    This case is so sad and infuriating. The saddest part is the fact that someone killed a 12 y/o child in this horrible manner and the same person is roaming around freely in society. It’s astonishing to think that people can commit such heinous crimes against children, it brakes my heart every time.

      I thought about it a bit more since you posted. If people have not had good experiences in childhood themselves, maybe disrupted living arrangements, fractured schooling, well it kind of sets them up for failure. On the one hand not fit to become a parent so young, romantic relationship doomed to fail and no-one has noticed that it is allgoing wrong

    • @tlc6756

      @@dd-jm1md it's not victim blaming. So many times women shack up with almost complete strangers trying to fullfil their own needs regardless of how it affects the children. Although predators are often charming in the beginning, the mother has the responsibility of making sure someone is a safe person to bring into their children's lives... especially if they end up living together. If a mother let's her two year old play outside alone near a street, and a speeding car hits that child, of course the person behind the wheel should be held responsible, but most people would hold the mother accountable too. This situation is not as extreme of course, but children don't have a choice of who their mother brings into their home.

    I know I should be sympathetic to the mother, and I am sorry she lost her child, but having had a mother who brought strange men into my life as a child, it just infuriates me when a mother places the well-being and happiness of her children lower than her romantic life. It's an automatic response on my part, I can't be objective.

      @@PutinsMommyNeverHuggedHim If that really was the sole reason she broke up with him, then that's great on her. I'm not denying that and obviously, she didn't deserve having her child murdered. • @bluevioletandlilac
      @bluevioletandlilac 2 роки тому +13

      @@PutinsMommyNeverHuggedHim There are a ton of other people on here talking about how the mother brought this man into her child's life. That's undeniable. And when a mother does choose to bring someone into their child's life, someone who proves to be harmful, that is, ultimately, prioritizing romance and sex over your kid, even if the mother does have the sense to end it after awhile. It's still her actions that have impacted the child.
      I'm sure she's grieving and regrets it, but it's too late for her son, isn't it? He's the victim in this, and I have a very hard time due to my own experiences feeling sorry for a mother who brought a man into her children's lives, who then went on to victimize them. Is she the worst person in this? Hell no. But when you have kids, you have a much larger responsibility than dating.
      Also, given the very similar situation, I don't feel I'm projecting onto a stranger. I'm giving the point of view of a child in that type of situation, which you've obviously never been.

    One thing about Nick being at the school: He lived with the family. He knew their rules and routine. Garrett had a firm rule that he was to come straight home from school and do his homework, and only when done could he go out to play. He broke the rule that day and stayed after school with friends to play basketball in the gym. He called his mom right before being seen leaving, and told her what he had done. She told him to leave immediately, go home, and do his homework. That's when he was seen on the skateboard heading home. So Nick had no idea that Garrett would be at the school at that time. He would have expected Garrett to be home doing his work, as was his rule and routine, which Nick knew. Nick would have had no reason to go to the school at that time to find Garrett. He wouldn't expect him to be there.

Someone who wanted the mother back as a romantic partner and too many things were inconsistent ~ Nick was scouting for new talent in the rain far from the field and he took a left instead of a right to exit the parking lot? You can tell by the way he was driving that he was stalking Garret and he had a scratch on his ankle? The only reason he got away with this crime was because of his race and he hired a TEAM of lawyers from his own town to prove it. And he was in the mother’s apartment watching her sleep? That’s concerning and indicative to narcissistic behavior. That poor mother! But I do agree she shouldn’t move her boyfriends into her apartment so soon after a breakup, this is certainly dangerous! Not that she deserved this! May God bless her and her family.

  • @AM-cs9ke
    @AM-cs9ke Рік тому +5

    I enjoy the show, but "I think Nick was responsible" and he was prosecuted out of "frustration and incompetence"? I think the word "corruption" needs to be in that second clause, and it should cast serious doubt on the first. There was, according to multiple judicial reviews, never enough evidence to suppose Hillary was responsible for Phillips's death. A conscientious DA refused to prosecute, another DA (who later had her license suspended for hiding witness statements relevant to this case) attempted to prosecute but the case was dismissed for lack of evidence. She finally got an indictment after a public campaign, but Hillary was found not guilty based on the preponderance of the evidence presented. The exculpatory evidence the DA hid was a statement by a witness placing Jones at the crime scene (doesn't mean Jones was there, but the witness said so, and the DA hid the statement). The prosecution did not challenge the decision to exclude DNA evidence in large part because the amount of Hillary's DNA present on Phillips was not consistent with Phillips defending himself against Hillary but was only consistent with Hillary being present somewhere in Phillips's home or being in casual contact with Phillips at some point in the recent past, which were established facts. The new prosecutor stated, after the revelation of the witness testimony placing Jones at the crime scene, that he had no case but dutifully saw the trial to its conclusion out of respect for Tandy Cyrus and her family. Good on him (maybe?) but in his closing argument all he could do was rest his case on the video of Hillary turning left out of a parking lot instead of turning right. The prosecution had nothing more than that. They never did. They had much more on Jones, however, starting with a witness placing him at the crime scene. The video of Jones walking the dog was not viewed as completely exculpatory because he lived so close to the crime scene (i.e., a reconstructed timeline does not exclude the possibility of Jones committing the crime and getting home to walk his dog). Jones had a record for being violent and confrontational, and Tandy Cyrus formally complained that he was stalking her and that she feared him. Jones also tried to get back at Tandy Cyrus after the breakup by filing a retaliatory lawsuit against her. Jones also actively attempted to monitor the investigation using his position (records of his calls are available elsewhere on the internet). Was Jones guilty? He was never accused, and, even if he were accused, he is innocent until proven guilty, but once the hidden witness testimony emerged, the prosecution all but abandoned its flimsy case against Hillary. Does that mean Hillary did not kill Phillips? I suppose not, but as of this moment there is no evidence suggesting that he did, despite the efforts of a discredited county prosecutor and an interested local sheriff's deputy to create that narrative.

