I immediately went to the merch store to try and grab a virtue glens and shirts before they were gone, but no luck. its just a name though. keep up the great work. the community appreciates and supports you guys in every way..i would really like to make the 8 hour drive up there sometime
Life happens...no biggie. Even if Buffalo Trace changed their name, I'd still drink their bourbon. You tried, made a mistake, and fixed it. Don't let it beat you up. On a side note, your entry level bourbon should be "EverNorth"...kind of like Buffalo Traces's entry level is...Buffalo Trace. Just my 2 cents.

I realize a lot of people are attached to the Virtue name, and I'm not trying take anything away from whatever that name meant to you guys. But I think Evernorth will end up being a better vehicle for your ambitions in the grand scheme.
Evernorth is a super cool rebrand!! It’s super unique and honestly stands out more than Virtue does! Obviously the hours of brainwork and branding put into the name Virtue was cool as well, but I think Evernorth is going to catch on fast and help to stick in the back of people’s minds until they get the chance to try it! Hell, E&J gallo is never ending rebranding naming everything they make, sometimes it’s a 3 year process of adding a word shrinking a size of a word and over 3 years its name is different and we never noticed.

Yeah, nothing ever good comes out of trademark infringement claims. I've been involved with a few in my career. Its usually the bigger guy with deep pockes that wins. And anhowsyourbush has very deep pockets and the capability of making life miserable.....and lawyers rich. I’m starting a seasoning company and laid in bed many nights thinking of names. It was harder than naming my child lol. I finally settled on one and what’s happening to you has been a legit concern of mine. I have the LLC but have not applied for a trademark yet. Guess this is my sign to get on that.

Great call handling this now. My wife recently had to rebrand her 9 year old business because even though the USPTO granted her a registered trademark on her business name, it turns out that a company has been using the name under an intent to trademark for 12 years and when they went to finalize their registration they ran into ours. So, they threatened to sue. We spoke to a few trademark attorneys (seriously...why are some of them suck terrible assholes?) and they all basically said "You can fight it, but you'll lose, and it will cost more money than you have to do it." It was a nightmare. I would have given anything to have fixed this problem before it started...

This sucks, but is the sad reality. Trademark in the alcohol world is beer, and then every other type of alcohol. I'm honestly.... a little surprised if you did a proper trademark search, that Virtue didn't come up as problematic, as they weren't exactly a small producer. I say that as part of a cidery who went through it's own trademark worry that was even far less similar, but just had 0 money to fight it, especially with no legal fee claim possibilities in those legal battles (ironically in opposition to a spirits co). Pick yourself up and keep going. Sucks you lost all the branding money/work you did, but it's the fact of life.
As a non lawyer/non trademark expert Virtue was clean under everything except cider and wine (there are actually two approved nationally). I didn't know Cider is the same as liquor (as they aren't in other categories of business like the ttb/state/federal levels of law). Only the USPTO considers them the same class.
As a former business owner who went through a similar problem (not in your particular industry)...the EMOTIONAL attachment to the NAME will pass. Trust me. It will. In 5 years, you and more importantly...YOUR CUSTOMERS...will only know the name you have NOW. Not the name you had 5 years ago. Best of luck, boys. Evernorth sounds like everclear…should have just called it Bourbon Junkies Spirits. And had Junky lines of different whiskeys. Everyone who follows the channel would easily identify your bourbon that way and would connect the two together.
This may sound dumb but flip the V up side down now it’s Aiture spirits but still virtue for the fans but for legal reason it’s “airture spirits”. Plus what alcohol company has that name trademark. But I agree with Evernorth!

I was pretty bummed for you guys at first... And then I saw Evernorth. That's a killer name. All the best going forward!
Evernorth sounds like everclear…should have just called it Bourbon Junkies Spirits. And had Junky lines of different whiskeys. Everyone who follows the channel would easily identify your bourbon that way and would connect the two together.
To be perfectly honest. I like the new name better.
This may sound dumb but flip the V up side down now it’s Aiture spirits but still virtue for the fans but for legal reason it’s “airture spirits”. Plus what alcohol company has that name trademark. But I agree with Evernorth!
Love the new name! I wonder how many names AB has registered just to squeeze IP out of everybody. They've tarnished their wimpy brand without even using it. EverNorth sounds like a battle cry if ever I heard one.
