Woman at Almost 5 TIMES LEGAL LIMIT After DWI Arrest (0.38% BAC)

- On April 27, 2024 around 9:30 PM, Corporal Michael Yeo with the Bernards Township Police Department was dispatched to the Exxon gas station at 545 Martinsville Road on a report of a 2023 Dodge Durango that had struck a light pole after exiting the eastbound ramp of Interstate 78. According to the report, the vehicle had stuck on the concrete median and was stuck for several minutes until a passerby on the exit ramp assisted the driver out of the vehicle and a gas station attendant moved her car into the Martinsville Exxon parking area. Corporal Yeo arrived on scene at 9:35 PM and made contact with the gas station attendant, who informed him that the woman did not seem injured but definitely under the influence. He then made contact with the driver of the Dodge Durango, who was identified as 34-year-old Nicole.
As he was speaking with Nicole, he detected the odor of alcohol and noticed that her eyes were bloodshot and watery. Nicole was asked to explain what happened, but she denied striking the pole. When he asked her how much she had to drink, she indicated that she had consumed a good amount. Based on her level of impairment, field sobriety exercises were not even attempted. Corporal Yeo placed Nicole under arrest, and retrieved her documents from the vehicle while Officer Gregory Gengaro placed her in the patrol car.
Nicole was transported to the Bernards Township Police Department for further processing. At the Bernards Township Police Department, Officer Tim Polizzi arrived to assist shortly after Nicole was placed in the cell. Corporal Yeo read her the Standard Statement for Motor Vehicle Operators, and she eventually agreed to submit breath samples for testing. Breath test 1 indicated an EC Result of 0.386% and IR Result of 0.397%. After a few failed attempts, Breath test 7 indicated an EC Result of 0.411% and IR Result of 0.417%. After making their calculations based on established NCIC tolerances, the final result was a BAC of 0.38%, nearly 5 times the legal limit of 0.08%.
Nicole was unsteady and she fell in the holding cell, but declined to be transported to the hospital. After she was processed, she was released to her father pending her court appearance. Based on her extraordinary level of intoxication, her father was permitted to come inside the station to take custody of her. Officer Polizzi, along with her father, escorted Nicole through the sally port all the way to his Maserati before deactivating his body worn camera.
Corporal Yeo issued Nicole the following summonses: Operating under the influence (39:4-50), careless driving (39:4-97), failure to obey traffic signal (39:4-81(A)), and delaying traffic (39:4-56)

they can sober up and say they didn't offer the testing opportunity and that gives a lot of power to the defense. the tests aren't important in court, but following protocol is.

This girl would lose her privilege to drive for 2 yrs, pay a minimum of $3100 in fines and 12 months in jail if she was in AZ. After all of the above was completed and she wanted to reinstate her DL the MVD will require a SR22 or $40k plus a breath ignition in her vehicle for 2 yrs w/ restrictions on where she can drive. Usually work and back.

I think the dad was extremely frustrated, disappointed and probably a lot hurt by her conduct. He just happened to say a couple of minor things to the cops. I’m sure it went right past them. They were just happy to get here gone.

The highest ive seen was working in emergency department, patient in full cardiac/respiratory arrest, labs revealed a 0.60 BAL. Person died ,literally drank himself to death. Bartender got charged with manslaughter

Wow holy sht. I’m surprised also that the bartender was charged. I don’t know the particular story, but sometimes people can have huge alcohol tolerance and it’s hard to tell they are with high levels. I had a friend who would seem normal, like just buzzed having a good time. But the next day when we’d talk about the night, it turned out he was in a blackout and didn’t remember.

My sister and her husband made their son spend the weekend in jail after his 1st (and so far only) DUI. My nephew is so special to me and I know how hard that was for my sister. But he needed to learn that lesson. He hasn't had a drink since then! That was 2 years ago.
Some jurisdiction require that they stay in jail until the person sobers up which is usually overnight or 12 hours.
It's called tough love. It is sad to see that people allow their children get away with murder these days with no consequences. I don't understand how people think this is acceptable behavior. I agree with letting her stay in jail. Her being in this state is a danger to herself and others on the road even with her in the passenger seat. wow. I really hope daddy doesn't get her out of the situation completely without consequences.
My brother got put in jail for 6 months. Not drunk driving. None of us in the family would bail him out. Told him he put himself there he could get himself out. Later he told us that’s when he realized it was time to grow up and he’s been out of trouble since then.

