      President can send in the marine corps without approval from congress though. He can also move naval ships around the world and position them in places to combat pirates/terror. Having essentially full control of all 4 branches of the military is a lot of responsibility.

    I just need to correct Stephen A. Smith. A United States President does not have the power to declare war on another nation. Under the Constitution, a war must be declared by an act of Congress. This is why the Korean War was not technically a war, but a "conflict" or a "police action," because Congress never declared war against North Korea. See Article 1, Section 8 of the Constitution.

And the documents case shows a double standard since they aren't prosecuting Biden for the same thing.     Never in our history has a president ask for complete immunity. Why now ? I'm not sure about giving a candidate who says he will be a DICTATOR for 1 day complete immunity is wise.       Presidents have always had it, just never a SCOTUS ruling clarifying it. Why is Barak Obama free instead of being jailed for kill a 16yr old US citizen without due process. Because he was president and protecting national security was part of his powers and obligations. Clinton got sued by Gennifer Flowers and was told that he wasn't immune since it had nothing to do with his job, powers, nor obligations as President.
      And when did he say he was going to be a dictator on day 1?

      Sure but that is not the issue that was brought before the court. What was brought before the court was the fact the trump tried to overturn an election that he lost. Which one of his actions to do that fell within his official capacity as potus? The conservative majority deflected from that and then told the lower courts to figure it out.

    Every President has had immunity. If not, they all could have been arrested. Any military action taken by a President outside of congressional approval would be considered a crime if not for immunity

    This is intellectually dishonest and shows Stephen A. Smith’s ignorance and lack of understanding the nuance. There already was a vacant SCOTUS seat when Obama asked RBG to retire…….Mitch McConnell and the GOP, who had the senate refused to bring that vacant seat to a vote. Had RBG retired, what the F do you think would be different. It just meant that 2 seats would have still been pending the election results. You’re not spouting facts if you don’t take the FACT into consideration. That is why I’m calling this segment intellectually dishonest. No offense, sir. However, you made the claim that RGB and the democrats caused the 6-3 swing, which is false. Mitch McConnell denying bringing Obama’s nominee to a vote is what.
    And just remember McConnell’s reasoning was because we are in an “election cycle.” Don’t give me that….,see how Amy Comey Barrett was nominated and pushed through.

    not sure how RBG is a good example… Obama would have had to replace her in his first term, because McConnell refused to bring any Obama nominee to the floor (Garland) in his second term, claiming some bogus tradition

    The Jackassary in the comments is wild. Presidential immunity has always been a thing but in our almost 300 years it’s never applied to criminal acts. The ruling by SCOTUS would have legalized watergate for example.

      What about any time a politician has said "fight for our rights", or "fight for our freedoms", or "fight for democracy" - is that inciting violence?
      Or... would a person using common sense (which is apparently quite uncommon these days) conclude that these are mere figures of speech, not to be taken literally?

      @@Wilky2526 Peaceful protesting is only one part of American people I call it putting folks on notice you have to follow up by voting which is the most important part of making your voice heard. Now to what you preferring to Jan 6th folks that there was not a protest it was a riot by certain crazy number of people that believe the election was stolen from Trump and Trump knew by using certain key words that would set these certain individuals to do what they did on that day. I understand those folks were concerned they believed Trump won and Biden loss and that’s fine they have that right although the facts says other wise but I’d leave that for another day, in the end there another election wait for the election and make your voice heard and encourage people more people to participate in the process and vote. No need to follow a fool and literally fall for okie doke and do what he literally said do.

    The President can deploy the Military into a hostile conflict zone, but he cannot declare war only Congress has that authority. But I get what Mr. Smith is saying. When drafting the role of the Presidency, the Founders viewed him as an Executive who would carry out through the agencies of the Federal government, & enforce the laws or directives Congress passed. It was not viewed as a figure of hyper partisanship who would nominate only judges he or his party alone wanted to get preferred results, instead he was to pick experienced wise people to work as judges of the law to interpret the Constitution's meaning & carry out justice.

    May you should re-read the constitution bc it obvious that the president cannot declare war without legislation. And again if weapon is made in your country and finance by your country taxpayers money you have a right to decide who you give it to.     7:51 massive context being left out… RBG didn’t step down because of what happened when Barack Obama selected Merrick Garland to the Supreme Court in Feb or March, and the republicans in Congress sat on not voting the pick until after the election in November. She knew they would have used the same excuse and not allowed the pick to go through.