    Interesting that a bench trial was chosen. I would like to know the lawyers’ thoughts on this. I would guess that when a case is circumstantial and / or there is risk that a jury might be biased against the defendant, a bench trial is a better option for the defense. I often see comments on this channel that demonstrates a tendency to massively overvalue certain unreliable evidence. Blood spatter analysis, interpretation of emotional reactions, and of course the rare but shocking “dog psychoanalysis” come to mind. A judge would probably assess these more accurately than a random juror. Of course if the case against you is very strong then you would want a jury. You only need one person to dissent for a not guilty verdict.

    • @brucejohnson9696
      @brucejohnson9696 2 роки тому +9

      Actually, if only 1 juror dissents, or if the jury isn't unanimous, a mistrial is declared in a criminal case. The defendant can be tried again in the event of a mistrial because there was no verdict.
      Maybe the defense opted for a bench trial thinking a fair judge would better understand reasonable doubt and would be less likely to go on just emotion.
      A jury might find this guy guilty because he was about the only person who would have had a motive and his story had some problems.
      He probably did it. "Probably" isn't supposed to rise to the level of the "beyond a reasonable doubt" standard, yet it often does just that when decided by highly subjective laypersons.

    I followed the case on TV on dateline. I was so sure Nick was innocent. I was so “sure” he was a singled out black guy. Then as I watched the case I was convinced he murdered Garrett? There was things Nick said that raised hairs on my back. The cues of his actions denoted, imo, his guilt. His aversions of: “I don’t recall” as questions were asked him…….these raised huge red flags. And the injury of his ankle was a result of him jumping out of the window, imo. His statement of moving furniture doesn’t jive. He’s an athletic soccer player who’s pretty strong. Old weak folk may get injured from moving furniture? But not an athlete like Nick. He claimed the ankle injury was before Garrett’s death? Seems like a lie? It was later proven that the scrape he had on his ankle was fresh. Unlike what he said: “I injured my ankle days before his death”.
    He also didnt answer questions as to what furniture he was moving? Something an innocent person would gladly answer to.
    And you can clearly see he stalked Garret home on the cctv at the school Garrett attended. But Nick claims he went to the school to watch a soccer game? But it clearly shows him leaving the school parking lot as Garret was leaving with his scooter device. You can see Nick reversing out of the lot as Garrett left school. Coincidence? Nick also says he went to the assistant coaches home after “watching his soccer game”. I believe he went there after quickly killing Garrett, then Nick hurried over to his assistant coaches home to establish his phony alibi. I honestly feel there were heated words exchanged between Garrett & Nick? Heated words that only the two of them know. Garrett may have said racial slurs that, perhaps, caused Nick to want to strangle him then and there? I believe Nick deeply begrudged the little boy for racial slurs and also ruining his relationship with Garret’s mother. I simply believe Nick was so vengeful toward that “little punk” that he literally wanted satisfaction in seeing him dead by strangulation. Im afraid that Nick got away with murder

      Perhaps Garrett did not like the way Nick treated his mother and that is why he did not like him. Otherwise, what boy would not like a sporty and fun boyfriend? Why assume Garrett's dislike is racially motivated?

    My personal theory is It could of been some random unhinged adult townie that Garrett pissed off. This is just an example; but lets say Garrett was skateboarding and cut some angry adult in a car off without apologizing or sometime petty like that. This person was unhinged and annoyed and followed him home. My question to this whole case that still has me scratching my head is why couldn’t they pull proper testable DNA from the skin under Garretts fingernails? I feel like that could of been a smoking gun to solving the crime.

    I’ve been waiting a long time for you to cover this case. And like always you omitted things. When Nick and Tandy. was together they both had filed police report on John. And John also had threatened to kill her kids in the past. why would Gerrett Philip open the door for Nick if he didn’t like Nick. No I witness saw a 6 foot 2 black man jump out of a two-story window in a white neighborhood. Even the judge knew they had nothing on him. Also they did not obtain a warrant, they made him strip naked inside the police office of hatred. You gotta watch the dateline episode.