With a BAC that high, she should’ve been hospitalized, numbers like that are incredibly dangerous. There’s 7 levels of alcohol intoxication, her numbers are indicative of reaching stage 6, which is at risk of death

She's got a working cellphone. She's on the phone, so her fingers work. Obviously, she can afford an Uber and was physically able to call one. Her BAC is insane! 0.38%!!!! This is officially the highest BAC I have ever seen on any bodycam video. Wow. The highest one was the NJ Police Lieutenant at 0.36% on Real World Police and the woman at 0.365% on California Bodycam (in case anyone else is interested) How is this woman standing!!! This is a new record.

I was at a .39 one time when a friend called for a mental health check because I was completely hysterical about something. Talking to me she has no idea I was wasted. None. (She lived in a different state). I was transported for a mental health hold and only then was it realized that I was wasted. I still had another bottle of vodka that I had just started. I would have drank it and died that night.

Yep. We need more officers that make going to jail seem like reuniting with old friends. Keeps them coming back for more.
If you base your opinion of our officers off of what you see on MSM or even SM then of course your opinion will be negative. It's all they show. Good cops don't get as many views and they also don't stir the pot of division. We have many, MANY, amazing officers across the entire country.

Did you know there is a liver disorder called HELLP. It’s seen in pregnancy not with alcohol but this ladies liver is probably begging for its own syndrome/disease name. That is some serious habitual tolerance to not be unconscious or having seizures with a level that high!

I'm Australian and I must must say these officers did an incredible job. They treated the drunk Nicole with extraordinary care and respect. I hope her family can get her all the help she needs.

My daughter works ER, ICU, etc. She just had a drunk young girl, 22 years old, DIE from alcohol poisons, her BAC was .04+..i can NOT stand a drunk and especially a drunk driver that literally KILL people!! Why do they get a slap on the wrist IF that UNTIL THEY DO KILL SOMEONE! I know a lady that her and 3 of her children were coming home from a ball game her son was playing in. His girlfriend was also with them. A drunk driver KILLED ALL THREE OF HER CHILDREN, she and the girlfriend was seriously hurt and took them years of therapy to even walk again. He lived and only got 7 years!! That was vehicular homicide!! It was a joke! Their lives are totally destroyed and that man will be out doing the same thing again!!

First of all, it’s useless to argue or attempt to make sense when a person is drunk. Secondly, 0.30 is a deadly alcohol level for almost everyone. For her to be this “conscious” at that level, proves she’s far into an addiction. No sense in aggravating and/or escalating the situation to a non coherent person.

WHY do the police wait 20 minutes before giving her a breath test? Wouldn't that allow the body to produce a lower BAC result? Those LIPS are horrible!
If she was just drinking her BAC is probably still rising.

I believe the reason is that they have to “observe” them for 20 minutes…ensuring that nothing skews the breathalyzer, i.e. drinking cold medicine, using mouthwash, even burping, vomiting, etc …since those things can contaminate or make the test read higher…

When I was at the peak of my drinking, a friend of mine was so worried about my mental health. She implored me to drive to the hospital because I was so distraught about something, she thought I needed to be on a mental health hold. She asked me to drive to the hospital and go there. I told her I couldn’t because I was wasted. She had NO idea from my speech. She called the sheriffs office to have them do welfare check. They transported me to the hospital themselves and I was put on a 24 hour hold. At which time, my BAC was .39. So, you can imagine the level of drinking I had been doing for awhile for my friend, an ER nurse and her husband a, a doctor, could not tell by my speech that I had drank that much. I had just started another bottle of vodka so if not for the grace of God and her concern about my mental health, I would have drank myself to death that night.
All that alcohol went to her lips
