sure why you brought up cops brandishing weapons, it's part of policing. Is that coherent enough?
I disagree with this arrest.
Clearly arrest was justified, DUI.. Charges on the other hand are definitely bogus if the man was truly threatened with a knife.
He brandished a gun, that itself cause grounds for arrest. No matter if you are a CWL of you pull a gun and point at someone you are gonna get arrested.

I don't know but maybe a translator could've helped this situation. The dude obviously struggles with English. Possibly more so since he's drunk(ish). Either way, grab someone that speaks his language & there may be less confusion.
Also, if everyone was drinking Jack then who knows how it all played out. For the officer to just assume this cat was the guilty party from a group of drunkards say so is kinda troublesome.
He seemed legit, wasn't aggressive, sounded honest in the moment, etc etc.....

Idk about Florida, but in Texas, assault is defined as anything from a physical threat to actual physical harm. So if you hold a gun in the air threatening to use it it's considered assault. Now, as far as the truth goes in this situation, I'm not saying that this guy did that. There should've been a deeper investigation, but at the end of the day that's what court is for. Luckily he's able to go to court and things didn't go south on the traffic stop.

Suspect is in the wrong, even brandishing a firearm in Fl is grounds for 5 years imprisonment. The only time a firearm should be mentioned/pulled is if you have to pull the trigger as well.
DAVID REYES many states it’s against the law to show your gun they cal it brandishing, so if someone pulls a knife on me and if I pull my gun I have the legal right to shoot them, but its illegal to pull your gun on someone even if they threatenyou with a knife I’m not sure why, but at that point I believe you have a right to use deadly force, in my state it’s called stand your ground ,

Brandishing is illegal in many states. The gun should only come out if your life is in immediate danger. Some states also have a duty to retreat which means if someone threatens you, you have to do your best to get out of the situation. If you cannot get out of the situation only then can you pull your gun on the other party.
I understand that but look at the state he was in.

A question for any lawyers or those in the know: Does Miranda v. Arizona apply here? The suspect is in custody and being interrogated. Was he read his rights? Are his statements admissible in court? Or was he considered to be in custody leading to arrest? Im curious if his statements about pointing the gun can be admitted. Even more importantly, is it a felony to brandish or threaten with a firearm when you feel your life is in danger from another person holding a weapon?

If in fact the other person was wielding a knife I believe that this guy's actions were justified. Further investigation is needed to prove any type of assault charge in my opinion. The suspect seemed very level headed and was completely cooperative with police.
